החלטה

דרך המלך להורות על איחוד הדיון בהליכים המתנהלים לפי פקודת פשיטת הרגל [נוסח חדש], התש"ם-1980 (להלן – פקודת פשיטת הרגל ), אינה לפי תקנה 7 לתקנות סדר הדין האזרחי, התשמ"ד-1984 (להלן – תקנות סדר הדין ), אלא בהתאם להסדרים המיוחדים שנקבעו בעניין זה בפקודת פשיטת הרגל ובתקנות שהותקנו מכוחה (ראו סעיפים 175 ו-186(4) לפקודת פשיטת הרגל ותקנה 144 לתקנות פשיטת הרגל, התשמ"ה-1985; להסבר מפורט ראו, בש"א 5176/13 ביטון נ ' כונס הנכסים הרשמי – ת"א (2.8.2013); בש"א 8430/13 סמבטיון נדל"ן בע"מ נ ' גהן (17.12.2013)).

משכך, היה מקום, לכאורה, למחוק את הבקשה דנא ולהפנות את בעלי הדין למסלול הדיוני המיוחד הקבוע לעניין העברה ואיחוד הדיון בהליכי פשיטת רגל. עם זאת, מאחר שבית המשפט המחוזי בתל-אביב-יפו (כבוד השופט א' אורנשטיין ) הוא שהפנה במקרה דנא את המבקש להגיש בקשה לפי תקנה 7 לתקנות סדר הדין, במסגרת החלטתו מיום 6.1.2014, הנני נעתר לבקשה, על מנת לחסוך זמן שיפוטי. יצוין, כי בא-כוח המשיבים עתר בפני בית המשפט המחוזי להעברת הדיון. היינו, הבקשה שלפניי הינה במהותה מוסכמת.

הנני קובע, על כן, כי הדיון בפש"ר 32114-08-13 (מחוזי – תל-אביב-יפו) יועבר לבית המשפט המחוזי מרכז-לוד, ויאוחד שם עם הדיון בפש"ר 24921-08-13 (מחוזי – מרכז-לוד).
