החלטה
חרף התנגדות המשיב, ואף שנכון הדבר כי הטענות בדבר המצב הכלכלי לא בוססו כדבעי, מצאתי כי במקרה זה, לצד הפטור מתשלום אגרה (שהמשיב אינו מתנגד לו), ראוי ליתן גם פטור מערבון. אציין כי איני מביע כל עמדה לעניין סיכויי ההליך, בפרט שעה שכבוד השופט פוגלמן הורה על מתן תשובת המשיב לבקשת רשות הערעור – עד ליום 30.7.2013.
