לפניי בקשה להארכת מועד להגשת בקשת רשות ערעור על החלטה של בית המשפט לעניינים מינהליים בנצרת (כב' השופטת א' הלמן) בעתירת אסיר שהגיש המבקש. בעתירה קבל המבקש, שהינו אסיר בטחוני, על כך שנמנע מגיסו לבקרו בכלא. בדחותו את העתירה התבסס בית המשפט על פקודת הנציבות הקובעת כי אין להרשות לאסירים בטחוניים לקבל ביקורים אלא של בני משפחה מדרגה ראשונה. צוין כי במקרה הנדון אחותו של המבקש מבקרת אותו אחת לחודש והמבקש לא הצביע על טעמים הומניים חריגים המצדיקים סטייה מן הנוהל. בית המשפט הוסיף וציין כי המבקש רשאי להגיש גם בעתיד בקשות ספציפיות לקבל ביקורים של מבקרים שאינם בני משפחה מדרגה ראשונה, ואלה תשקלנה על-ידי המשיבים לגופן, על רקע הנסיבות שיפורטו בהן.

החלטתו של בית המשפט לעניינים מינהליים ניתנה ביום 15.4.2007 בהעדר הצדדים. הבקשה שלפניי הוגשה ביום 22.1.2009. המבקש ציין כי קיבל את החלטת בית המשפט באיחור רב, רק ביום 24.8.2008, למרות שלאורך כל התקופה פנה למשיבים וביקש לקבל את ההחלטה. המבקש מוסיף וטוען כי אחותו היא קרובת המשפחה היחידה שלו בדרגה ראשונה. בשל מצבה הבריאותי של האחות היא אינה מבקרת אותו באופן סדיר ולכן הוא אינו זוכה לביקורים תדירים של בני משפחה. לבקשה צורף מכתב של קצינת אסירים בכלא רמון, בו היא מציינת כי בטעות שלחה את הבקשה לרשות ערעור לבית המשפט המחוזי במקום לבית המשפט העליון.

המשיבים מתנגדים לבקשה. על פי האמור בתגובה, מלשכת הייעוץ המשפטי של שירות בתי הסוהר נמסר כי הערעור נמסר לקצינת האסירים לצורך הגשתו לבית המשפט רק בסוף חודש דצמבר 2008. מכאן שגם אם תתקבל טענת המבקש כי קיבל את ההחלטה רק ביום 24.8.2008 ונראה את הבקשה כאילו הוגשה בדצמבר 2008, עדיין מדובר בפרק זמן החורג במידה ניכרת מ- 15 הימים הנתונים להגשת בקשת רשות ערעור. המשיבים מוסיפים וטוענים כי משחלף פרק זמן כה אורך מעת שניתן פסק הדין ובמידה ועדיין ברצונו של המבקש להביא את עניינו בפני בית המשפט, הרי שהדרך המתאימה לכך היא הגשת עתירת אסיר חדשה. לבסוף, טוענים המשיבים כי סיכויי הבקשה לרשות ערעור להתקבל הינם נמוכים.

המועד להגשת בקשת רשות לערער על החלטה של בית המשפט המחוזי בעתירת אסיר הינו חמישה עשר ימים (תקנה 7(א) לתקנות סדרי דין (עתירות אסירים), תש"ם – 1980). עם זאת, לרשם בית המשפט נתונה הסמכות להאריך את המועד להגשת ההליך, מכוח הסמכות הכללית הקבועה בסעיף 90(3) לחוק בתי המשפט (נוסח משולב) תשמ"ד-1984 (ראו, בשג"ץ 4232/91 היועץ המשפטי לממשלה נ' אברהים אחמד (לא פורסם, 11.10.1991)). סמכות כללית זו אינה מותנית בקיומו של טעם מיוחד כנדרש בהליכים אזרחיים לגבי מועד הקבוע בחיקוק ודי בקיומו של טעם סביר שיהא בו כדי להצדיק את האיחור. יחד עם זאת, מתן אורכה אינו נעשה כדבר שבשגרה. הכלל הוא כי בעתירות אסירים, כמו גם בהליכים פליליים, יש לקיים את המועדים הקבועים בחוק, בעוד שהארכת מועד הינה היוצא מן הכלל (השוו, בש"פ 5988/06
נגר נ' מדינת ישראל (לא פורסם, 25.7.2006). הדבר נעוץ בהכרח להתחשב בעקרון סופיות הדיון; בצורך בהצבת גבול להימשכות ההליכים; באינטרס של הצד שכנגד ושל הציבור בכללותו לחיזוק היציבות והוודאות המשפטית; ונוכח הקשיים הכרוכים בניהול דיון בערעור שהוגש באיחור. בהקשר זה יש לזכור כי ככל שמשך האיחור ארוך יותר, כן יגבר משקלם של הנימוקים האחרים הנוטים לדחיית הבקשה.

במקרה שלפני הבקשה להארכת מועד הוגשה שנה ותשעה חודשים לאחר מתן ההחלטה בבית המשפט המחוזי. אף אם אניח, לצורך הדיון לפניי, כי ההחלטה הומצאה למבקש אך ביום 24.8.2008, עדיין חלפו חודשים ארוכים עד שפנה לבית המשפט. מכאן שהבקשה הוגשה באיחור משמעותי לאחר המועד הקבוע בדין. אין בנטען בבקשה כדי להצדיק את האיחור המ מוש ך. המבקש אינו מציג שום הסבר לכך שלא הגיש את ההליך מיד כשקיבל לידיו את ההחלטה או בתוך חמישה-עשר ימים לכל המאוחר. נמצא כי הבקשה אינה כוללת טעם כלשהו, לא כל שכן טעם סביר או ממשי, שעשוי להצדיק את האיחור המ מוש ך בהגשת ההליך. במצב דברים זה, בו מדובר מדובר באיחור מ מוש ך שלא ניתן לו טעם סביר, אין הצדקה להיענות לבקשה להארכת מועד.
הבקשה נדחית.
