השופט ס' ג'ובראן :
עניינה של עתירה זו בבקשת העותר כי נורה למשיבים להסדיר את מעמדה של אשתו (דונצוב אולגה – דרכון מס' 2496088 – A ) בישראל. זאת מכוח נישואיה לעותר, אשר הינו תושב ואזרח ישראל.
כפי שעולה מהמסמכים אשר צורפו לעתירה, נכנסה אשת העותר לישראל בשנת 2000, דרך גבול מצרים, בהעדר אשרה כנדרש על פי דין.
בשנת 2003 הכירו העותר ואשתו בישראל. ביום 2.11.2006 נישאו השניים בנישואי פראגוואי והם חיים יחדיו ומנהלים משק בית משותף.
אחר נישואיהם, פנה העותר למשיבים ביום 4.12.2006 בבקשה להסדרת מעמדה של אשתו בישראל.
לטענת העותר, אחר פנייתו הראשונית, פנה למשיבים מספר פעמים נוספות, אך לא זכה לכל תשובה. זאת למעט שיחה עם פקידה במשרדי המשיבים, בה הודע לו כי בקשתו בטיפול.
בהמשך, הודיעו המשיבים לעותר, באמצעות מכתב מיום 2.8.2007 אשר נמסר לעותר בביקורו במשרדי המשיבים, כי בקשתו נדחית. זאת מחמת קיומו של חשד כי המ דובר בנישואים פיקטיביים, שתכליתם השגת מעמד בישראל.
מכאן העתירה שבפנינו, בגדרה טוען העותר כי החלטת המשיבים אינה מבוססת כלל ועיקר ויש בה כדי לפגוע בזכותו היסודית להינשא.
דין העתירה להידחות על הסף מחמת קיומו של סעד חלופי. עניינה של העתירה בהחלטת רשות לפי סעיף 7 לחוק האזרחות, סוגיה הנתונה כיום בסמכות בית המשפט לעניינים מנהליים, זאת מכוח הוראות סעיף 5(1) לחוק בתי משפט לעניינים מינהליים, התש"ס-2000 (להלן: החוק ) בצירוף פרט 12(2) לתוספת הראשונה לחוק (כנוסחו העדכני אחר תיקון תשס"ח, אשר נכנס לתוקפו ביום 2.3.2008. משעומד לעותרים סעד חלופי בדמות פניה בעתירה מתאימה לבית המשפט לעניינים מנהליים, הלכה היא כי לא יזקק בית המשפט הגבוה לצדק לעתירתם (וראו בג"ץ 6163/92 אייזנברג נ' שר הבינוי והשיכון , פ"ד מז(2) 229 (1993) ).
אשר על כן, העתירה נדחית.
