לפניי בקשה לפטור מתשלום אגרה. הבקשה הוגשה במסגרת עתירה בעניין פסק דין של בית הדין הארצי לעבודה, שבו נדחה ערעורו של העותר על פסק-דין של בית הדין האזורי לעבודה בעניין זכאות לתוספת תלויים לקצבת נכות על-פי הוראות חוק הביטוח הלאומי (נוסח משולב), התשנ"ה-1995. אין בידי להיעתר לבקשה באופן מלא. גם בהנחה שמצבו הכלכלי של העותר אינו מן המשופרים, אין בכך די לצורך מתן הפטור המבוקש. על פי תקנה 14(ג) לתקנות בתי המשפט (אגרות), התשס"ז-2007, תנאי נוסף ומצטבר למתן הפטור הוא כי ההליך מגלה עילה. בענייננו, מדובר כאמור בעתירה המכוונת נגד פסק-דין של בית הדין הארצי לעבודה (בשבתו כערכאת ערעור). כלל הוא כי בית משפט זה אינו משמש ערכאת ערעור על החלטותיו של בית הדין הארצי לעבודה, והוא יתערב רק במקרים חריגים ויוצאי-דופן שבהם יצאה מלפני בית הדין הארצי טעות משפטית מהותית שהצדק מחייב את תיקונה (ראו בג"ץ 525/84 חטיב נ' בית הדין הארצי לעבודה בירושלים , פ"ד מ(1) 673 (1986)). לאור אמת מידה זו, ולאחר עיון בפסק-הדין של בית הדין הארצי לעבודה ובנימוקי העתירה, לא שוכנעתי כי מוצדק לפטור את העותר באופן מלא מתשלום אגרה. עם זאת, לאחר עיון במסמכים שלפניי, ראיתי לנכון לבוא לקראת העותר ולהפחית את האגרה ל-1,000 ש"ח. סכום זה ישולם תוך 14 ימים מעת המצאת החלטה זו, שאם לא כן יימחק ההליך ללא הודעה נוספת.
