בקשה להארכת מועד
החלטה
לפניי בקשה להארכת מועד להגשת ערעור על פסק-דין של בית המשפט המחוזי בירושלים מיום 27.1.2012. עניינו של פסק-הדין בסכומי הפיצוי המגיעים למבקשים (ולמשיבה 3) בעקבות קבלת תביעתם הנזיקית בעילה של "הולדה בעוולה".
לאחר עיון בבקשה ובתגובה החלטתי להיעתר לבקשה נוכח משקלם המצטבר של שיקולים אחדים:
ראשית , המבקשים מסבירים כי הצורך בהגשת ערעור מטעמם התחוור לאחר פסק-הדין של בית המשפט העליון בע"א 1326/07 המר נ' עמית (טרם פורסם, 28.5.2012), שבו הותוותה הלכה חדשה בסוגיה של "הולדה בעוולה" ו"חיים בעוולה". הלכה חדשה זו עשויה להצריך, כך נטען, תיקונים שונים בפסק-הדין, וקיים חשש כי אם לא יתאפשר למבקשים להגיש ערעור אזי ייווצר מצב של "נפילה בין הכיסאות". אין ספק כי שינוי הלכה אינו מהווה עילה אוטומטית למתן ארכה, אולם בנסיבות מסוימות עשוי הדבר להיחשב "טעם מיוחד" (ראו למשל אורי גורן סוגיות בסדר דין אזרחי 772 (מהדורה עשירית, 2009)).
שנית , בפני בית משפט זה תלוי ועומד ערעור שהגישו המשיבים על פסק הדין של בית המשפט המחוזי (ע"א 2124/12). הליך אחרון זה מצוי עדיין בשלבים המקדמיים וטרם הוגשו בו סיכומים. משמעות הדבר היא שפסק-הדין של בית המשפט המחוזי אינו חלוט ועומד לבחינת בית משפט זה. הדבר משפיע כמובן גם על משקלו של אינטרס ההסתמכות.
שלישית , המשיבים הביעו התנגדות למתן ארכה להגשת ערעור על החלטות בית המשפט המחוזי "למעט כל סוגייה הנובעת ישירות מקביעות פסק הדין שניתן [בעניין המר ]". איני סבור כי יש מקום לאבחן עתה בין סוגיות הנובעות מפסק-הדין המר לסוגיות שאינן נובעות מפסק-הדין, ומשהובא התיק לפני ערכאת הערעור דומה כי יש לאפשר פריסת המחלוקת כולה.
לאור הצטברות השיקולים שלעיל, ראיתי לנכון להיעתר לבקשה ולאפשר את הגשת הערעור. הערעור יוגש עד ליום 8.7.2012 , ולאחר השלמת הליכי הרישום תינתנה הוראות מתאימות, בשים לב לקשר שבין ההליך שיוגש לבין ע"א 2124/12. המערערים יציינו בפתח הערעור שיוגש את דבר הארכה, ויצרפו עותק של החלטתי-זו כנספח. בנסיבות העניין – אין צו להוצאות.
