השופט ס' ג'ובראן :
עניינה של העתירה שבפנינו אפוא, היא בבקשת העותר, נהג מונית המסיע בין השאר לקוחות משדה התעופה בן-גוריון, כי נורה למשיבה ליתן טעם מדוע לא יתאפשר לו לזמן עדים רלוונטיים ולאפשר את חקירתם במסגרת שימוע בפני הוועדה המייעצת למנהל שדה התעופה. יצוין, כי בעתירה המקורית, נכללו שני עותרים נוספים אך לבקשתם, ההליך שבכותרת נמחק ככל שהוא נוגע להם. לפיכך, ההתייחסות להלן תהיה רק לטיעונים הרלוונטיים.
המשיבה הינה תאגיד סטטוטורי הפועל מכוח חוק רשות שדות התעופה, התשל"ז-1977. על פי סעיף 30 לחוק זה, רשאית המשיבה לקבוע כללים לניהול והפעלה יעילים של שדות התעופה בישראל. על סמך האמור, בכללי רשות שדות התעופה (הסעת נוסעים במוניות מנמל התעופה בן-גוריון), התשמ"ג-1983 (להלן: כללי המוניות ), מופיעים קריטריונים שונים המסדירים את התנהלות נהגי המוניות שמעוניינים לעבוד בשטח שדה התעופה. בנוסף, כללי רשות שדות התעופה (שמירה על הסדר בשדות התעופה), התשמ"ד-1984 (להלן: כללי הסדר ), קובעים הנחיות התנהגות כלליות החלות על כלל האנשים השוהים בשדה וממילא גם על נהגי המוניות. בין השאר, סעיף 2 לכללי המוניות אוסר הסעת נוסעים שלא בהיתר קבוע. סעיף 7 קובע חריג המאפשר למוניות לקחת נוסעים משדה התעופה גם ללא היתר כאמור, אשר מותנה באישור על פי התנאים הקבועים בסעיף 8. סעיף 13 לכללי המוניות, מחייב נהג מונית שלוקח נוסעים על פי סעיף 7, לעצור בנקודת ביקורת ולהציג למפקח את האישור לנסיעה. תלונות כנגד נהגים העוברים על כללי המוניות והסדר, מוגשות על ידי מפקחים. התלונות מוגשות לדיון לוועדה מייעצת למנהל השדה. על פי סעיף 13א(ב) לכללי המוניות, סדרי הדיון ונוהלי עבודת הוועדה נקבעים על ידי מנהל השדה. עם קבלת המלצות הוועדה, למנהל השדה סמכות, לאסור על המפר את כללי המוניות או הסדר את הכניסה לשדה התעופה. על החלטה זו ניתן לערור למנהל רשות שדות התעופה והחלטתו היא סופית.
לאחר שהעותר קיבל עשרות רבות של דו"חות מאת המפקחים וכן שני דו"חות משטרה, בשדה התעופה בן-גוריון, נשלח אליו זימון להתייצב לשימוע בפני הוועדה המייעצת שתדון בעניינו, כדי לאפשר לו למסור את תגובתו בהתאם לסעיף 13א לכללי המוניות. עקב דחיות שונות, נכון להיום השימוע עדיין לא התקיים. בפניותיו למשיבה, במסגרת הבקשות לדחיית מועדי ההתייצבות, דרש העותר בין השאר לאפשר לו לזמן ולחקור במהלך השימוע את המפקחים החתומים על דו"חות האירוע ואת האחראי על אגף פיקוח המוניות. בשני מכתבי תגובה, מיום 18.1.2009 ומיום 29.1.2009, סירבה המשיבה לזמן לשימוע עדים ולאפשר את חקירתם.
לטענת העותר, קיימים אי סדרים בהתנהלות מחלקת הפיקוח של נמל התעופה בן-גוריון, הכוללים התנכלות, רישום דו"חות כוזבים וענישה לא מוצדקת כלפי נהגי מוניות שאינם מחזיקים באישור קבוע לעבודה בשטח שדה התעופה. כמו כן לדבריו, התשתית הראייתית שמוכיחה כי הוא עבר על כללי המוניות, רעועה ולא מבוססת די הצורך. נוכח סירובה האמור של המשיבה, מבקש העותר לאפשר לו לחקור את המפקחים שחתמו על הדו"חות, במהלך השימוע בפני הוועדה המייעצת, כדי לאשש את טענותיו. לשיטתו, השימוע המדובר הוא הליך בעל אופי שיפוטי ומכאן שהוועדה מחויבת לערוך חקירת עדים, לרבות חקירה נגדית.
המשיבה מצידה טוענת, כי דינה של העתירה להידחות על הסף מחמת חוסר ניקיון כפיים של העותר. זאת, מאחר והעותר הפר באופן עקבי את כללי המוניות, גם לאחר קבלת דו"חות רבים וזימונים לשימוע בוועדה. כמו כן, הלה לא צירף לעתירתו את הדו"חות שקיבל מאת המפקחים ואת הודעות הקנס ממשטרת ישראל. לגופם של דברים, נטען כי השימוע בפני הוועדה הינו הליך מנהלי ובמסגרתו אין חובה לאפשר זימון עדים וחקירתם. עם זאת, מדגישה המשיבה כי לעותר וודאי תינתן זכות מלאה להציג את כל טענותיו בפני חברי הוועדה.
לאחר עיון בעתירה, מצאנו כי דין העתירה להידחות על הסף, בשל העובדה כי מ דובר בעתירה מוקדמת. כלל הוא שאדם חייב, לפני שהוא מגיש עתירה לבית משפט זה, למצות את כל האפשרויות העומדות בפניו, במסגרת ההליך המנהלי (ראו בג"ץ 2624/97 ידיד ואח' נ' ממשלת ישראל ואח' , פ"ד נא(3) 71 , 82 (1997); בג"צ 5516/07 Iosebashvili Liana נ' מדינת ישראל, משרד הפנים (לא פורסם, 19.8.07)). כאמור לעיל, סעיף 13א(ב) לכללי המוניות קובע, כי "סדרי הדיון ונהלי עבודת הועדה המייעצת ייקבעו בידי המנהל לאחר שנועץ בה". במקרה דנן, בקשת העותר לאפשר לו לזמן עדים לוועדה ולחוקרם, הופנתה ליושב ראש הוועדה המייעצת בלבד, בעוד שהסמכות לקביעת נהלים שאינם מפורטים בסעיף 13א(ב) גופא, מופקדת בידי מנהל שדה התעופה בן-גוריון. לצורך העניין, אין נפקא מינא בידי מי התקבלה ההחלטה בפועל, בין אם היה זה המנהל, יושב ראש הוועדה או גורמים אחרים של המשיבה. הגורם המוסמך שאליו ניתן להפנות טענות בדבר פגמים בהליכי הדיון של הוועדה המייעצת, הוא מנהל שדה התעופה בעצמו. משלא פנה העותר בכל בקשה או פנייה למנהל השדה בעניינו, אין מקום להידרש לעתירתו בשלב זה.
אשר-על-כן, דין העתירה להידחות על הסף.
העותר ישא בשכר טרחת עורכי הדין של המשיבה בסך 5,000 ש"ח.
