בקשה להארכת מועד להגשת ערעור

לפני בקשה להארכת מועד להגשת ערעור על פסק דינו של בית המשפט המחוזי בחיפה (כב' השופט ש' ברלינר) מיום 30.9.09 . הבקשה עצמה הוגשה ביום 24.11.09 , וזאת לאחר שהודעת הערעור נמחקה מהמרשם בשל איחור בהגשתה. המבקש מציין בבקשתו כי קיבל את פסק הדין ביום 4.10.09. משכך, ובשל פגרת חג הסכות אשר נסתיימה ביום 9.10.09, הוא יום שישי, הרי שמניין הימים להגשת הערעור החל ביום ראשון שלאחריו (11.10.09). במצב דברים זה, אין לטענת המבקש כל איחור בהגשת ההליך. לטענתו, גם אם אכן ישנו איחור ומניין הימים החל מיום 9.10.09, הרי שמדובר באיחור מזערי של יום לכל היותר שמקורו בטעות. משיבה 2 (להלן: המשיבה) מתנגדת לבקשה. לטענתה, פסק דינו של בית המשפט קמא הומצא לצדדים בדואר עוד ביום 1.10.09. משכך, ומשעה שפגרת הסוכות נסתיימה ביום 9.10.09 הרי שהמבקש איחר איחור לא מבוטל ואף לא סיפק "טעם מיוחד" לאיחורו כאמור. לבסוף, טוענת המשיבה כי סיכויי הערעור קלושים.

לאחר עיון בחומר שלפני, בטענות בעלי הדין, ובכלל כך גם תגובת המבקש (מיום 2.12.09), נחה דעתי כי נחה דעתי כי דין הבקשה להארכת מועד – להתקבל. פסק דינו של בית המשפט קמא ניתן ביום 30.9.09, הוא יום רביעי. על פי תצהירו של המבקש, הרי שפסק הדין הומצא כדין למשרדו ביום ראשון שלאחר מכן (4.10.09). מועד המצאה זה, הוא יום ראשון, נופל במסגרת תקופת פגרת הסוכות שחלה מיום י"ד בתשרי ועד יום כ"א בתשרי (תקנה 1(1) לתקנות בתי המשפט וההוצאה לפועל (פגרות), התשמ"ג-1983). על פי לוח השנה העברי, נסתיימה פגרת סוכות השנה ביום שישי (9.10.09). משכך, המועד למניין הימים החל הוא לכאורה ביום שבת שלאחריו, הוא על פי לוח השנה העברי כ"ב בתשרי. במצב דברים זה, הרי שלכל היותר עומד איחורו של המבקש על יום אחד. זאת, מכיוון שהיום הראשון לתחילת מניין הימים חל לכאורה ביום שבת (ראו: בש"א 7839/01 עיריית תל אביב יפו נ' אלון גול ן (לא פורסם, 18.11.01)). נוכח האיחור הקל שמקורו בטעות באשר למניין הימים, אשר הייתה סבירה בנסיבות העניין, לא מצאתי מניעה להאריך את המועד כמבוקש. כמו כן, לא מצאתי ואף לא נטען לפני, כי נוצרה אצל המשיבה הסתמכות על סופיות הדיון המצדיקה דחיית הבקשה, וזאת בייחוד בשים לב לכך שפסק הדין נשוא ההליך ניתן שלא במעמד בעלי הדין. לעניין סיכוייו של הליך זה יוסף, מבלי לקבוע עמדה בדבר, כי לא מצאתי את אלו כנמוכים במידה המצדיקה דחייתה של הבקשה שלפני בייחוד נוכח כלל נסיבות המקרה המצערות.

התוצאה היא, אפוא, כי דין הבקשה להארכת מועד – להתקבל. הודעת הערעור אשר הוגשה ביום 24.11.09 תתקבל למרשם ובירור ההליך יימשך כמקובל. בנסיבות העניין, אין צו להוצאות.
