החלטה
ניתן בזה צו על תנאי כמבוקש. המשיבים יגישו תשובתם לעתירה בתוך 45 יום. כל החומר שהוגש מטעם העותרים והמשיבים הינו חלק מהעתירה והתשובה שכבר מצויה לפנינו. העותר יגיב על התשובה בתוך 30 יום נוספים ויתייחס גם לפתרונות אלטרנטיביים אחרים, לרבות מעבר אלג'יב. העתירה תיקבע לשמיעה בהקדם לאחר קבלת התשובה.

צו על תנאי
על יסוד עתירה זו שהובאה לפני בית-משפט זה, מצווה בית-המשפט
כי ייצא מלפניו צו על תנאי המכוון אל המשיבים והמורה להם להתייצב וליתן טעם:
(1) מדוע לא תבוטל החלטת ועדת הערעור לפי חוק להסדר תפיסת
מקרקעים בשעת חירום, התש"י-1949 מיום 11.9.08 בתיק ו"ע 614/06 בכל הנוגע
להוראתה בפסקה 65 להחלטה ולפיה "כביש הגישה הקיים היום בין קלנדיה לבין מעבר
עטרות ייסגר בשרוול, כך שהעוברים בו יוכלו לנסוע ישירות למעבר עטרות מבלי אפשרות
לצאת ממנו, ומבלי שיוכלו להיכנס לישראל ללא הבדיקה במעבר עטרות".
(2) מדוע לא ייקבע כי צו התפיסה מס' צת-65-06 שהוצא מכוח חוק
להסדר תפיסת מקרקעים בשעת חירום, התש"י-1949 ביום 26.3.06, לצורך הקמת גדר
הביטחון בתחום ירושלים, באזור הכפר קלנדיה, הוצא כדין.
המשיבים יגישו תשובתם, אם רצונם בכך, תוך 45 ימים מיום המצאת
כתב זה, לבית-המשפט ולבעלי-הדין ישירות.
