עניינה של העתירה בבקשת העותרים להסדיר את מעמדו של העותר
על ידי הענקת אזרחות ישראלית או באופן אחר שיאפשר לעותר להמשיך לחיות בארץ כבעלה וכבן זוגה של העותרת.
נספר לקורא כי העותרת מבוגרת מהעותר
ב-30 שנה (העותרת היא ילידת 1928), ובפסק דינו של בית משפט זה (בג"ץ 1173/07 מיום 2.12.2009) ניתנה לעותרים הזדמנות נוספת להוכיח את טיב הקשר ביניהם. עניינם של העותרים הוחזר אפוא לבחינה ולהערכה נוספת של המשיב, אשר בחן את עניינם של העותרים והחליט שוב כי אין מקום לאשר את בקשתם לאיחוד משפחות. על כך נסבה העתירה דכאן.

דין העתירה להידחות על הסף. הסוגיה של רכישת מעמד בישראל מכוח נישואין לאזרח ישראלי מוסדרת בסעיף 7 לחוק האזרחות, התשי"ב-1952, וב חוק האזרחות והכניסה לישראל (הוראת שעה), התשס"ג-2003. הסמכות לדון בעניינים אלה נתונה כיום ל בית המשפט לעניינים מנהליים, כאמור בסעיף 5(1)
ופרט 12 ל תוספת הראשונה לחוק בתי משפט לעניינים מנהליים, התש"ס-2000.
