לפני בקשה לפסיקת הוצאות מטעם העותר בהליך שבכותרת. עניינה של העתירה בבקשת העותר לקבל לידיו את פרוטוקול הדיון של הרשות המאשרת, כמשמעותה על-פי חוק התגמולים לנפגעי פעולות איבה, התש"ל-1970 (להלן: "החוק"). במסגרתו של הדיון האמור, הוחלט שלא להכיר בפציעתו כפגיעה כתוצאה מפעולת איבה. העותר טען כי גילוי הפרוטוקול, המפרט את נימוקי דחיית בקשתו, נחוץ לו לשם ניהול ערעורו ומיצוי זכויותיו בפני הרשויות ובית המשפט. מכאן העתירה, אשר הוגשה ביום 19.12.2007. ביום 5.2.2008 התקבלה הודעת המשיב ולפיה הרשות המאשרת החליטה להכיר בפציעתו של העותר כפגיעת איבה. לפיכך נתייתרה העתירה ונמחקה בהחלטתי מיום 17.2.2008. למרות מחיקת העתירה עמד העותר על הוצאותיו.

העותר טוען כי הבקשה להכיר בפציעתו כפגיעת איבה הוגשה למשיב ביום 17.9.06, ונדחתה על-ידו בלא כל נימוק ענייני ביום 10.4.07. מאז ועד להחלטה להכיר בבקשתו לא הומצא מידע חדש או שונו הקריטריונים הקבועים בדין. לפיכך לא הייתה כל מניעה להכיר בבקשתו כבר בשנת 2006, ועל המשיב לשאת בהוצאותיו, אותן הוא מעריך בסכום של 7,000 ש"ח. המשיב מסכים לבקשה ומציין כי הוא מייצג מכוח החוק את הרשות המאשרת, אשר היא שדחתה את בקשת העותר ואת נימוקיה ביקש לחשוף. כן מציין הוא כי עם הגשת העתירה נפתר עניינו של העותר במלואו ולא רק עניין חשיפת הפרוטוקול, ללא צורך בדיון משפטי.

לאחר שעיינתי בבקשה ובתיק בכללותו ובשים לב לבג"צ 842/93 אל נסאסרה נ' שר הבינוי והשיכון , פ"ד מח(4) 217, כמו גם לעמדת המשיב, מסקנתי היא כי דין הבקשה להתקבל. מן החומר שבתיק עולה כי אכן נמנעה הרשות המאשרת מלנמק את החלטתה בעניינו של העותר, וכי נסיונותיו של העותר לברר נימוקים אלו, לא צלחו. בנסיבות העניין, ובפרט נוכח היעדר היכולת לדעת את טעמי הדחייה על אף צירוף האסמכתאות הנדרשות, מצאתי כי נמצא צידוק בהגשת העתירה דנן, כמו גם קשר סיבתי מספיק בין הגשת העתירה לבין קבלת הסעד עקב בחינה מחודשת של ההחלטה בעניינו של העותר. לפיכך, ובאין נתונים נוספים, שוכנעתי כי בנסיבותיו של מקרה זה יש אפוא מקום לחייב את המשיב בהוצאות העותר. אשר לשיעור ההוצאות, הרי שיש לקחת בחשבון את פעולותיו של המשיב לשם מתן פתרון מהיר לעתירה בלא צורך בקיום דיון. בשקלול כלל הנסיבות ולאחר עיון בעתירה עצמה, ובאין ראיות מטעם העותר להוצאות הנטענות על ידו, יחויב המשיב בשכר טרחת עורך-דין של העותרים בסך של 3,000 ₪. סכום זה ישא הפרשי ריבית והצמדה כדין מיום מתן החלטתי זו ועד לתשלום בפועל.
