עתירה למתן צו על תנאי וצו ביניים

העותרת היא עמותה רשומה ששמה לה למטרה "לעודד ולהביא לשינויים חקיקתיים וחברתיים בישראל בתחום המשפחה וההורות ולקדם זכויות קטינים בישראל". עניינה של העתירה בבקשת העותרת כי נורה למשרד החינוך (להלן: המשיב ) לפרסם לאלתר הנחיות חדשות בכל הנוגע לרישומם לבתי ספר של תלמידים שהוריהם חיים בנפרד, כך שהנחיות אלו תתאמנה לאפוטרופסות של שני ההורים. לשיטת העותרת, אופן הרישום הרווח של תלמידים כאמור מנוגד להוראות החוק בהיותו מבוסס על חתימת הורה אחד בלבד חלף דרישת הסכמה משותפת של שני ההורים; תוך שמצב זה מביא לבלבול בקרב הוריהם של תלמידים אלה ואף למריבות ביניהם על חשבון טובת ילדיהם. העותרת סבורה כי מצב זה עומד בניגוד לחוק וסומכת את ידיה על חוק הכשרות המשפטית והאפוטרופסות, התשכ"ב-1965. בתוך כך הביאה העותרת הצעה אופרטיבית לשינוי המצב הקיים באמצעות טפסי רישום מטעמה שיש בהם לשיטתה כדי לרפא את הפגמים הקיימים.

נתבקשה תגובה מקדמית מטעם המשיב, שבה הביע זה את עמדתו כי דין העתירה להידחות הן על הסף, הן לגופה. אשר לדחייה על הסף סבור המשיב כי לעותרת קיים סעד חלופי, בשים לב לכך שהנושא שבו עוסקת העתירה נמצא בתחום סמכותם של בתי משפט לעניינים מינהליים, בהתאם לפרט 3 לתוספת הראשונה לחוק בתי משפט לענינים מינהליים, התש"ס-2000 (להלן: התוספת הראשונה ; החוק ). לעניין זה צוין כי לבד מהגשת העתירה דכאן הגישה העותרת שתי עתירות מינהליות בנושא דנן שנמחקו בעקבות קיומו של הליך בבית משפט זה. עוד נטען כי דין העתירה להידחות על הסף גם נוכח היותה כללית ותיאורטית, הואיל והעותרת נמנעה מלהציג פגיעה קונקרטית הנגרמת לכאורה כתוצאה ממדיניות המשיב בנושא הנדון. עוד טען המשיב כי דין העתירה להידחות אף לגופה תוך שעמד על המסגרת הנורמטיבית הצריכה לעניין.

לאחר שעיינו בעתירה ובתגובה המקדמית לה באנו לכלל מסקנה כי דין העתירה להידחות על הסף, נוכח קיומו של סעד חלופי בדמות פנייה לבית משפט לעניינים מינהליים. העותרת טוענת, כאמור, כי הרשויות המקומיות עורכות רישום ילדי גרושים או פרודים שלא כדין. לפי סעיף 5(1) לחוק בצירוף פרט 3 לתוספת הראשונה, לבית משפט לעניינים מינהליים נתונה הסמכות העניינית לדון בעתירה נגד רשות שעניינה "חינוך", להוציא חריגים שאינם מתקיימים בענייננו (בג"ץ 8989/07 העמותה האסלאמית במכר נ' משרד החינוך , פסקה 4 (19.3.2008); בג"ץ 1319/13 עבידאת נ' מדינת ישראל – משרד החינוך , פסקה 4 (19.2.2013); בג"ץ 8170/13 פלוני נ' שר החינוך (3.12.2013)). במצב דברים זה, על העותרת להביא את טענותיה לפני בית משפט לעניינים מינהליים ואין מקום כי בית משפט זה ידון בהן כערכאה ראשונה. למעלה מכך, כפי שעולה מהעתירה ומהתגובה לה, לא זו בלבד שלעותרת עומד סעד חלופי כאמור, אלא שהיא אף עתרה לסעד זה לאחרונה בשתי עתירות מינהליות שעניינן כענייננו. עתירות אלו נמחקו נוכח עתירה זו התלויה ועומדת לפנינו (האחת בהסכמת העותרת והשנייה בהחלטת בית המשפט, ראו בהתאמה: עת"ם 16155-11-14 עמותת "הורות משותפת-טובת הילד" נ' עיריית גבעת שמואל
(8.12.2014); עת"ם 5450-11-14 עמותת "הורות משותפת-טובת הילד" נ' עיריית תל אבי ב (23.12.2014)). הנה כי כן, העותרת מודעת לקיומו של סעד חלופי העומד לרשותה ואילו הייתה נמנעת מהגשת עתירה לבית משפט זה יש להניח כי העתירות המינהליות שהגישה היו זוכות להתברר לגופן. אכן, כפי שהובהר ביחס לעתירה אחרת שהגישה העותרת בהקשר קרוב (שנדחתה אף היא על הסף), "אין מחלוקת עקרונית על נקודת המוצא החשובה העומדת ביסוד העתירה – הערך הגלום בקשר שבין הורים לילדיהם" (בג"ץ 1273/13 עמותת "הורות משותפת = טובת הילד" נ' מדינת ישראל , פסקה 16 (18.6.2013)). אלא שכאשר עומד לעותרת סעד חלופי, עליה למצותו. משאלה הם פני הדברים, לא ראינו להתייחס לטענות המועלות בעתירה לגופן, ולמותר לציין שאיננו נוקטים לגביהן כל עמדה.
אשר על כן, העתירה נדחית על הסף. העותרת תישא בהוצאות המשיב בהליך זה בסך 2,500 ש"ח.
