המשיבים עשו שימוש בסעיף 7(1) לפקודה, בנוסחו לאחר התיקון, לשם תפיסת הקרקע מושא העתירה. לטענת העותרים, הוראת סעיף 8 לפקודה היא ההוראה היחידה החלה במצב של תפיסה דחופה של קרקע, מקום בו בעלי הקרקע או המחזיקים בקרקע מסרבים לתפיסת החזקה. ואילו לטענת המשיבים, סעיף 7(1) לפקודה חל במצב של דחיפות בתפיסת החזקה בשטח, בעוד השימוש בסעיף 8 במצב של תפיסה דחופה לצורך תשתית ציבורית או פרוייקט בטיחותי, דווקא שולל מהבעלים או המחזיק את אפשרות הטיעון נגד הרכישה לאור סעיף 5א(ג) לפקודה. עוד הצביעו המשיבים על כך, כי על פי סעיף 8(ב)(1) לפקודה, אין צורך בפנייה מוקדמת ל בית המשפט לצורך מתן צו למסירת החזקה. מכאן טענת המשיבים, כי דרך הפעולה בה נקטו לפי סעיף 7(1) לפקודה, הייתה הדרך הראויה בנסיבות העניין.

במקרה דנן, איננו רואים להידרש לסוגיות שהועלו בפנינו, נוכח מכלול נסיבות העניין וההליכים השונים שכבר נתקיימו בנושא גדר ההפרדה בכפר וולג'ה. כפי שעולה מהסעדים שנתבקשו בעתירה, העתירה נועדה להוות סעד ביניים לסעד העיקרי שבדעת העותרים להגיש תוך הזמן הקרוב, קרי, תקיפת החלטת שר האוצר לגבי רכישת הקרקע, בעקבות הדיון בוועדת ההשגות. כפי שהצהירה באת כוח המדינה, החלטת שר האוצר בעניין זה אמורה להתקבל ממילא תוך כשבעה ימים.
בנסיבות אלה, מאחר שהסעד העיקרי נמצא כבר "מעבר לפינה" – מה שמייתר את הדיון בעתירה דנן – ומאחר שבהליכים קודמים כבר נדחו מספר בקשות של העותרים לצווי ביניים, איננו מוצאים אפוא טעם להידרש לעתירה, ונותיר את הסוגיות שהועלו על ידי הצדדים בצריך עיון.

אשר על כן, אנו דוחים את העתירה, ובנסיבות העניין אין צו להוצאות.
