בקשה לצירוף צד
החלטה
לפניי בקשה מטעם "רשת עמל 1 בע"מ" (להלן: רשת עמל ), לצרפהּ כמשיבה בהליך שבכותרת.
בקשת רשות הערעור שבכותרת נסבה על פסק-דין של בית המשפט לעניינים מנהליים בתל-אביב-יפו; בפסק-הדין נדחה ערעור מנהלי שהגישה אורט ישראל (להלן: אורט ), הטוענת כי היא זכאית – מכוח סעיף 5ג(ה)(3) לפקודת מסי העירייה ומסי הממשלה (פיטורין), 1938 – לפטור מלא מארנונה בגין בית-הספר המקצועי "יד שפירא" (שנות המס הנדונות הן 2008 ו- 2009, עובר לתיקון הפקודה).
רשת עמל טוענת כי גם היא – כמו אורט – מפעילה בתי ספר תיכון מקצועיים, ומנהלת שני הליכים של ערעור מנהלי שבהם מתעוררת שאלה זהה לזו המצויה בלבו של ההליך שבכותרת – שאלת הזכאות לפטור מארנונה מכוח סעיף 5ג(ה)(3) הנ"ל. רשת עמל מטעימה כי הליכיהַ-שלה "הוקפאו" עד להכרעה בהליך דנן, וכי לתוצאה שתתקבל בתיק זה צפויה להיות השפעה ישירה על התיקים שלה. לדעת המבקשת יש לאפשר לה להצטרף להליך כבר עתה – אף טרם שניתנה לאורט רשות ערעור – הן על-מנת שתוכל להמחיש את משקלה של הסוגיה הנדונה, הן על-מנת שתוכל להשלים את התמונה העובדתית והמשפטית. המבקשת גורסת כי צירופה להליך יביא לייעול ההליך ולחסכון בהתדיינויות.
אורט הודיעה כי אינה מתנגדת לצירוף המבוקש. המשיב לעומת זאת סבור כי בקשה זו אינה מעוגנת בדין ואינה מוצדקת כלל.
דין הבקשה להידחות.
ראשית, מן הראוי להעמיד דברים על דיוקם מבחינת המסגרת הנורמטיבית. רשת עמל סבורה כי הסמכות להורות על צירופה כמשיבה בהליך בקשת רשות הערעור מצויה בתקנה 24 לתקנות סדר הדין האזרחי, התשמ"ד-1984 (להלן: תקנות סדר הדין האזרחי ), ובתקנה 6 לתקנות בתי משפט לעניינים מינהליים (סדרי דין), התשס"א-2000 (להלן: תקנות בתי משפט לעניינים מינהליים ). ובכן – לא כך הדבר.
אשר לתקנה 6 לתקנות בתי משפט לעניינים מינהליים, זו מתייחסת להליך של עתירה מנהלית , והיא קובעת כי "המשיבים בעתירה יהיו הרשות שנגד החלטתה מכוונת העתירה, כל רשות אחרת הנוגעת בדבר, וכן כל מי שעלול להיפגע מקבלת העתירה". אלא שאנו איננו עוסקים היום בהליך של עתירה מנהלית, כי אם בהליך של בקשת רשות ערעור על פסק-דין בערעור מנהלי ; ואין ללמוד משם לכאן. גם סעיף 24 לתקנות סדר הדין האזרחי – שעניינו מחיקה או הוספה של תובע או נתבע בהליך של תובענה אזרחית – אינו הסעיף הרלוונטי.
לגבי הליך של ערעור מנהלי, תקנה 25 לתקנות בתי משפט לעניינים מינהליים קובעת כי "המשיב בערעור מינהלי יהיה כל מי שהיה בעל דין להליך לפני בית הדין, למעט המערער". האם ניתן להורות על צירופו של משיב נוסף – שלא היה בעל-דין בהליך הערעור המנהלי – להליך בקשת רשות הערעור על פסק-הדין בערעור המנהלי?
העיגון הסטטוטורי לסמכותו של בית המשפט העליון להורות על צירוף משיב לערעור על פסק-דין של בית המשפט לעניינים מנהליים מצוי בפרק ל לתקנות סדר הדין האזרחי – החל מכוח תקנה 34 לתקנות בתי משפט לעניינים מינהליים; בפרט רלוונטיות לעניין זה תקנה 424, הקובעת כי המשיב בערעור יהיה כל מי שהיה בעל דין בערכאה הקודמת ואינו מערער, ותקנה 425 הקובעת את האפשרות להורות על צירוף משיב שלא היה בעל-דין בערכאה הקודמת (ראו למשל עע"ם 7926/06 אדרי-אל ישראל בע"מ נ' הוועדה המקומית לתכנון ובניה גליל עליון (טרם פורסם, 24.06.2009)) . אציין, כי תקנה 425 חלה לפי לשונה על הליך של ערעור בזכות, אך ניתן לסבור כי אין מניעה עקרונית להחילה בשינויים המחויבים גם בהליך של בקשת רשות ערעור (ראו רע"א 7311/10 כהן נ' דדון (לא פורסם, 22.12.2010)). מכל מקום, הצדדים לא נדרשו לשאלה זו, ולאור המסקנה שאליה הגעתי איני רואה לקבוע מסמרות בעניין זה.
על-פי פסיקת בית המשפט העליון, כאשר נבחנת השאלה אם לאפשר את צירופו של משיב להליך הערעור, יש לבדוק את אמות המידה הבאות: האם הגורם שצירופו מתבקש עלול להיפגע ישירות אם לא יצורף לערעור; האם ראוי שפסק הדין יכבול כמעשה בית דין את אותו גורם; והאם שיקולי יעילות תומכים בהצטרפות (ראו בש"א 3973/91 אליהו חברה לביטוח בע"מ נ' קרנית – קרן לפיצוי נפגעי תאונות דרכים , פ"ד מה (5) 457, 463 (1991)). הנטל להוכיח את התקיימותם של התנאים האלה מוטל על מבקש הצירוף (ראו עניין אדרי-אל ישראל הנ"ל).
בענייננו, לא שוכנעתי כלל וכלל בקיום הצדקה לצירופה של רשת עמל כמשיבה בהליך – משיבה החפצה למעשה לחבור לעמדתה של אורט ולהשיג על פסק-הדין של בית המשפט לעניינים מנהליים (שניתן בעניינה של אורט). בלב בקשתה של רשת עמל מונחת טענה אחת, והיא כי הסוגיה המתעוררת בהליך בקשת רשות הערעור שבכותרת מתעוררת גם בהליכים שהיא-עצמה מנהלת. ובכן, טענה זו כלשעצמה אין בה די כדי להצדיק את צירופו של מאן-דהוא כבעל דין בהליך ערעורי (לאחר שלא היה בעל-דין בערכאה הדיונית).
חזון נפרץ הוא שסוגיה משפטית המובאת לדיון בבית משפט זה מתעוררת גם בהליכים אחרים התלויים ועומדים בערכאות הדיוניות. גם אין זה דבר נדיר ויוצא דופן שפסק-דין של בית המשפט העליון יהא בעל השלכה אפשרית, לאור עקרון התקדים, על עניינם של אנשים וגורמים שאינם בעלי-דין בהליך. אולם אין להעלות על הדעת כי בכל מקרה כזה יצורפו כל הצדדים בהליכים התלויים ועומדים כמשיבים בהליך הערעור המתקיים בבית משפט זה. ודוק: בענייננו רשת עמל לא הייתה בעלת-דין בהליך בבית המשפט קמא, ואין היא זכאית להצטרף כבעלת-דין בהליך בקשת רשות הערעור רק מן הטעם שהקביעות המשפטיות של בית משפט זה עשויות להשליך על הליכים אחרים המתנהלים בעניינה. מקל וחומר שאין הצדקה לצרף את רשת עמל בשלב הנוכחי שבו טרם ניתנה רשות ערעור. יובהר, כי רשת עמל מעלה טענות כאלה ואחרות בעניין יכולתה לתרום להליך, אך טענות כלליות אלה לא שכנעוני כי מדובר בתרומה הנושאת משקל סגולי המצדיק את הצירוף המבוקש. אדרבא, יש סיבה להניח כי צירופה של רשת עמל כמשיבה בהליך (משיבה מבחינה פורמאלית – מהותית מדובר על חבירה לעמדתה של אורט), עלול להכביד על ההליך ולפגום ביעילות הדיונית.
סוף דבר: הבקשה נדחית. רשת עמל תישא בשכר טרחת עורך-הדין של המשיב בסכום של 3,500 ₪.
