העותר הותקף בשנת 1988 על ידי המון עוין בכפר סעיר, סמוך לחברון. הוא הוכר כנפגע פגיעת איבה, כמשמעותו של מונח זה ב חוק התגמולים לנפגעי פעולות איבה, התש"ל-1970 (להלן: החוק ). לאחר כחמש עשרה שנים הגיש העותר תביעה למוסד לביטוח לאומי, בבקשה להכיר בו כנכה לפי החוק. לטענתו, הוא סובל מנכות נפשית פוסט-טראומטית. תביעתו נדונה בועדה רפואית ובועדת ערר לפי החוק. הועדות מצאו כי העותר סובל מסכיזופרניה רזידואלית, וכי לא קיים קשר סיבתי בין מצבו כיום לבין פגיעת האיבה בה הוא נפגע. אי לכך קבעו הועדות כי שיעור נכותו של העותר עומד על 0%. ערעור שהגיש העותר לבית הדין האזורי לעבודה בירושלים (ב"ל 10851/04) ובקשת רשות ערעור שהגיש לבית הדין הארצי לעבודה (בר"ע 1606/04) נדחו שניהם.

בעתירתו, מבקש העותר צו, המורה לועדות הערר הרפואיות, משיבות 2 ו-3, לבסס את החלטותיהן בתחום בריאות הנפש, וכן לנמקן, על פי אחת משתי שיטות האבחון המקובלות בתחום זה: שיטת ה- DSM , המקובלת בארצות הברית, או שיטת ה- ICD , הרווחת במדינות אירופה. לטענתו, הועדות שעסקו בעניינו הוא לא הלכו בדרך זו, והאבחון שנקבע לגביו אינו מבוסס על שיטת אבחון מוסדרת ומקובלת. בכך חרגו הועדות, כך לשיטת העותר, מחובת ההנמקה המוטלת עליהן כגופים מעין-שיפוטיים, ופגעו ביכולתו לתקוף את החלטותיהן בערכאות הערעור.

בהחלטה מיום 5.7.2009 התבקש העותר להשלים פרטים אודות החלטות הגופים המוסמכים שאותן הוא מבקש לתקוף, שכן החלטות כאלה – לרבות ההחלטות שפורטו לעיל – לא צוינו בעתירה ולא צורפו לה. ביום 26.10.2009 הגיש העותר עותקים של שלוש החלטות שקיבלו ועדות רפואיות בעניינו; אך העותר הבהיר, כי עתירתו אינה מכוונת לשנות מהחלטות אלה, שהפכו חלוטות, אלא היא עתירה "ציבורית" וצופה פני עתיד. נאמר עוד, כי לאחרונה הורע מצבו של העותר, והוא שוקל להגיש בקשה נוספת לקביעת נכות על פי החוק.

בתגובה שהגיש המוסד לביטוח לאומי נטען, כי העתירה מופנית, במהותה, כנגד החלטותיהם של בתי הדין לעבודה בעניינו של העותר, וכי הטענות שבעתירה נדונו והוכרעו בערכאות אלה. נטען, כי הועדות הרפואיות קיבלו החלטות ענייניות, מנומקות וסבירות בעניינו של העותר. במישור הכללי נאמר, כי בהתאם להנחיות משרד הבריאות, רושמים כלל הרופאים בישראל – ובהם חברי הועדות הרפואיות – את אבחוניהם על פי המינוח הבינלאומי המקובל, שהוא ה- ICD ; הוטעם, כי אין צורך לציין בהחלטה פלונית את שיטת האבחון, אלא אם היא חורגת מן המקובל.

בתגובת משיב 1, שר העבודה והרווחה (להלן: השר ), נטען, כי על פי נושאי העתירה והסעדים המבוקשים בה, המשיב המתאים לעתירה הוא המוסד לביטוח לאומי, ולא השר. השר מצטרף לעמדת המוסד לביטוח לאומי, לפיה העתירה תוקפת, במהותה, את החלטות בתי הדין לעבודה. עוד נטען, כי הגם שהשר הוא הממונה על ביצוע החוק, ואף שהוא רשאי להתקין תקנות מכוחו, אין הוא הגורם המתאים להורות לחברי הועדות הרפואיות כיצד לבצע את מלאכתם במישור המקצועי-רפואי.
לאחר שקילת נסיבות הענין על רקע טיעוני הצדדים, באתי לכלל מסקנה כי דינה של העתירה להידחות על הסף, מן הנימוקים הבאים:

עניינו של העותר נבחן, כאמור לעיל, בועדה רפואית ובועדת ערר לפי החוק. הועדות מצאו כי מצבו הנפשי של העותר כיום אינו קשור בקשר סיבתי לפגיעת האיבה אליה נחשף. העותר מיצה את המסלול הערעורי הקבוע בדין בהליכים לפני בתי הדין האזורי והארצי לעבודה (סעיף 5(ד) לחוק וסעיף 123 ל חוק הביטוח הלאומי [נוסח משולב], התשנ"ה-1995 , להלן: חוק הביטוח הלאומי ). בהליכים אלה העלה העותר בפני בתי הדין, בין השאר, את הטענות אותן הוא טוען בעתירה זו, ובראשן הטענה שהחלטות הועדות לא נומקו בהתאם לשיטת אבחון מקובלת. בתי הדין לעבודה דחו טענות אלה. בנסיבות המתוארות אין זה ראוי להתייחס לעתירה במנותק מעניינו של העותר, מן ההליכים שהתנהלו בו, ומן ההחלטות שהתקבלו בהליכים אלה.

הדרך שהיתה פתוחה בפני העותר לתקיפת ההחלטות שהתקבלו בעניינו היתה זו של עתירה כנגד החלטת בית הדין הארצי לעבודה. לעתירה כזו צריך היה העותר לצרף כמשיב גם את המוסד לביטוח לאומי, הצד שכנגדו בהליכים בבתי הדין לעבודה. לא בנקל היתה פנייה למסלול זה מניבה התערבות של בית משפט זה, שכן " מושכלות יסוד הם כי בית משפט זה אינו יושב כערכאת ערעור על החלטת בית הדין הארצי לעבודה, והוא נוהג ריסון רב בהתערבות בהחלטותיו. רק טעות משפטית מהותית, המשולבת בטעמים כבדי משקל של צדק שיפוטי, עשויה להצדיק התערבות " (בג"ץ 454/08 בטיטו נ' מערכת בתי הדין לעבודה (לא פורסם, 27.10.2009); בג"ץ 674/07 וינברג נ' בית הדין הארצי לעבודה (לא פורסם, 29.1.2007); בג"ץ 525/84 חטיב נ' בית הדין הארצי לעבודה , פ"ד מ(1) 673 (1986); בג"ץ 6080/94 גפני נ' בית הדין הארצי לעבודה , פ"ד נא(4) 308, 322‑324 (1997)). תנאים מחמירים אלה אינם מתקיימים במקרה הנוכחי. החלטותיהם של בתי הדין לעבודה נטועות בנתוני מקרהו של העותר, ובליבן ניצב העיקרון שלפיו תפקידו של בית הדין לדון "בשאלה משפטית בלבד" (סעיף 123 לחוק הביטוח הלאומי) ולא בשאלות רפואיות. על פניהן, מ דובר
בהחלטות שאינן מצדיקות את התערבותנו.

עולה, אפוא, כי אם היה העותר הולך בתלם של עתירה נגד החלטת בית הדין הארצי לעבודה, שהוא הנתיב המתבקש בנסיבות הענין, הוא היה מתקשה בהרמת הנטל הנדרש לצורך זכייה בסעד. על אחת כמה וכמה, שאין מקום להיענות לעתירה כמתכונתה שלפנינו, המתעלמת מההיבט הפרטני העומד בשורשה ומתיימרת להיות עתירה ציבורית עקרונית. אין להתיר עקיפה של הליכי ההשגה הקבועים בחוק על דרך הגשת עתירה העוטה באופן מלאכותי כסות עקרונית (השוו: בג"ץ 755/07 דורון נ' בית הדין הארצי לעבודה , פסקה 9 (8.10.2007); בג"ץ 5537/91 אפרתי נ' אוסטפלד , פ"ד מו(3) 501, 507 (1992); בג"ץ 7430/05 גבעון נ' מדינת ישראל (לא פורסם, 20.6.2007)).

הרקע העובדתי סביבו נולדה העתירה מביא, בסופו של יום, לדחייתה. אולם, אפילו היינו מפרידים הפרדה מלאכותית בין העתירה לבין נסיבות התהוותה, כבקשת העותר, לא היתה התוצאה משתנה. ניתוקה של העתירה ממערכת הנסיבות הקונקרטיות היה מותיר אותה מרחפת בחלל התיאורטי-אקדמי, ללא העוגן המוחשי-מציאותי המשמש ציר מרכזי למלאכה השיפוטית. " הניסיון השיפוטי מרתיע את בית-המשפט מקביעת הלכה שהיא כביכול מרחפת באוויר. בית-המשפט צריך תשתית של עובדות, במקרה נתון, כדי לבנות עליה הלכה " (בג"ץ 6055/95 צמח נ' שר הביטחון , פ"ד נג(5) 241, 250 (1999) (להלן: פרשת צמח ); בג"ץ 1853/02 נאוי נ' שר האנרגיה והתשתיות הלאומיות (לא פורסם, 8.10.2003); בג"ץ 4827/05 אדם טבע ודין – אגודה ישראלית להגנת הסביבה נ' שר הפנים (לא פורסם, 20.7.2005)).
לכלל שלפיו בית המשפט לא ידון בעניינים תיאורטיים הוכר חריג בפסיקה, והוא – כאשר באה לפניו סוגיה, העשויה להישנות בעתיד, ואשר נוטה מטיבה להפוך תיאורטית בטרם הכרעה שיפוטית (פרשת צמח , בעמ' 250‑251; בג"ץ 73/85
סיעת "כך" נ' יושב-ראש הכנסת , פ"ד לט(3) 141, 145 (1985); בג"ץ 2581/91 סלחאת נ' ממשלת ישראל , פ"ד מז(4) 837, 841 (1993)). המקרה הנוכחי אינו בא בגדרי החריג האמור, הואיל ואין מ דובר
בענין פרטני הנוטה מטיבו להפוך תיאורטי בטרם הוכרע על ידי ערכאה שיפוטית. במאמר מוסגר אוסיף, כי לגופה של הטענה האמורה, יש לכאורה טעם רב בדברי התגובה של המוסד לביטוח לאומי, לפיהם הואיל וכלל רופאי ישראל אמונים על השימוש בשיטת האבחון הבינלאומית המקובלת, אין צורך בפירוט שיטת האבחון בכל מקרה ומקרה.

סיכומו של דבר: בחינתה של העתירה לאור הנסיבות על רקען היא צמחה מגלה כי אין מקום להיענות לה; הוא הדין אף בבחינתה במנותק ממערכת נסיבתית זו. העתירה נדחית, אפוא.
בנסיבות המיוחדות של הענין, אין צו להוצאות.
