החלטה

שתי העתירות שבפנינו הינן מבחינות שונות המשך להסדר פשרה שקיבל תוקף של פסק-דין ביום 14.11.2011 בע"א 8263/09 וע"א 8432/09. בהסדר הפשרה נקבע, בין השאר, כי בעלי הדין דשם יפנו לשר הפנים (הוא המשיב 1 בעתירות) על מנת שישקול מחדש עמדתו בשאלה האם לעניין העסקאות בהן מ דובר
חל פטור ממכרז לפי תקנה 3(2)(ט) לתקנות העיריות (מכרזים), התשמ"ח-1987. העסקאות הן של חכירת משנה של מקרקעין, שמינהל מקרקעי ישראל (להלן – המינהל ) החכיר לעיריית כפר- סבא. העתירות הוגשו לאחר ששר הפנים דחה את האפשרות בדבר תחולת פטור כאמור. עם זאת, בתגובות שהוגשו על ידי שר הפנים והמינהל הוצע מסלול שונה לטיפול בעסקאות בהן מעוניינים העותרים (וכן המשיבים 6-4 בבג"ץ 3134/12), שלא על דרך הפטור הנזכר. העותרים בבג"ץ 3134/12, וכן המשיבים 6-4 באותו הליך, אינם מעוניינים ללכת במסלול שהוצע. הם מעוניינים ללכת במסלול הפטור, לפי תקנה 3(2)(ט) האמורה. לעומת זאת, העותרת בבג"ץ 3955/12 דווקא מעוניינת במסלול שהציע משרד הפנים.

לאחר ששמענו טיעונים קצרים הגענו לכלל דעה כי על משרד הפנים ליתן תגובה שתתייחס לסוגיה של הפטור לפי תקנה 3(2)(ט) וזאת במסגרת בג"ץ 3134/12. התגובה תוגש לא יאוחר מיום 23.1.2014. העותרים וכן המשיבים 6-4 בבג"ץ 3134/12 יגיבו עד ליום 6.2.2014. לעת הזו העתירה בבג"ץ 3955/12 תישאר תלויה בבית משפט זה.
משיוגש החומר בכתב בבג"ץ 3134/12 על ידי בעלי הדין בהליך נחליט באשר להמשך הטיפול בשתי העתירות.
