החלטה
לפניי בקשה להארכת מועד להגשת בקשת רשות ערעור על פסק-דין של בית המשפט המחוזי בירושלים (כבוד השופטת מ' מזרחי). פסק-הדין ניתן ביום 16.3.2010 אך הומצא למבקשת ביום 27.4.2010. בפסק-הדין נדחה ערעורה של המבקשת על פסק-דין של בית משפט השלום, בעניין זכותו של תלמיד ישיבה שפעלה ביישוב מפונה למענקים לפי חוק יישום תכנית ההתנתקות, התשס"ה-2005.
ייאמר מיד כי הבקשה הוגשה בתוך המועד הקבוע בדין להגשת ההליך, ובכך יש כדי להשליך על אינטרס ההסתמכות של הצד שכנגד על סופיותו של פסק-הדין. מעבר לכך, עמדה המבקשת על מורכבות הסוגיות המתעוררות בתיק, לשיטתה, ועל הצורך לערוך התייעצויות עם הגורמים הרלבנטיים בטרם תגבש את עמדתה. עם זאת, יש לציין כי נימוקי הבקשה מנוסחים בכלליות ולא הובהר, למשל, מדוע נדרשות התייעצויות החורגות מן המועד הקבוע בדין, לצורך הגשת בקשת רשות ערעור ב"גלגול שלישי" .
במכלול הנסיבות, משהוגשה הבקשה להארכת מועד בתוך המועד הקבוע בדין, ובהתחשב בתגובת המשיב, סבורני כי יש להאריך את המועד להגשת בקשת רשות הערעור עד לתאריך 13.6.2010, ולא עד לתאריך 27.6.2010, כמבוקש. ככל שאכן יוגש ההליך, תצרף לו המבקשת את החלטתי-זו, והמזכירות תתייק את ההחלטה בתיק בית המשפט. כמו-כן, תציין המבקשת בפתח בקשת רשות הערעור כי ניתנה הארכת מועד לפי החלטתי.
החלטה זו תועבר לצדדים, ללא דיחוי, באמצעות הפקסימיליה.
