החלטה

לפני בקשה מטעם העותרות לחיוב המשיבים 2-1 (להלן: המשיבים) בהוצאות עתירה זו. עניינה של העתירה (מיום 8.11.06) בבקשת העותרות כי המשיב 1, שר הפנים, יאשר את הסכם החכירה שנחתם בין העותרות לבין המשיבה 3 לגבי מקרקעין שהופקעו לטובת האחרונה, וזאת מכוח סמכותו הקבועה בסעיף 188(א) לפקודת העיריות [נוסח חדש]. ביום 11.8.08 ניתן האישור האמור, ולבקשת העותרות, החלטתי ביום 1.9.08 להורות על מחיקת העתירה. מכאן הבקשה לעניין ההוצאות.

העותרות טוענות כי עתירתן הוגשה לאחר כשש שנים בהן נמנע שר הפנים מלאשר את הסכם החכירה עקב התנגדות המשיב 2 – מינהל מקרקעי ישראל (להלן: המינהל), ורק לאחר שעשו כל שניתן על מנת להשיג את האישור המבוקש, לרבות פניות למינהל ופגישה עם העומד בראשו. לטענתן, לא היה בסמכות שר הפנים להתחשב באינטרסים הכספיים של המינהל ולעכב את האישור בשל כך, ועל כן יש לראות בהימנעותו מאישור ההסכם כאצילה אסורה של סמכותו למינהל. כפי הנטען, במהלך הדיון שהתקיים בעתירה התברר כי שר הפנים נמנע כלל מלדון בהסכם החכירה עד לאותו מועד. עקב כך, הורה לו בית משפט זה לעשות כן, אולם גם אז נמנע הוא מקבלת החלטה בנדון. לטענת העותרות, רק בעקבות הגשת העתירה נסוגו לבסוף המשיבים 2-1 מעמדתם האמורה, ואושר הסכם החכירה.

המשיבים מתנגדים לבקשה. לטענתם, לא עצם הגשת העתירה היא שהובילה לקבלת הסעד המבוקש. כפי הנטען, לאחר שהועבר הסכם החכירה לאישורו, העבירו שר הפנים לוועדה המחוזית לתכנון ובניה מחוז דרום (להלן: הוועדה המחוזית), לצורך קיום חובת ההיוועצות הקבועה בסעיף 195 לחוק התכנון והבניה, התשכ"ה-1965. זאת, נוכח העובדה שהמ דובר במקרקעין שהופקעו, וכן בהתאם להליך הבדיקה הנהוג על ידי משרד הפנים. בנסיבות העניין, ביקשה הוועדה המחוזית את התייחסותו של המינהל להסכם, אשר הודיע כי הוא מתנגד לאישורו, מנימוקים שונים. לטענת המשיבים, בשל כך לא ניתנה עמדת הוועדה המחוזית לשר הפנים, ובשלב זה הוגשה העתירה. כפי הנטען, בהמשך הדברים ולנוכח התנגדות המינהל נתקיים דיון בראשות המשנה ליועץ המשפטי לממשלה (אזרחי), ובסופו הוחלט כי בהתאם לעמדת היועץ המשפטי לממשלה בעע"מ 7315/02 הוועדה המקומית לתכנון ובניה אור יהודה נ' בירנבוים , יפנה המינהל לוועדה המחוזית בבקשה לתיקון תכנית המתאר, מכוחה הופקעו המקרקעין נשוא הסכם החכירה מלכתחילה, כך שתבוטל הפקעת המקרקעין שבבסיס הסכם החכירה. המינהל אכן עשה כן והוגשה לאישור תכנית חדשה המבטלת את ההפקעה. אולם, תכנית זו לא אושרה על-ידי הוועדה המחוזית. רק בעקבות החלטת הוועדה המחוזית לדחות בקשה זו, אישר מנכ"ל משרד הפנים (אליו הואצלה הסמכות) את הסכם החכירה.

לאחר עיון בחומר שלפני, מסקנתי היא כי קם בנסיבות המקרה בסיס לחיוב המשיבים 2-1 בהוצאות העותרים. אכן, דומה כי לב המחלוקת בבקשה שלפני היא אם הגשת העתירה הובילה לקבלת הסעד. בהקשר זה מסתברת יותר המסקנה כי הגשת העתירה תרמה תרומה משמעותית לקידום החלטת שר הפנים בנדון. כך הדבר, שכן עד להגשת העתירה לא נתקבלה החלטה והעניין אף לא הובא להכרעת שר הפנים. ההחלטה להורות למינהל להגיש התנגדותו למוסדות התכנון באה לאחר העתירה וכפועל יוצא ממנה (וראו בהקשר זה האמור בסעיף 15 לתגובת המשיבים 2-1 מיום 6.9.07). מהחלטה זו נבע עיכוב מובנה בהכרעה בנדון, אם על-ידי שר הפנים ואם על-ידי בית משפט זה, אולם בסופו של דבר גם מניעה זו הוסרה והסעד ניתן. עולה מכאן, שישנו קשר סיבתי מספיק בין הגשת העתירה לבין קבלת הסעד, או למצער זירוז קבלתו והנעת ההליך שהיה קשור בו. ממילא זכאים העותרים להוצאותיהם.

אשר לשיעור ההוצאות, הרי שבשים לב לעתירה; סבבי כתבי הטענות; הדיון שהתקיים וכן סיום ההליך לא צורך במתן פסק-דין, ישאו המשיבים בשכר טרחת העותרים בסך של 10,000 ₪ וכן בהוצאות משפט בסך של 1,500 ₪ נוספים. סכומים אלו ישאו הפרשי ריבית והצמדה כדין מיום ההחלטה ועד התשלום בפועל.
