החלטה

עניינה של העתירה שלפנינו בתשעה מבנים אשר נבנו בתחומי היישוב "עפרה" על אדמות פרטיות של פלסטינים תושבי הכפר עין יאברוד. בעתירתם, ביקשו העותרים כי נורה למשיבים ליתן טעם מדוע לא יאכפו ללא דיחוי את צווי הפסקת העבודות וצווי ההריסה שהוצאו ביחס למבנים האמורים וכן ביחס להכשרת שטחים המתבצעת על אדמות הכפר עין יאברוד. ככל שקיימים מבין מבנים אלה מבנים אשר ביחס אליהם לא הוצאו צווי הריסה, ביקשו העותרים כי נורה למשיבים ליתן טעם מדוע לא יוצאו ללא דיחוי צווי הפסקת עבודות וצווי הריסה ביחס למבנים הללו.

עם הגשת עתירתם, ביום 4.6.08, הגישו העותרים גם בקשה לצו ביניים, לפיו יורה בית המשפט למשיבים לנקוט מיידית וללא דיחוי בכל הפעולות הנדרשות על-מנת למנוע את אִכלוסם של המבנים נשוא העתירה, וכן למנוע את חיבורם לחשמל, מים וביוב, וזאת עד למתן פסק-דין סופי בעתירה. עוד באותו היום - 4.6.08 - ניתנה החלטת השופט לוי, לפיה התבקשו המשיבים להגיש את תגובתם המקדמית בתוך עשרה ימים. ביום 19.6.08 הגישו המשיבים 1-4 את תגובתם, בה ציינו כי אמנם יש מקום להוצאת צו ביניים אשר יאסור על מגורים או כל שימוש אחר במבנים, וכן ימנע את המשך הבנייה או כל פעולה אחרת במבנים. מיד לאחר קבלת עמדת המדינה, ובהתאם לאמור בה, הוציא בית המשפט (השופט
א' א' לוי ) צו ביניים לפיו נאסר אכלוס המבנים נושא העתירה וכל שימוש בהם. כמו כן, צוּוּ המשיבים למנוע את המשך הבניה בשטח בו עוסקת העתירה, וכן את חיבור המבנים הקיימים למערכות המים, החשמל והביוב, עד להחלטה אחרת של בית המשפט.

ביום 21.7.08 הגישו העותרים בקשה להבהרת צו הביניים שניתן בתיק. לטענתם, בניגוד להחלטת בית המשפט, אוכלסו המבנים נשוא העתירה, ופניותיהם למשיבים 1-4 בדרישה כי ימומש צו הביניים נענו בשלילה. העותרים ציינו כי בתשובה לפניותיהם טענו המשיבים כי המבנים אוכלסו בטרם הוּצא צו הביניים, וכי לשיטתם האיסור על שימוש במבנים, כפי שנקבע בצו הביניים, מתייחס רק למשיבים עצמם, ועל כן אין מקום לפנות את המבנים מתושביהם. על רקע זה, ביקשו העותרים כי יובהרו היקפו ותחולתו של צו הביניים. ביום 23.3.09 קיימנו דיון בבקשה להבהרת צו הביניים. בדיון נמסר לנו על-ידי המשיבים 1-4 כי אמנם אוכלסו המבנים נשוא העתירה במהלך הימים שחלפו מאז הגשתה של העתירה ועד להוצאתו של צו הביניים. כן נמסר, כי בנסיבות אלה החליט שר הביטחון להימנע, לעת הזו, מביצוע צווי ההריסה האמורים.

מהמידע שנמסר לנו בעת הדיון הסתבר, כי בעת שהוּצא צו הביניים כבר לא ניתן היה לקיימו, היות שהמבנים נשוא העתירה אוכלסו עוד קודם לכן. בשים לב לכך שאכלוס המבנים נעשה, ככל הנראה, ברובו, בתקופת הביניים שבין הגשתה של העתירה לבין הוצאת צו הביניים, במהלך הימים הספורים אשר ניתנו למשיבים לשם הגשת תגובתם לבקשה להוצאת צו הביניים, מתקבל הרושם כי נעשו פעולות שמטרתן הייתה קביעת עובדות בשטח וסיכול הבקשה לצו הביניים. מכל מקום, המצב הנוכחי, בו אוכלסו הבתים זה מכבר, מייתר את הצורך בהבהרת צו הביניים שניתן, ואשר סוכל לקראת הדיון בעתירה. עתה, השאלה העיקרית אשר נותרה לפיתחנו הינה שאלת הסעד הסופי המבוקש בעתירה.

נוכח כל האמור לעיל, אנו מורים בזאת על הוצאת צו-על-תנאי בעתירה שלפנינו, ולפיו מתבקשים המשיבים ליתן טעם מדוע לא יאכפו את צווי הפסקת העבודות ומדוע לא יממשו את צווי ההריסה שהוצאו ביחס למבנים האמורים וכן ביחס להכשרת שטחים המתבצעת על אדמות הכפר עין יאברוד. ככל שקיימים מבנים הנבנים במקום, אשר ביחס אליהם לא הוצאו צווי הריסה, מתבקשים המשיבים ליתן טעם מדוע לא יוצאו ללא דיחוי צווי הפסקת עבודות וצווי הריסה ביחס למבנים הללו. המשיבים יוכלו להגיש את תשובתם לצו-על-תנאי בתוך 60 ימים.
