בקשה לפסיקת הוצאות
החלטה

לפני בקשה לפסיקת הוצאות. העתירה שבנדון הוגשה ביום 12.2.06 ונתבקש בה, בין היתר, סעד בגין אי מתן מענה לבקשה להארכת מועד להגשת תביעה לפיצויים על פי סעיף 197(ב) לחוק התכנון והבניה, תשכ"ה-1965. בהודעה משלימה מטעם משיב 1 נתקבל הסעד המבוקש בנדון לגבי עותרים 2-1. בהמשך לכך החליטה כב' השופטת א' חיות, בהחלטתה מיום 12.11.06, למחוק את עותרים 2-1 דאז מן העתירה, כמו גם את משיבים 3-2 דאז מן ההליך. כן הוחלט, כי בקשה לפסיקת הוצאות בנדון תועבר לטיפול הרשם. מכאן הבקשה שלפני, שבשל תקלה הובאה לטיפולי זה מקרוב.

בבקשה נטען כי העתירה הוגשה בשל אי מענה ורק בעקבותיה החל משיב 1 (משרד הפנים) "במרוץ קדחתני" לאיתור התשובות לעותרים. הטעם שניתן לאי הטיפול בנדון – מצוקת כוח אדם וגידול במספר הפניות – אינו מספיק, ויש אפוא מקום לפסיקת הוצאות בנדון. משיב 1, בתגובתו מיום 16.11.06, השאיר הבקשה לשיקול דעת בית המשפט תוך שהוא מדגיש את העומס הכבד בטיפול בבקשות מן הסוג הנדון, עומס שעמד, בין היתר, ביסוד העיכוב בטיפול בעניינם של העותרים. משיבים 3-2 לא הגיבו לבקשה.

לאחר עיון בחומר שלפני, נחה דעתי כי קם בסיס מספיק לחיוב בהוצאות העותרים 2-1, שהם המבקשים הרלבנטיים לעניין זה. כך הדבר, שכן אין חולק עוד כי הגשת העתירה בנדון היתה מוצדקת, וכי הגשתה הביאה לקבלת הסעד המבוקש, ולו בחלקו. עוד יצוין, כי החבות בנדון הינה של משיב 1, שהוא הגורם הרלבנטי בנדון, והוא אף זה שהסדיר את מתן המענה בסופו של יום.

אשר לשיעור החיוב, הרי שהטיפול בנדון נסתיים בלא צורך בדיון לפני בית המשפט, והסעד שניתן – ניתן תוך זמן קצר יחסית למן הגשת העתירה. יש ליקח בחשבון גם את העובדה כי העתירה והטיפול בה כללו גם את עניינו של עותר מס' 3, שעניינו תלוי ועומד בבית משפט זה על פי העתירה המתוקנת (מיום 17.7.07). במצב דברים זה, ישא משיב 1 בשכר טרחת עו"ד של עותרים מס' 2-1 בסך של 5,000 ₪ בסך הכל, וכן בהוצאות בסך של 1,000 ₪ נוספים. סכום זה ישא ריבית והצמדה כדין מיום ההחלטה ועד התשלום בפועל.
