החלטה

בפניי בקשה להארכת מועד להגשת בקשת רשות ערעור על החלטת בית המשפט לעניינים מינהליים בבאר-שבע (השופט י' פרסקי) בה נדחתה עתירתו של המבקש כנגד החלטת המשיב שלא לאפשר לו התייחדות עם אשתו.
ההחלטה ניתנה ביום 30.10.2012, במעמד באי-כוח הצדדים, ובהתאם לתקנה 7(א) לתקנות סדרי הדין (עתירות אסירים), תש"ם-1980 היה המבקש רשאי להגיש בקשת רשות ערעור עליה בתוך חמישה עשר ימים, כלומר עד ליום 14.11.2012. הבקשה שבפניי, אליה צורפה הבקשה למתן רשות ערעור שהגשתה מתבקשת, הוגשה ביום 20.11.2012, קרי באיחור של שישה ימים.

בבקשה טוענת באת כוח המבקש כי הבקשה הוכנה על ידה במועד, אך כי בשל המצב הביטחוני אשר שרר במועד הרלבנטי בדרום מזכירתה לא הגיעה כשבוע ימים למשרד, הממוקם באשקלון, ועל כן הבקשה לא הוגשה באמצעות שליח כמתוכנן אלא נשלחה בדואר באיחור.
המשיב מתנגד לבקשה. לטענתו טענת המבקש לפיה האיחור נבע מן המצב הבטחוני לא נתמכה במסמך כלשהו ואינה נותנת מענה לשאלה מדוע בחלוף האירועים היא לא הוגשה באמצעות שליח אלא בדואר. כן טוען המשיב כי סיכויי ההליך אינם גבוהים.

לאחר שעיינתי בטענות הצדדים ובחומר שבפניי החלטתי להיעתר לבקשה למתן ארכה.
אכן, מן הראוי היה שהטעם שהעלה המבקש לאיחור בהגשת ההליך היה מועלה על ידו באופן מפורט יותר וכי היה תומך אותו בתצהיר. יחד עם זאת, מבצע "עמוד ענן" אכן החל ביום 14.11.2012 וארך שמונה ימים, עד ליום 21.11.2012. כמו כן, כידוע בהליכים כגון דא יש לבחון קיומו של "נימוק סביר" לאיחור בהגשת ההליך, ובהקשר זה יש ליתן משקל הולם, בין היתר, לאופי ההליך ולסעד המבוקש (ראו בשג"ץ 8931/11 צאפאנא נ' מדינת ישראל (טרם פורסם, 11.1.2012)). בנסיבות המקרה הקונקרטי דומני כי העובדה שהמבקש שוהה בבית האסורים; הסעד המבוקש על ידו; משך האיחור שאינו מ מוש ך מאוד; כמו גם העובדה שעתירת המבקש נדחתה על בסיס מידע מודיעיני שהוצג בפני בית המשפט קמא במעמד צד אחד וזה אינו בפניי - כך שאין באפשרותי להעריך את סיכויי ההליך לגופו (ראו בשג"ץ 1616/10 יצחק נ' שירות בתי הסוהר (טרם פורסם, 17.3.2012)) - מצדיקים שלא לחסום את דרכו של המבקש לבירור טענותיו בבית משפט זה. המועד להגשת הבקשה למתן רשות ערעור מוארך , אפוא, עד למועד הגשתה בפועל.
המזכירות תעביר את ההחלטה לידי הצדדים באמצעות הפקסימיליה, ותפתח תיק רע"ב בו תתויקנה בקשת רשות הערעור שצורפה לבקשה להארכת מועד והחלטתי זו.
