הנשיאה ד' ביניש:
לפנינו עתירה שהגישו בני משפחת המנוח שלומי
וואזנה ז"ל כדי לבטל את החלטת בית משפט השלום בתל-אביב-יפו אשר הורתה על נתיחת גופתו של המנוח בשל הצורך בחקירה בדבר נסיבות מותו, אשר ארע כתוצאה מפיצוץ מטען חומר נפץ במוסך. המשטרה חוקרת בכיווני חקירה שונים בדבר העבירה שנעברה אשר גרמה למוות ולפציעתם של אנשים נוספים שנכחו במקום.
בא-כוח המשפחה, עו"ד ד' שוסהיים, ביקש מאיתנו להורות על ביטול החלטת בית משפט השלום וטען בהרחבה כי הנתיחה אינה יכולה לתרום לחקירה מעבר לממצאי הזירה והנתונים המתקבלים מרסיסי חומר הנפץ שנמצאו בגופם של הפצועים. שמענו את טיעוני המשטרה הן במעמד הצדדים ובהסכמה גם במעמד צד אחד, כדי לקבל פרטים ביחס למתחייב בחקירה וביחס לחוות דעת מנהל המכון לרפואה משפטית באשר לצורך בנתיחה לשם קידום החקירה.
לאחר שמיעת הטענות באנו לידי מסקנה כי על פי העילות המנויות בסעיף 19 וסעיף 26 לחוק חקירת סיבות מוות, ובהתאם להוראת סעיף 9 לחוק האנטומיה והפתולוגיה, תשי"ג-1953, אכן דרושה הנתיחה לצרכי החקירה כיוון שהמוות נגרם בעבירה. כלל נקוט בידינו משום כבוד המת, כי בכל מקרה שנדרשת נתיחה לצרכי חקירת עבירה, אנו מנחים את רופאי המכון לרפואה משפטית להסתפק בנתיחה חלקית, או בדיקה חיצונית ככל שאין בכך כדי לפגוע בחקירה הנדרשת. בנסיבות העניין שלפנינו שוכנענו כי הנתיחה היא חיונית לחקירה ולא נוכל לקבוע את היקף הנתיחה. אנו יוצאים מההנחה שהרופאים יפעלו רק ככל הדרוש לפענוח נסיבות גרימת המוות.
