לפני בקשה לפסיקת הוצאות בהליך שבכותרת.

עניינה של העתירה בקשת העותר לקבלת אזרחות ישראלית. העתירה הוגשה ביום 7.8.06. ביום 11.9.06 הגיש העותר בקשה למחיקת העתירה נוכח הודעת ב"כ
המשיב כי ביום 21.8.06 אושרה בקשתו לקבלת אשרת עולה, אולם זאת בכפוף לכך שהמשיב יחויב להשיב לעותר כל סכום שלא יושב לו מכספי האגרה. המשיב מתנגד לבקשה. לטענתו, הטיפול בבקשתו של העותר היה טיפול סביר בשים לב לכך שנמסר מהמשטרה כי לעותר תיק מב"ד פתוח שהיה צריך לברר מה עלה בגורלו. כמו כן, לפי הנטען, בעת שמוצתה הבדיקה בעניינו של העותר אושרה הבקשה, וזאת ללא קשר להגשת העתירה, ומכאן שלא הגשת העתירה היא שהביאה לקבלת הסעד המבוקש. המשיב מבהיר, כי העתירה הומצאה למשרד הפנים על ידי הפרקליטות רק ביום 14.8.06 בעוד שבקשת העותר אושרה
ביום 13.8.06 על ידי סגן הממונה במחלקת אשרות וזרים ותזכיר בנושא הועבר למנהל מינהל האוכלוסין ולסגנית מנהלת לשכת מנהל האוכלוסין בירושלים.

לאחר שעיינתי בעתירה, בבקשה לפסיקת הוצאות ובתגובת המשיב באתי לכלל מסקנה כי דין הבקשה להתקבל. כאמור לעיל, לטענת המשיב, פרק הזמן שנדרש לצורך טיפול בעניינו של העותר, כשנה וחצי, הינו סביר, נוכח הצורך לברר מה עלה בגורל תיק מב"ד פתוח בעניינו. ברם טענה זו אינה עולה בקנה אחד עם האמור במכתבו של מר ששי קציר, מנהל מינהל האוכלוסין, מיום 28.9.06, לפיו "מבחינת המקרה, אין מניעה לאשר לו (לעותר, ש.ל) מעמד עולה בגין רישום זה". נוכח האמור, כלל לא ברור מדוע עוכב הטיפול בעניינו של העותר פרק זמן כה מ מוש ך, כאשר מתגובת מנהל מינהל האוכלוסין עולה כי ממילא לא היה בעצם קיומו של תיק מב"ד כדי למנוע ממנו לקבל מעמד עולה. אוסיף, כי איני מתעלמת מכך שבנסיבות העניין ההחלטה לאשר את בקשת העותר לקבלת מעמד עולה נתנה עוד בטרם עודכן המשיב בנוגע להגשת העתירה ולפיכך אין לקבוע כי הסעד ניתן לו בעקבות הגשתה. אולם את הכללים שנקבעו בפסיקה לעניין פסיקת הוצאות יש להפעיל בגמישות באופן ההולם את תכליתם. אין מדובר בכללים נוקשים אשר יש ליישמם בבחינת "ייקוב הדין את ההר". ברי כי בעת הגשת העתירה, טרם התקבלה החלטת המשיב בעניינו של העותר, ולעותר לא היתה כל אפשרות לחזות כי מבוקשו יינתן לו תוך פרק זמן קצר, ולפיכך הוא נזקק להגיש עתירה ולשלם בגינה אגרה. בנסיבות אלה, על אף שהסעד לא ניתן בעקבות העתירה, דעתי היא, שאין מניעה להיעתר לבקשה לפסיקת הוצאות וזאת במיוחד בשים לב לכך שהבקשה מוגבלת להשבת ההפרש בין סכום האגרה ששולמה לסכום האגרה שלא הושב לעותר בשל ניכוי האגרה הקבועה בפריט 8(א) לתקנות בית משפט (אגרות), התשמ"ח-2007. התוצאה היא, שהבקשה מתקבלת. המשיב ישא בהוצאות העותר בסכום כולל של 829 ₪. סכום זה ישא הפרשי הצמדה וריבית מעת המצאת החלטה זו ועד ליום התשלום בפועל.
