העותרים פנו למשטרת ישראל בבקשה להתיר להם לקיים עצרת מחאה בשכונת שייח ג'ראח, בה הם מצפים להשתתפות של כ-3,000 איש. העתירה שלפנינו נידונה בדחיפות בשים לב לעיתוי העצרת המבוקשת, ובא-כוח המשיבה הסכים כי נדון בה כאילו ניתן צו על-תנאי. הרקע לעצרת המבוקשת הוא בפינויים של חלק מהעותרים מבתים בהם התגוררו ברחוב ע'תמאן בן עפאן (להלן: הרחוב ) שבשכונת שייח ג'ראח. בשל כך מבקשים הם כי ההפגנה תתקיים ברחוב זה. המשטרה סירבה להתיר קיום העצרת במיקום המוצע הן משום ההפרעה לתנועה במקום והצורך לסגור את הרחוב באופן המונע מעבר בו, והן משום החיכוך הצפוי באותו רחוב, בין האוכלוסיות השונות ומשיקולי בטיחות בשל הצפיפות שעלולה להיווצר במקום.
קיימנו דיון מפורט בטענות הצדדים, וזימנו את מפקד מחוז ירושלים שהתייצב בבית המשפט והסביר את טעמיו להתנגדות לקיום העצרת במיקום המבוקש. מלכתחילה, הציעה המשטרה לעותרים לקיים את העצרת במגרש כדורסל המצוי ממערב למקום, כשבין האתר המבוקש לאותו מגרש מפריד כביש ראשי של "דרך שכם" והמגרש עצמו סגור, מוקף גדר גבוהה ואינו נצפה מהרחוב. בעת הדיון הסכימה המשטרה לכך שחלק מהמפגינים יימצאו גם מחוץ למגרש, בגן הציבורי בו כבר התקיימה עצרת דומה בשבועות הקודמים. כאמור, מוקד המחלוקת ונושא המחאה שמבקשים העותרים להביע מצוי ברחוב עצמו. הצענו במהלך הדיון כי יתאפשר לעותרים קיום חלקי של תהלוכה בסיום העצרת לכיוון הרחוב, בחלקו העליון, המערבי, לזמן מוגבל ולמספר מוגבל של משתתפים, כך שתהיה זיקה בין נושא ההפגנה למיקומה. מפקד המחוז הציע תהלוכה ברחוב חלופי, מדרום לרחוב המבוקש, בשל החשש שהתהלוכה ברחוב עצמו תחסום את הגישה ברכב לבתי השכונה המצויים מצידו הצפוני של הכביש.
בבואנו להכריע בשאלת האיזון הנדרש בין זכותם של העותרים להפגין ולהביע מחאה לבין האינטרס לשמור על הסדר הציבורי, הלכנו בעקבות פסיקה עקבית ורבה של בית משפט זה. בגידרה של פסיקה זו נקבע כי "חופש הביטוי והזכות להתכנס ולהפגין הם מזכויות היסוד המרכזיות של האדם בישראל" ( בג"ץ 8988/06 יהודה משי זהב נ' מפקד מחוז ירושלים (טרם פורסם, 27.12.06; פסקה 9 לפסק הדין) (להלן: פרשת משי זהב ) ). עם זאת, אין הן זכויות מוחלטות ויש לאזנן - באמצעות המבחנים שקבענו - אל מול זכויות אדם יסודיות אחרות ואינטרסים מוגנים נוספים (ראו, למשל: בג"ץ 153/83 לוי נ' מפקד המחוז הדרומי של משטרת ישראל, פ"ד לח(2) 393; פרשת משי זהב ).
ברוח זו אף החלטנו להתיר תהלוכה בעתירתה של עמותת "עם כלביא", שביקשה לקיים אירוע של "מצעד דגלים" במזרח ירושלים ביום ירושלים (בג"ץ 4846/08 עמותת עם כלביא נ' מפקד מחוז ירושלים (טרם פורסם, 1.6.08)). בכל אותן עתירות עמד החשש של המשטרה מפני פגיעה בשלום הציבור ומפני קשיים מעשיים להבטיח את הסדר הציבורי עקב פוטנציאל החיכוך בין חלקי אוכלוסיה שונים.
הנטל המוטל על המשטרה בעיר ירושלים, שאוכלוסייתה מגוונת ומורכבת, הוא ללא ספק כבד. יחד עם זאת, על המשטרה "מוטלת חובה לנקוט בכל האמצעים הסבירים העומדים לרשותה, כדי להגן על המשתתפים באסיפה או בהפגנה" (פרשת משי זהב , פסקה 10 לפסק הדין).
בהתאם לכל האמור, ובאיזון שערכנו בין כל השיקולים, לא ראינו להתערב בהחלטת מפקד המחוז באשר למיקום העצרת, היינו, במגרש הכדורסל ובגן הסמוך לו בו קוימו עצרות בעבר. עם זאת על מנת לאפשר ביטוי לזיקה ולנראות הנדרשים בקשר עם נושא המחאה, העתירה מתקבלת בחלקה בכך שניתן בזה צו מוחלט המורה למשטרה לאפשר למספר מוגבל של משתתפים בעצרת, שלא יעלה על 300 מפגינים, לצעוד בתום העצרת, ממקום העצרת לרחוב - בחלקו המערבי שמול המגרש הריק - באופן שהצועדים יעצרו 15 מטרים לפני הצומת הסמוכה למגרש בצידו המזרחי ומסומנת על-גבי התצלום שהוגש על-ידי המשיבה וסומן כמש/1. הצועדים יוכלו לצעוד בתוך הקטע המסומן כמלבן הצהוב המערבי שבאותו רחוב ולחזור בחזרה למקום העצרת, וזאת בפרק זמן של 30 דקות.
מבקשי ההיתר להפגין בשם העותרים יקבלו על עצמם לקיים את התנאי האמור ואת יתר התנאים שהשיתה עליהם המשטרה.
