המבקש הגיש בקשה להארכת מועד להגשת ערעור על פסק-דין של בית המשפט המחוזי מיום 11.1.2010, בנימוקים הנוגעים בין היתר להיקף ההליך ולשינוי בייצוגו של המבקש. הבקשה הוגשה ביום 28.2.2010. יצוין כי הצדדים חלוקים לגבי מועד המצאת פסק-דינו של בית המשפט המחוזי לבא-כוח המבקש, אולם למקרא תגובות המשיבים ויתר המסמכים שבתיק, איני יכול לקבוע כי פסק-הדין הומצא למבקש עובר לתאריך שנטען על-ידו והרשום על העותק שנשלח לבא-כוחו הקודם בפקסימיליה (24.1.2010). יצוין כי גם לפי טענת המשיבים באשר למועד המצאת פסק-הדין למבקש (12.1.2010) – טענה המבוססת על בירור שערכו לדבריהם עם מרכז המידע – הבקשה שלפניי הוגשה בתוך המועד (ספירת 45 ימים בהתאם להוראות סעיף 10 לחוק הפרשנות, התשמ"א-1981). על כן, אין לומר כי התגבש אצל המשיבים אינטרס הסתמכות בעל משקל.
לכך מתווספת העובדה שביום 18.2.2010 ניתנה החלטת בית המשפט המחוזי שאישרה תיקון טעויות סופר בפסק-הדין. סעיף 81(ג) לחוק בתי המשפט [נוסח משולב], התשמ"ד-1984 קובע: "תוקנו פסק דין או החלטה אחרת כאמור בסעיף קטן (א) יראו, לענין ערעור, את מועד החלטת התיקון כמועד מתן פסק הדין או ההחלטה
האחרת". אכן, המשיבים טוענים ובצדק כי התיקונים שבוצעו בפסק-הדין הם טכניים בלבד והיו מוסכמים. השאלה אם יש להגביל את תחולתו של סעיף 81(ג) כך שיחול על תיקונים מסוימים ולא יחול על תיקונים אחרים – הגבלה שאינה מופיעה בלשון הסעיף – הועלתה בבית משפט זה אך נראה כי לא ניתנה בה הכרעה (ראו ע"א 4395/06 עמותת

איני רואה צורך לקבוע מסמרות בעניין זה שכן בנסיבות העניין, לאור המועד שבו
הוגשה הבקשה להארכת מועד ויתר הנסיבות, סבורני כי יש לאפשר את הגשת הערעור
עד לתאריך 4.4.2010, כמבוקש על-ידי המבקש בהודעתו מיום 3.3.2010. בנסיבות העניין
אין צו להוצאות.
