גרוניס:

בעתירה שלפנינו מבקש העותר, מרדכי ואנונו (להלן – העותר ), כי נורה למשיבים לאפשר לו לצאת את ישראל לתקופה בת שלושה ימים, בין הימים 19-17 לחודש זה, על מנת שיוכל להשתתף בשני כנסים שאליהם הוזמן, האמורים להיערך בעיר לונדון שבבריטניה.

המגבלות שהוטלו על העותר מאז שחרורו ממאסר תוארו ביתר פירוט בפסק-הדין שניתן לפני זמן לא רב בבג"ץ 5198/13 ואנונו נ ' היועץ המשפטי לממשלה (29.12.2013) (להלן – בג"ץ 5198/13 ). על-כן, נעמוד להלן על תמצית הדברים בלבד. בקצרה ייאמר, כי מאז שחרורו של העותר ממאסר ארוך בשנת 2004, הוטלו עליו מגבלות שונות, אשר תוקפן מוארך מעת לעת. בפסק-הדין בבג"ץ 5198/13 נדחתה עתירה שהגיש העותר נגד הארכת תוקף הצווים. לעניין העתירה דנא רלוונטי בעיקר הצו שהוצא מכוח תקנה 6 לתקנות שעת חירום (יציאה לחוץ לארץ), התש"ח-1948, האוסר על העותר לצאת מן הארץ. כפי שעולה מתשובת המשיבים לעתירה, תוקפו של צו זה הוארך לאחרונה עד ליום 31.5.2015. כן רלוונטי לעניינו צו הצמצום וההשגחה שהוצא בעניינו של העותר לפי תקנות 108, 109 ו-110 לתקנות ההגנה (שעת חירום), 1945, המטיל עליו מגבלות שונות, וביניהן שלא לקיים קשר כלשהו עם אזרחים או תושבים זרים ללא קבלת אישור בכתב מראש. בדיון שנערך לפנינו מסר העותר כי גם תוקפו של צו זה הוארך פעם נוספת. נעיר, כי העתירה בבג"ץ 5198/13 הייתה העתירה השביעית של העותר נגד הארכת הצווים.

לטענת העותר, ביום 11.5.2013 הוא פנה למשיבים בבקשות להתיר לו לצאת מן הארץ לשם השתתפות בשני הכנסים, והמשיבים הותירו את פניותיו בלא מענה. לטענתו, מ דובר ביציאה קצרה ביותר מן הארץ ולמטרה ספציפית. העותר מוסיף כי באותם כנסים הוא אמור להרצות בנושאים שאין בהם כדי לגרום נזק לביטחון המדינה. לטענת העותר, נוכח הזמן שחלף מאז שחרורו ממאסר, הצטמצמה המסוכנות הנובעת ממנו לביטחון המדינה. כן טוען העותר כי איסור היציאה מן הארץ שהוטל עליו פוגע בזכויות יסוד שלו, לרבות חופש התנועה וחופש הביטוי, וכי הסירוב לאפשר לו להשתתף באותם כנסים אינו מידתי.

המשיבים, בתשובתם מיום 10.6.2014, סבורים כי דין העתירה להידחות. לטענת המשיבים, העתירה דנא הוגשה בלא שהעותר המתין פרק זמן סביר לקבלת מענה לפניותיו. העתירה הוגשה ביום 20.5.2014, וביום 22.5.2014 השיב שר הפנים לעותר בתשובה מנומקת כי הוא דוחה את בקשותיו, בעיקר בשל החשש שעודנו קיים לפגיעה בביטחון המדינה מצידו של העותר. כן טוענים המשיבים כי בשל הזמן הלא-רב שחלף מאז שניתן פסק הדין בבג"ץ 5198/13 ועד היום, הטעמים שעמדו בבסיס הותרת המגבלות שהוטלו על העותר על כנן, עומדים בעינם. המשיבים טוענים כי הנימוקים הביטחוניים העומדים בבסיס האיסור המוטל על העותר לצאת מישראל יפים גם באשר ליציאה מישראל לתקופה קצרה, וכי גם נסיעה מסוג זה מקימה חשש ממשי לפגיעה בביטחון המדינה. לטענת המשיבים, בנסיבות העניין אין אמצעי שניתן לנקוט בו שפגיעתו בזכויות העותר היא פחותה (כדוגמת הפקדת ערבות). לבסוף מוסיפים המשיבים, כי העותר ממשיך להפר את המגבלות המוטלות עליו, ובכך מלמד כי לא ניתן ליתן בו אמון שלא יגרום לפגיעה בביטחון המדינה אם תיעתר בקשתו.

ביום 12.6.2014 קיימנו דיון בעתירה. במהלך הדיון הציגו בפנינו המשיבים חומר חסוי במעמד צד אחד מפי גורמי ביטחון שונים. החומר החסוי (שמטבע הדברים לא ניתן לפרטו), מתייחס לחשש שעודנו קיים מן העותר לפגיעה בביטחון המדינה ולהפרות של העותר את המגבלות שהוטלו עליו.

דין העתירה להידחות. כפי שעמדו על כך המשיבים, בפסק-הדין שניתן בבג"ץ 5198/13 לפני מספר חודשים, נדרש בית משפט זה לעתירה שהגיש העותר נגד הארכת תוקף הצווים שהוצאו נגדו. באותו עניין נקבע, כי אין מקום להתערב בהחלטה להאריך את תוקפם של הצווים בשנה נוספת. זאת, נוכח החשש שעדיין נשקף מן העותר לפגיעה בביטחון המדינה. עוד עמד בית המשפט על כך, שהעותר לא נסוג מכוונתו להפיץ מידע חסוי, וכי הוא שב ומפר את המגבלות שהוטלו עליו. הטענות שמעלה בפנינו העותר בעתירה דנא אינן שונות במהותן מאלו שהועלו על-ידו בעתירתו הקודמת. נוכח העובדה שחלף זמן לא רב מאז פסק-הדין בבג"ץ 5198/13, דעתנו היא שאין מקום שנורה עתה למשיבים לפעול באופן שונה ולאפשר לעותר לצאת מן הארץ. איננו סבורים כי יש בעובדה שמ דובר ביציאה מן הארץ לפרק זמן קצר כדי לשנות ממסקנה זו. אדרבה, דומה שבקשה לצאת את הארץ אינה המקום להתחיל בו ככל שהעותר חותר להקלת המגבלות שהוטלו עליו ומבקש להוכיח במעשיו כי ניתן לתת בו אמון. לכך יש להוסיף את החומר החסוי שהוצג בפנינו גם במסגרת הדיון בעתירה דנא, שמחזק את העמדה כי הצורך במגבלות שהוטלו על העותר בעינו עומד. לבסוף, אין לנו אלא לשוב ולציין את שאמרנו בפסק-הדין בבג"ץ 5198/13, בדבר ההפרות החוזרות של העותר את המגבלה שהוטלה עליו בכל הנוגע למפגשים עם זרים בלא קבלת אישור מראש. יצוין, כי בא-כוח העותר השיב לטענת המשיבים בעניין זה כי מ דובר
במפגשים אקראיים של העותר עם אחרים. מכל מקום, כפי שנקבע בפסק-הדין בבג"ץ 5198/13, טוב יעשה העותר אם יפעל לקבלת אישור בטרם קיום המפגשים כנדרש ממנו, מה גם שנראה כי חלק מהמפגשים אינם אקראיים. גם מטעם זה אין עילה להתערב בהחלטה המינהלית עליה משיג העותר.

העתירה נדחית.
