בעתירה נטען, כי העותרת פנתה ביום 19.4.2012 לוועדה המקצועית המייעצת לשר הפנים "בבקשה לקבלת היתר שהייה/רישיון ישיבה בישראל מטעמים הומניטאריים מיוחדים לפי סעיף 3א1 לחוק האזרחות והכניסה לישראל (הוראת השעה) התשס"ג" וכי פנייה זו לא נענתה. עם זאת, מתגובת המשיבים עולה, כי פנייה כאמור לא התקבלה אצל המשיב 2. יתרה מכך, במכתב שנשלח לעותרת ביום 23.12.2012, קרי לאחר המועד בו נטען כי נעשתה פנייה לוועדה המקצועית, הובהר לעותרת כי לא ניתן לשדרג את מעמדה (ככל הנראה, מכוח סעיף 7 לחוק האזרחות, התשי"ב-1952) וכי באפשרותה לפנות לקבלת מעמד מטעמים הומניטאריים.
נוכח האמור, יודיעו העותרים עד ליום 4.3.2013 אם ברצונם למחוק את עתירתם ולהגיש בקשה מסודרת לוועדה המקצועית לפי סעיף 3א1 לחוק האזרחות והכניסה לישראל או שמא הם עומדים על עתירתם.
