בקשה לפטור מאגרה
החלטה
לפניי בקשה לפטור מתשלום אגרה.
דין הבקשה להידחות.
ראשית יובהר כי תיק זה (שהוכתר "ערעור עתירה מנהלית") הוסב לבג"ץ נוכח הוראת החוק השוללת אפשרות להגיש ערעור על פסק-דין של בית המשפט לעניינים מנהליים בהקשר הנדון (סעיף 42(ג) לחוק הרשויות המקומיות (בחירות), התשכ"ה-1965, הקובע כי פסק-הדין יהיה סופי). כלומר, במקום למחוק את ההליך, הוחלט לילך לקראת העותר ולאפשר פתיחת הליך בג"ץ (ראו גם ההחלטות בעע"ם ובבג"ץ 6760/13).
בבקשה הלאקונית שלפניי נטען כי מתן פטור מאגרה בהליך שבכותרת מתבקש לאור העובדה שפטור כזה ניתן בבית המשפט קמא. טענה זו אין בידי לקבל. אמת, סעיף 14(ד) לתקנות בתי המשפט (אגרות), התשס"ז-2007 קובע, כי החלטה של בית משפט לפטור בעל-דין מתשלום אגרה מהווה ראיה לכאורה לחוסר יכולתו של המבקש לשלם את האגרה. אולם, לא זו בלבד שתקנה זו אינה מקנה פטור אוטומטי בכל הליך נוסף (מדובר ב"ראיה לכאורה" לעניין המצב הכלכלי), אלא שבענייננו דומה כי תקנה 14(ד) כלל אינה רלוונטית. ככל שניתן להסיק, הפטור שניתן לעותר בבית המשפט המחוזי לא נבע מהחלטה המושתתת על חוסר יכולת כלכלית, אלא מהוראת סעיף 42 לחוק הרשויות המקומיות, הקובעת כי לא תשולם אגרה בקשר לעתירה – והכוונה כמובן לעתירה בבית המשפט לעניינים מנהליים. כעת מצויים אנו, כאמור, בהליך בג"ץ, ואיני סבור כי יש לגזור מן הפטור הקבוע בסעיף 42 הנ"ל לגבי אגרה בהליך הנוכחי. אדגיש, כי בבקשה שלפניי אין כל טענה לעניין המצב הכלכלי, ובמצב דברים זה אני קובע כי על העותר לשלם את האגרה הקבועה בדין (בהליך בג"ץ).
האגרה תשולם תוך 10 ימים מעת המצאת החלטה זו.
