החלטה
לפניי בקשה למחיקה על הסף של ההליך שבכותרת, מחמת איחור בהגשתו.

ההליך נסב על פסק דין של בית המשפט לעניינים מינהליים בחיפה, שדן בערעור על תוצאות הבחירות במועצת העיר נהרייה. בית המשפט דחה את ערעור הבחירות, הן מטעמים דיוניים והן לגופו של עניין, משלא מצא כי נפל פגם כלשהו באמצעי התעמולה בהם נעשה שי מוש , כטענת המבקש. פסק הדין ניתן ביום 3.12.2008 בהעדר הצדדים. בשוליו נכתב כי יש להודיע לצדדים בדחיפות כי ניתן פסק הדין.

הבקשה לרשות ערעור הוגשה ביום 21.12.2008. בסמוך לאחר הגשתה הגישו המשיבים 1 ו-2 בקשה לסילוק ההליך על הסף, מחמת איחור של המועד הקבוע בדין. המשיבים התבססו על סעיף 73(א) לחוק הרשויות המקומיות (בחירות), התשכ"ה-1965 (להלן – חוק הבחירות ) לפיו "בקשת הרשות תוגש תוך 14 יום מיום מתן פסק הדין". לטענתם, המועד להגשת ההליך הסתיים ביום 17.12.2008, כך שההליך הוגש באיחור של ארבעה ימים. משיב 3 הודיע גם הוא כי לשיטתו דין הבקשה לרשות ערעור להיות מסולקת על הסף בשל הגשתה באיחור. המבקש טען בתגובה כי פסק הדין הומצא לו ביום 9.12.2008. לטענתו, יש למנות את הימים להגשת ההליך ממועד המצאת פסק הדין, באופן שמניין הימים במקרה דנן הסתיים ביום 22.12.2008. המבקש ביקש להסתמך בעניין זה על תקנות סדר הדין האזרחי, התשמ"ד-1984 בעניין המצאת פסקי דין.

נקודת המוצא לדיון מצויה בסעיף 73(א) לחוק הבחירות, הקובע כדלהלן:
"בית המשפט יפסוק בערעור בחירות תוך שלושים יום מיום הגשתו, ופסק דינו יהיה ניתן לערעור לבית המשפט העליון ברשות שופט של בית המשפט העליון, בשאלה משפטית; בקשת הרשות תוגש תוך 14 יום מיום מתן פסק הדין".
לשונו של סעיף 73(א) ברורה היא ועל פיה יימנה המועד להגשת בקשה לרשות ערעור מעת מתן פסק הדין ולא מעת ההמצאה. יצוין כי הליך של הגשת ערעור בחירות הוא אמנם במהותו הליך של ערעור מינהלי, כפי שגם נקבע בסעיף 72(א) לחוק הבחירות. יחד עם זאת, המועד להגשת בקשה לרשות ערעור על ערעור בחירות קבוע בהוראה מפורשת של חוק הבחירות. הוראה זו עומדת על רגליה שלה ואינה מפנה באופן כלשהו לתקנות בתי משפט לעניינים מנהליים (סדרי דין), התשס"א-2000, שהן עצמן מפנות לתקנות סדר הדין האזרחי, התשמ"ד-1984 (תקנה 34). ההוראה הספציפית הקבועה בסעיף 73(א) לחוק הבחירות גוברת על ההוראות הכלליות של תקנות בתי משפט לעניינים מנהליים (סדרי דין), התשס"א-2000. קביעה זו מתחייבת, בראש וראשונה, בשל העליונות הנרטיבית של חקיקה ראשית ביחס לחקיקת משנה. נמצא, כי בהליכי ערעור המוסדרים בסעיף 73(א) לחוק הבחירות אין תחולה להוראה של כללי הדיון האזרחי והמנהלי, לפיה מניין הימים מתחיל מיום המצאת פסק הדין כאשר פסק הדין ניתן שלא בפני המערער ומבלי שהוזמן לשימוע. מניין הימים בהגשת הליך מכוח סעיף 73(א) לחוק הבחירות מתחיל, איפוא, ביום מתן פסק הדין, בין אם נכח המערער במעמד מתן פסק הדין ובין אם לאו.

ההוראה העצמאית בסעיף 73(א) לחוק הבחירות לגבי אופן מניין הימים, נובעת מהמאפיינים הייחודיים של ערעורי בחירות. הוראה דומה מצויה בסעיף 86(ה) לחוק הבחירות לכנסת [נוסח משולב] התשכ"ט-1969. ברוח זו קובע סעיף 73(א) לחוק כי בית המשפט יפסוק בערעור בחירות תוך שלושים יום מיום הגשתו. הוראות אלה נועדו כולן להחיש את ההליכים המשהים את סופיות תוצאות הבחירות. הן נועדו להבטיח כי לצד השמירה על טוהר הבחירות תובטח גם סופיות הליך הבחירות ויציבות השלטון הנבחר. המחוקק מחייב איפוא את המבקש לבטל את תוצאות הבחירות שלא לשקוט על שמריו. עליו להזדרז בנקיטה בהליכים משפטיים, ולא – יחמיץ את השעה. גם הגישה הנקוטה בבתי המשפט היא כי בכל הנוגע לענייני בחירות, יש טעם מיוחד לסיים את ההתדיינות בהקדם האפשרי. כך, נפסק לא פעם בבית משפט זה כי המהירות בנקיטת ההליכים בענייני בחירות היא חיונית (ראו, בג"ץ 2115/99 הועד המקומי צור יגאל נ' שר הפנים , פ"ד נג(4) 61 והאסמכתאות המובאות שם). יתרה מכך, כאשר עסקינן בבחירות, לעיתים די אף בשיהוי קצר, אפילו הוגש ההליך במועד, כדי להביא לדחיית ההליך על הסף (ראו, למשל, בר"מ 543/04 פיסל מסאלחה נ' זוהיר יוספיה (לא פורסם, 22.1.2004).

סיכומו של דבר, המועד להגשת בקשה לרשות ערעור על ערעור בחירות נמנה מיום מתן פסק הדין ולא מיום המצאתו לצדדים. ההליך שבכותרת הוגש בחלוף 18 ימים מעת מתן פסק הדין דלמטה. בכך החמיץ המבקש את המועד הקבוע בחוק להגשת ההליך. במצב דברים זה אין מנוס ממחיקת ההליך מן הרישום, וכך אני מורה. כל צד ישא בהוצאותיו. ההחלטה תומצא לבעלי הדין ללא דיחוי באמצעות הפקסימיליה.
