לכל אחד מבתי המשפט לענינים מינהלים במחוזות ירושלים, מרכז-לוד, ותל-אביב-יפו, הוגשה בקשה לאישור תובענה ייצוגית. שלוש בקשות האישור הוגשו נגד רשויות מקומיות ותאגידי מים ברחבי הארץ, אלו הן המשיבות 10-1. הטענה המרכזית בבקשות האישור הינה, כי במים שמספקות המשיבות 10-1 לתושבי הרשויות הרלוונטיות, נמצא ריכוז נמוך של פלואוריד מזה הנדרש על פי דין. לטענת המבקשים בבקשות האישור (להלן – המבקשים ), על המשיבות 10-1 היה להפחית את תעריף המים באופן שישקף את הריכוז הנמוך, לטענתם, של פלואוריד במים המסופקים לצרכנים. יצוין, כי המבקשים מיוצגים כולם על ידי אותם עורכי דין. בבקשה דנא עותרים המבקשים לאחד את הדיון בכל בקשות האישור. לטענתם, בקשות האישור מעוררת שאלות משפטיות ועובדתיות משותפות. יצוין, כי בקשות האישור הוגשו בפער של ימים ספורים.

הבקשה הוגשה לפי תקנה 7 לתקנות סדר הדין האזרחי, התשמ"ד-1984 (להלן – תקנות סדר הדין ). לטענת המבקשים, ראוי לפעול לאיחוד הדיון לפי התקנה האמורה ולא לפי המסלול הקבוע בסעיף 7 לחוק תובענות ייצוגיות, התשס"ו-2006 (להלן – חוק תובענות ייצוגיות ; אשר ליחס בין שתי הוראות הדין ראו, בש"א 8226/12 דיפלומט מפיצים (1968) בע"מ נ ' בשתאוי (30.1.2013)). בנסיבות העניין אין צורך לקבוע אם המבקשים פעלו נכון עת הגישו בקשה לפי תקנה 7 לתקנות סדר הדין ולא לפי סעיף 7 לחוק תובענות ייצוגיות. זאת, משום שאף אחת מהמשיבות לא הביעה התנגדות לעצם איחוד הדיון. בין חלק מבעלי הדין קיימת, עם זאת, מחלוקת לגבי זהותו של בית המשפט בו יתקיים הדיון המאוחד. המבקשים סבורים כי יש לנהל את הדיון המאוחד בבית המשפט לענינים מינהליים בירושלים, ואילו מרבית המשיבות התנגדו לכך שהדיון יאוחד בירושלים ועתרו לאיחוד הדיון בבית המשפט לענינים מינהליים מרכז-לוד או בבית המשפט לענינים מינהליים בתל-אביב-יפו, כל אחת לפי עמדתה שלה.

לאחר שעיינתי בעמדותיהם של בעלי הדין הגעתי לכלל מסקנה כי יש לאחד את הדיון בבית המשפט לענינים מינהליים בתל-אביב-יפו. אשר על כן, הנני מורה על העברת הדיון בת"צ 57334-01-14 (מחוזי – ירושלים) ות"צ 4192-02-14 (מחוזי – מרכז-לוד) לבית המשפט המחוזי בתל-אביב-יפו, ועל איחוד הדיון שם עם ת"צ 57007-01-14 (מחוזי – תל-אביב-יפו). אין צו להוצאות.
