בקשה לפסיקת הוצאות
החלטה

לפניי בקשה מטעם העותרים לפסוק להם הוצאות לאחר שהעתירה שהגישו (ביום 14.4.2010) נמחקה לפי החלטתי מיום 12.9.2010. עוד מונחת לפניי בקשה מטעם המשיב 2 לחייב דווקא את העותרים בהוצאות.

העותרים, חברים במועצה המקומית ערערה שכהונתם הופסקה על-ידי שר הפנים, ביקשו בעתירתם כי המשיב 1 (שר הפנים) יורה על חיובו של המשיב 2 (ראש המועצה), באופן אישי, בגין הוצאות שהוצאו שלא כדין מקופת המועצה (זאת לפי הסמכות הנתונה לשר לפי סעיף 189 לצו המועצות המקומיות (א), התשי"א-1950). המשיב 2 הגיש (ביום 30.5.2010) תגובה מקדמית ובה ביקש לדחות את העתירה על-הסף ולחלופין – לגופה. המשיב 1 הגיש אף-הוא (ביום 15.8.2010) תגובה מקדמית מטעמו, ובה נטען כי פנייתם של העותרים למשיב, בנושאים המועלים בעתירה, נבדקה בהתאם לנוהל בעניין זה, וכי בתום הבדיקה ולאחר שנתקבלה גם תגובת המשיב 2, הוחלט על פעולות שונות לצורך המשך הבירור, ובהן מינוי רואה חשבון מבקר שיקיים הליך בחינה מתאים. הובהר, כי אין בהחלטה לגבי מינוי רואה החשבון משום הבעת עמדה בשאלה אם הוצאו הוצאות שלא כדין, ובאשר לחיובו האישי של המשיב 2, וכי עניינים אלה ייבדקו בהתאם לנוהלי המשיב 1.
לאור האמור בתגובות המשיבים נתבקשו העותרים להודיע אם הם עומדים על עתירתם, וביום 5.9.2010 באה הודעתם כי העתירה התייתרה וכי מבוקש למחקה בכפוף לחיובו של המשיב 1 בהוצאות. המשיב 1 הגיש (באיחור) את תגובתו, ובה הוא מתנגד לפסיקת הוצאות. המשיב 2 מצדו הגיש תגובה ובה עתר לחיוב העותרים בהוצאות.

אפתח בהתייחסות למועד הגשת תגובתו של המשיב 1. מסתבר כי ארעה תקלה אצל המשיב 1 ולכן הוגשה תגובתו באיחור. בנסיבות העניין, וחרף התנגדות העותרים, סבורני כי מן הראוי להאריך את המועד להגשת התגובה, ולברר את נושא ההוצאות תוך התייחסות לטענות שני הצדדים.

לגוף העניין: לאחר שבחנתי את טענות הצדדים בראי אמות-המידה שנקבעו בבג"ץ 842/93 אל נסאסרה נ' שר הבינוי והשיכון , פ"ד מח(4) 217 (1993), לא מצאתי להורות על חיוב בהוצאות בהליך זה, לכאן או לכאן.
מן החומר שלפניי לא שוכנעתי כי פנייתם של העותרים אל המשיב 1, בנושא חיובו האישי של המשיב 2, לא זכתה לטיפול עובר להגשת העתירה. כאן ראוי להבהיר: בבקשות מהסוג שלפניי מתעוררות לא פעם שתי שאלות נפרדות: האחת נוגעת לטיפולה של הרשות בפנייתו של האזרח לגופה, והאחרת נוגעת למידע שנמסר לאזרח בנוגע לטיפול בפנייתו. כאשר האזרח אינו מקבל תשובה ראויה תוך זמן סביר – ולוּ תשובה המיידעת אותו לגבי מצב הטיפול בפנייתו – אפשר שהגשת העתירה תיחשב מוצדקת (לצורך פסיקת הוצאות) אפילו אם יתברר כי בפועל הנושא טופל וכי הסעד ניתן ללא קשר ישיר להגשת העתירה.

בענייננו, העותרים פנו לראשונה למשיב 1 בעניין נשוא העתירה ביום 15.6.2009. זמן קצר אחר-כך, ביום 7.7.2009, הועבר העתק מהתלונה להתייחסותו של המשיב 2. זה האחרון התבקש להגיב עד ליום 1.8.2009, אך לא עשה כן במועד שנקבע (התייחסותו באה בשלב מאוחר יותר). יצוין כי העותרים היו מכותבים לפנייה למשיב 2 לקבלת התייחסותו. העותרים שבו ופנו למשיב 1, וביום 27.4.2010 שוגר להם מכתב שלפיו המשיב 1 מצא לנכון להמתין לתוצאות הליך משפטי המתקיים בנושא העסקת קרוב משפחה על-ידי המשיב 2, וכי "אנו ממשיכים בבדיקת תלונת מרשיך (לרבות בירור עם הגורמים המוסמכים במשרד הפנים) ובסיום הבדיקה נודיעך דבר". יצוין כי לפי האמור במכתב זה, הפנייה השנייה של העותרים, מיום 19.7.2009, כלל לא הגיעה למשרדי המשיב 1, ואילו הפנייה השלישית, הנושאת תאריך 28.2.2010, הגיעה רק ביום 8.4.2010.

על רקע זה, ולפי החומר שלפניי, וכן בשים לב לנושא המורכב והרגיש נשוא העתירה – חיובו של נושא משרה ברשות מקומית בחיוב אישי – לא אוכל לקבוע כי המשיב 1 "גרר רגליים" בטיפול בפנייתם של העותרים, וכי הוא החל לפעול רק לאחר הגשת העתירה ובעקבותיה. לפי הנתונים שלפניי לא שוכנעתי כי המשיב 1 הזניח את הפנייה, ויצוין כי גם היום הנושא עדיין מצוי בשלבי בדיקה, כאמור בתגובתו המקדמית של המשיב 1 וכמתחייב ממהות הנושא. ודוק: המכתב מיום 27.4.2010, המתאר את מצב הטיפול בפנייתם של העותרים, שוגר רק לאחר שהוגשה העתירה (ביום 14.4.2010). אולם לפי האמור במכתב זה, ואין לי סיבה להניח שהאמור אינו נכון, פנייתם של העותרים מיום 19.7.2009 כלל לא הגיעה למשרדי המשיב 1, והפנייה מיום 28.2.2010 הגיעה רק ביום 8.4.2010. משמעות הדבר היא שהמשיב 1 הגיב לפנייתם הנוספת של המערערים תוך זמן סביר מעת שבאה לפניו. מצד שני, לא ראיתי לקבוע כי העותרים מבחינתם פנו בטרם-עת לבית המשפט, זאת בשים לב לכך שככל הנראה מנקודת ראותם הם לא זכו למענה לשתי הפניות הנוספות שהגישו, וכן בשים לב לכך שהמשיב 2 לא מסר את התייחסותו לתלונה במועד שהוקצב לכך.
לאור כל המקובץ, ובהתחשב בכך שטרם נקבע אם יש מקום לחיובו האישי של המשיב 2, סבורני כי התוצאה הראויה היא שכל צד יישא בהוצאותיו; וכך אני מורה.
