לפניי בקשה מטעם העותר לפסיקת הוצאות – זאת לאחר שהעתירה נמחקה לבקשתו ביום 19.9.2010. לאחר עיון בטענות הצדדים נחה דעתי כי דין הבקשה להתקבל. במבוא לעתירה ביקש העותר להורות על שחרור בעין של מקרקעין בכפר אבו-גוש; מדובר במקרקעין שהוקנו למשיב 1 לפני שנים רבות לפי חוק נכסי נפקדים, התש"י-1950 (להלן: החוק ). עוד קודם להגשת העתירה טען המשיב – במענה לפניותיו של העותר – כי אין אפשרות לדון בבקשה לשחרור בעין של הנכס, זאת מן הטעם שהנכס נמכר זה מכבר למשיבה 2, והמשיב 1 מחזיק רק בתמורה (סעיף 28 לחוק). המשיבים מחזיקים בעמדה עקרונית זו גם היום. עם זאת, בפועל, הפתרון שהוצע לעותר – אשר הביא למחיקת העתירה – הוא הבאת הבקשה לשחרור הנכס בעין לפני הוועדה המיוחדת לפי סעיף 29 לחוק. המשיבים אמנם טוענים כי פתרון זה אין בו משום היענות לסעד שנתבקש בעתירה, אך אין בידי לקבל טענה זו. עיון בעתירה מלמד כי העותר חתר לכך שבקשתו לשחרור הנכס בעין תובא לפני הועדה (ראו למשל סעיפים 22-18 לעתירה). נכון הדבר שבמבוא לעתירה הסעד נוסח בלשון גורפת יותר (מתן הוראה למשיבים להורות על שחרור הנכס בעין), אך עיון בעתירה גופה מלמד כי הנכונות להביא את בקשתו של העותר לשחרור הנכס בעין לפני הועדה היא בהחלט היענות, ולוּ חלקית, לתכלית שלשמה הוגשה העתירה. ודוק: הנכונות להביא את בקשתו של העותר לשחרור הנכס בעין לפני הוועדה היא צעד שהמשיב לא נאות לו קודם להגשת העתירה – והדברים עולים במפורש גם מתגובת המשיבים (ראו סעיפים 6-5 לתגובה). המשיבים מדגישים כאמור כי הם עומדים על עמדתם העקרונית, וכי הפתרון שהוצע לעותר הוא פתרון פרקטי שנועד לחסוך בהתדיינות ובזמן שיפוטי. אלא שבטענה זו אין כדי לגרוע מן המסקנה כי הגשת העתירה קידמה את עניינו של העותר באופן העולה בקנה אחד עם מטרת העתירה.
אם כן, העותר יצא כשסעד בידו; סעד שהעתירה כיוונה אליו. במצב דברים זה, ולאחר שהבאתי בחשבון את טענות הצדדים כולן, באתי לכלל מסקנה כי יש מקום לחייב את המשיבים בתשלום הוצאות לעותר. לגבי שיעור ההוצאות, יש להביא בחשבון, בין היתר, את אופיו של הפתרון שהוביל להתייתרות העתירה, את העובדה שלא מדובר בעתירה מורכבת, ואת היקף ההתדיינות המועט (יובהר כי לאחר הגשת העתירה לא הוגשו כתבי טענות מהותיים נוספים והעתירה לא נדונה לפני הרכב). עוד יצוין כי אין לפניי ראיות כלשהן לגבי שיעור ההוצאות ושכר הטרחה. על יסוד כל האמור, מצאתי לנכון לפסוק לעותר שכר-טרחת עורך-דין בסכום של 3,500 ₪. סכום זה יישא הפרשי הצמדה וריבית כדין מיום ההחלטה ועד התשלום בפועל.
