הסעד העיקרי שהתבקש בעתירה שלפנינו, שהוגשה בחודש דצמבר 2011, הינו להורות למשיבה 3 (להלן – רשות השידור ) לקיים את הוראת סעיף 44ג והתוספת לחוק רשות השידור, התשכ"ה-1965. לפי האמור שם, על רשות השידור להשקיע לפחות חמישה עשר אחוזים מכלל הכנסותיה בשנים 2013-2012 לרכישת הפקות מקור מקומיות. עוד נדרש כי עשרה מתוך חמישה עשר האחוזים יוקצו לרכישת תוכניות סוגה עילית. בהודעה המעדכנת שהוגשה מטעם רשות השידור ביום 15.1.2014 פורט כי בשנים 2012 ו-2013 רכשה רשות השידור תוכניות בהפקה מקומית קנויה, והפקות סוגה עילית, בסכום העולה על הסכום המינימלי הנדרש על פי החוק. בנסיבות אלה, אנו סבורים כי העתירה במתכונתה הנוכחית מוצתה.

בתגובתם של העותרים מיום 3.3.2014 להודעה המעדכנת, ביקשו העותרים כי נורה לרשות השידור להמשיך ולהגיש הודעות מעדכנות, בהן יינתן פירוט אודות התשלומים שבוצעו על ידי הרשות בפועל לעניין החוזים שנחתמו בשנים 2013-2012, וכן אודות עמידת הרשות בחובות בשנים 2016-2014. יצוין, כי על פי התוספת לחוק, אחוזי ההכנסות אותם נדרשת רשות השידור להשקיע בהפקות השונות יוגדלו באופן הדרגתי בשנים אלה. נוכח עמדת הצדדים, אנו מורים כי:
(א) רשות השידור תמציא לידי העותרים, לא יאוחר מיום 31.1.2015, הודעה ובה יימסר דיווח לגבי החוזים שנחתמו לעניין הפקות מקומיות בשנת 2014 וכן פירוט התשלומים שבוצעו לעניין אותם חוזים שנחתמו בשנים 2013-2012. הדיווח יכלול אבחנה בין הפקות רגילות לבין הפקות של סוגה עילית.
(ב) דיווחים דומים לאלה הנזכרים לעיל יוגשו לעותרים לא יאוחר מיום 31.1.2016 ומיום 31.1.2017, וזאת לגבי החוזים שיחתמו בשנים 2015 ו-2016 בהתאמה.
(ג) העתירה תימחק בכפוף לאמור לעיל. המשיבה 3 תישא בשכר-טרחת באי כוח העותרים בסכום של 15,000 ש"ח.
