ענייננו במשאלת המשיבים מעיקרא להרוס חלקות ולאטום חלקית את בית משפחתו של המפגע שניסה לרצוח, על בסיס לאומני, את מר יהודה גליק בגין פעילותו הקשורה להר הבית, ותודה לאל ולמרבה המזל לא צלחה דרכו המפגע עצמו נהרג מששלף אקדח כלפי כוחות הביטחון שבאו לעצרו.

ביום 1.12.14 הוצא על-ידינו צו על תנאי בעתירה זו, באשר למידתיות השימוש בתקנה 119 לתקנות ההגנה (שעות חרום), 1945 במקרה דנא; בהקשר זה ציינו כי איננו מתעלמים מן השיפור שחל במצבו של מר גליק, אשר נפצע קשה בהתנקשות, ועם כל חומרת המעשה, ביקשנו בחינה קפדנית של כל חלופה אפשרית להריסת הבית. המישור העקרוני בעניין כולו נדון בפסק הדין בבג"ץ 8091/14 המוקד להגנת הפרט נ' שר הביטחון (31.12.14), ולא נשוב להידרש לכך כאן.
ג.
ביום 2.3.15 הוגשה תשובת המשיב, ובה נאמר כי לאחר שיקול ובעקבות פסק הדין בעתירת המוקד להגשת הפרט ובעתירות פרטניות אחרות "הוחלט לנקוט במקרה דנן בצעד מידתי יותר, ולהורות על אטימת החדר בו התגורר המחבל בלבד, בלא פגיעה בשאר חלקי הדירה והמבנה" (הדגשה במקור). הוטעם עם זאת, כי השימוש בתקנה 119 עניינו הרתעת הרבים, ועל כן יהא תלוי נסיבות, גם אם לא נקטפו חיי אדם.
ד.
עוד קודם לכן, ב-12.1.15 ביקש מר גליק להצטרף לעתירה כמשיב ולחלופין כידיד בית המשפט, וזאת בהיותו הקרבן. המשיב הותיר לשיקול דעת, אף ששב וציין כי החלטתו בפרשה עניינה הרתעת הרבים; והעותרים סברו כי משאין הם מואשמים בפגיעה במבקש, אין מקום לצירופו.
ה.
בדיון בפנינו ביום 14.6.15 טען עו"ד חביב לעותרים, כי משלא הסתיים האירוע בקיפוח חיים ואין טענה למעורבות המשפחה, היא נענשה דיה במות בנה, ואין מקום לתוספת הרתעה, שכן פירוש הדבר חוסר מידתיות גם אם חל שינוי בהחלטה, ואף אין מקום לראות את הנושא כמצוי כל עיקר בגדרי תקנה 119; זאת, מה גם שהשטח נרגע לאחר תקופה קשה.
ו.
מטעם המשיבים נאמר, כי בעקבות מתן צו על תנאי נדון הנושא במערכת הביטחון ובפרקליטות, והוחלט על אטימת חדרו של המפגע בלבד, ובכך הושגה מידתיות, לאחר שהמישור העקרוני הוכרע. הנושא כולו כרוך בהרתעת הרבים.
ז.
מטעם המבקש להצטרף, נטען כי נשקלת אפשרות תביעה נזיקית כלפי בני המפגע, וכי המבקש להצטרף מתקשה להמשיך לתפקד; הוצגה תלונה מטעמו למשטרה, ובה נטען בין השאר כי משפחת המחבל מקבלת כספים לנוכח מעשי בן המשפחה, וכן נראו בני המשפחה בסרטון, צופים בבנם המאיים בפעילות טרור ובעניין הר הבית בפרט. נציין כי שמענו בקשב את הדברים מטעמו של המבקש להצטרף, ובכך נסתפק לעניין עתירה זו.
ח.
לגופם של דברים, סבורים אנו כי משחל שינוי מהחלטה כללית שעניינה הריסה ואטימה להחלטה חלקית לאטום את חדרו של המפגע בלבד, וזו ההחלטה המונחת לפנינו עתה – יש בכך משום ביטוי למידתיות, שהיא רלבנטית גם בשעסקינן בהרתעה. בהחלטה החדשה והממותנת איננו רואים מקום להתערב. בנתון לכך ולהכרעה העקרונית הנזכרת, מתבטל איפוא הצו על תנאי. העתירה נמחקת בלא צו להוצאות.
