החלטה
המשנה לנשיאה א' רובינשטיין:
א.
בשלב זה טרם גיבשה המדינה לאמיתו, בגלל מחלוקת פנימית בין משרדי הממשלה בהקשר "בריאות מול בטיחות", את התקן הרשמי לעניין הלהבה הפתוחה. כרגע בתוקף הודעת
דחיה ל-17.5.15, והכוונה היא למנות מומחה טוקסולוגי כדי שיסייע לשר הכלכלה לקבל החלטה. נטען בפנינו מצד עותרים ומשיבים כאחד, כי דבר זה יוצר חוסר ודאות בשוק, ולכך תוצאות לא בריאות. אין להקל ראש בכך, ועל כן מסכימה המדינה כי אם וכאשר יתקבל תקן סופית, אם הקיים ואם בשינוי, תינתן ארכה של שישה חודשים להתארגנות לכולי עלמא (או להגשת עתירות מתוקנות לפי הצורך). רשמנו לפנינו את האמור.

העותרים בבג"צ 4926/14 עותרים גם לעניין מבחן הסיגריה, תקן שנכנס כבר לתוקף. הנושא טרם נדון בפנינו כדבעי, וקיימות טענות שיהוי מטעם המדינה. הוא יידון כשתידון העתירה לגופה, אך כמובן הזמן שחלף מהגשת העתירה לא יבוא במניין טענת שיהוי.

התנועה לאיכות השלטון ביקשה להצטרף מהיבט התחרות שלשיטתה על השר לשקול אותו בצד שיקולי הבריאות והבטיחות. בא כוח המדינה הצהיר כי השר ישקול שיקולי יוקר המחיה ומשמעות התקן לגביהם וחזקה
על השר כי יעשה כן. בנסיבות אלה, עם שרשמנו לפנינו את עמדת התנועה לאיכות השלטון, איננו רואים צורך בצירופה.
ד.
הודעת עדכון מטעם המדינה תוגש עד סוף אפריל 2015. הצדדים האחרים כולם יוכלו להגיב תוך שבועיים לאחר מכן. בעקבות זאת יוחלט באשר להמשך הטיפול בעתירות.
