המשנה לנשיאה א' ריבלין:
העותרים הם חברי הגרעין המייסד, או חליפיהם, של אגודת מושב היוגב – מושב עובדים להתיישבות חקלאית שיתופית בע"מ. יצוין כי האגודה מצויה מזה שנים רבות בהליכי כינוס ושיקום עקב היותה חדלת פירעון. בעתירתם ביקשו העותרים להורות למשיבים למסור להם (עבור ילדיהם), בהקצאה ראשונה, נחלות חקלאיות במושב. כמו-כן הם ביקשו להורות על ביטול כל הסכמי המעטפת המקפחים אותם שנחתמו עם הנושים של המושב. יצוין כי מקצת מהעותרים ביקשו בתאריך 22.9.2008 למחוק את עצמם מן העתירה לאור העובדה שהחליטו להצטרף להסכם המעטפת בין המושב לבין נושיו, ולחתום על הסכם פנימי המהווה חלק מהסכם המעטפת. מבוקשם של עותרים אלה ניתן להם ושמם נמחק מן העתירה.
לפי המתואר בעתירה, מושב היוגב נוסד בשנת 1950. תחילה התיישבו במושב 60 משפחות מייסדים כשלכל אחת מהן הוקצתה נחלה חקלאית אחת. ברבות השנים, בעקבות החלטות של האסיפה הכללית של המושב ופניות לגורמים המוסמכים, הוחלט שתקן הנחלות במושב יעמוד על 120, כאשר הנחלות הנוספות יוקצו לילדיהם של המייסדים. רוב הנחלות אוישו אולם מקצתן נותרו פנויות מטעמים כלכליים ומשום שילדי העותרים לא הגיעו באותה עת לגיל הבגירות. בשלב מאוחר יותר ביקשו העותרים לקבל את הנחלות הבלתי-מאויישות אולם הדבר לא צלח בשל הליכי הכינוס והשיקום שהאגודה מצויה בהם. יצוין כי עוד בשנת 1976 נחתמה אגרת חוב שלפיה מקרקעי המשבצת החקלאית של המושב, לרבות מקרקעי הנחלות הבלתי-מאוישות, משועבדים לטובת המשיב 7, בנק החקלאות לישראל בע"מ.
העותרים (או מקצתם) קיימו לאורך השנים הליכים שונים בנוגע לנחלות. בין השאר, הנושא נדון אצל המשקם ובד-בבד פנו העותרים, בשנת 2007, לבית המשפט לעניינים מנהליים, בעתירה דומה לזו שלפנינו. בית המשפט דחה את העתירה על הסף בקבעו, בין היתר, כי מ דובר בסכסוך בעל אופי אזרחי במהותו, כי בית המשפט אינו מוסמך לדון בו, וכי מתקיים לגביו הליך לפני הגורם המוסמך קרי: המשקם. בית המשפט אף הטעים כי בבוא העת הדרך לתקוף את פסק המשקם היא זו הנקובה בחוק הסדרים במגזר החקלאי המשפחתי, התשנ"ב-1992 (ראו סעיפים 29-27). על פסק-הדין של בית המשפט לעניינים מנהליים לא הוגש ערעור. העותרים פנו למשקם, העלו לפניו טענות דומות לאלה המועלות כאן, וככל שנמסר לנו ההליך בעניין זה טרם הסתיים (אף כי בינתיים גובשו הסדרים במטרה לסיים את הליך כינוס הנכסים וההסדרים קיבלו תוקף של פסק משקם).
העותרים מעלים שורה ארוכה של טענות. בין השאר הם משיגים על תוקפה של אגרת החוב ועל האפשרות לשעבד באמצעותה את הנחלות; הם גורסים כי לכונס הנכסים מטעם הבנק אין כל מעמד ביחס לנחלות הפנויות, שאינן נכס מנכסיו של המושב, וכי לא ניתן לפרוע את החובות של האגודה על-ידי מימוש הנחלות; הם סבורים כי לא ניתן לשנות החלטות שנתקבלו בנוגע לייעוד הנחלות, במיוחד לאור הסתמכותם על החלטות אלה; הם מדגישים את העובדה שמרבית הנחלות כבר הוקצו; הם טוענים כי אין להתנות את הקצאת הנחלות באישור המשקם, ומלינים על האופן שבו מתנהל ההליך לפני המשקם. לדברי העותרים ההסדרים המתגבשים בין המושב לנושים עומדים בניגוד להתחייבויות שניתנו להם.
עיינו בטענות העותרים ובתגובות המשיבים, ובאנו לכלל מסקנה כי דין העתירה להידחות על הסף.
הסמכות לברר את עיקר הטענות המועלות בעתירה מסורה למשקם והדרך לתקוף את החלטותיו קבועה בדין. כך קבע גם בית המשפט לעניינים מנהליים בדחותו על הסף את עתירתם המנהלית של העותרים, על קביעה זו לא הוגש ערעור ובפני המשקם מתקיים הליך בעניין הנדון בעתירה. בירור הטענות אצל המשקם הוא בבחינת סעד חלופי המהווה עילת-סף לדחיית העתירה שלפנינו. ודוק: בפני המשקם אכן מתנהל הליך הכולל גם את נושא זכויות העותרים. ההליך לא תם וגם אם בפי העותרים השגות לגבי ההליך ותוצאותיו, בית משפט זה אינו הערכאה המתאימה לדון בכך, בוודאי בשלב זה. מקובלת עלינו טענת המשיבים 1 ו- 2 כי עיקר טענות העותרים הן למעשה טענות נגד האגודה, נגד הכונס ונגד המשקם, וכן מקובלת עלינו הטענה כי ככל שיש בפי העותרים טענות כלפי המשיבים 1 ו- 2, הרי שאלה הן טענות שטרם הגיע זמנן, הכול כמפורט בתגובת המשיבים 1 ו- 2. אציין בשולי הדברים כי לא ניתן לשלול על הסף את טענות העותרים בדבר התמשכות הליכי הכינוס והשיקום, אולם הטענות והחומר שלפנינו לא מקימים עילה להתערבותנו בשלב זה.
על כן – העתירה נדחית על הסף.
