השופט ס' ג'ובראן :
עניינה של העתירה שבפנינו בבקשת העותר, כי נורה למשיבים ליתן טעם מדוע לא יבצעו שורה של פעולות הנוגעות למכרז מר 500/2007 שהתפרסם על ידי המשיב 1, לרכישת קרקע בשטח של 392 דונם בראש העין, ומכרז מר/256/2008 שיצא בעקבותיו. לטענת העותר, במכרזים ובהתנהלותם של המשיבים נפלו פגמים שונים, המעלים חשד לניגוד אינטרסים ולשחיתות.
מנגד טוענים המשיבים כי דין העתירה להידחות על הסף, הן לנוכח שיהוי ניכר ביותר, כך שהעתירה מבקשת לתקוף "מעשה עשוי", והן בשל קיומו של סעד חלופי בדמות הגשת עתירה לבית המשפט לעניינים מינהליים. כן טוענים המשיבים כי דין העתירה להידחות אף לגופו של עניין.

כפי שקובע סעיף 5(1) לחוק בתי משפט לענינים מינהליים, התש"ס-2000 במסגרת סמכותו ידון בית המשפט לעניינים מינהליים בעתירות כנגד החלטה של רשות או של גוף המנוי בתוספת הראשונה לחוק, בענין המנוי בתוספת זו. במסגרת התוספת נקבע כי בית המשפט ידון בעניני מכרזים של גוף או רשות החבים בחובת מכרז לפי חוק חובת המכרזים, התשנ"ב-1992, ועניני מכרזים של רשות מקומית, שענינם התקשרות בחוזה לביצוע עסקה במקרקעין.
משקיימת ערכאה שיפוטית המוסכמת לדון בעניינו של העותר, לא ייעתר בית משפט זה לבקשתו (ראו בג"צ 3649/08 שמנובה נ' משרד הפנים (לא פורסם, 20.5.2008)). אמנם, סמכותם של בתי המשפט המנהליים לדון בעתירות מנהליות איננה גורעת מסמכותו של בית משפט זה, אך עם זאת, כפי שציין בית המשפט
בבג"צ 2371/04 וולף נ' רשות שדות התעופה בישראל (לא פורסם, 14.3.2004):
"רק במקרים חריגים ונדירים ביותר ייזקק בית משפט זה לעתירות בנושאים המצויים בסמכותו של בית המשפט לענינים מינהליים. הטעם לכך הוא, בין היתר, כי פסק דינו של בית המשפט לענינים מינהליים בעתירה מינהלית נתון ממילא לערעור בפני בית משפט זה בשבתו כבית משפט לערעורים."
המקרה שבפנינו איננו נמנה על אותם מקרים חריגים המצדיקים את התערבותנו בשלב זה. לעותר פתוחה הדרך לפנות לבית המשפט לעניינים מינהליים ולהעלות לפניו את טענותיו השונות המפורטות בעתירתו.
אשר על כן, דין העתירה להידחות על הסף.
