החלטה
בפניי בקשה לעיון חוזר בהחלטתי מיום 25.2.2014 בה דחיתי את בקשתם של המבקשים להארכת מועד להגשת עתירה לדיון נוסף בפסק דינו של בית משפט זה בעע"מ 6526/12.
איני מוצאת להיעתר לבקשה.
העובדה שבא-כוח המבקשים נטל על עצמו את ייצוגם רק ביום 3.3.2014 אין בה כדי ליתן מענה לאמור בהחלטתי הנזכרת. זאת שכן, וכפי שצוין בהחלטה, בקשת הארכה הוגשה לאחר חלוף המועד להגשת העתירה, ולכך לא ניתן הסבר מספק.
העובדה המצוינת כעת ולפיה עורך הדין שטנגר (אשר פסק הדין נשלח אליו באמצעות הפקסימיליה ביום 6.2.2014) התפטר מייצוגה של המבקשת 2 במועד המוקדם למן המועד שעלה מן הבקשה במתכונתה המקורית אך מחזקת את המסקנה כי אין מדובר בטעם המצדיק מתן ארכה, שכן לא הובהר מה מנע מן המבקשים עצמם להגיש בקשת ארכה (עד למציאת עורך דין) מיד לאחר התפטרותו מייצוג (ודומה כי בטענה זו אף יש כדי ללמד כי נודע למבקשים על פסק הדין סמוך לאחר הינתנו). עוד יוזכר כי המבקש 1 ממילא ייצג עצמו גם בהליך הערעור. כמו כן הטענה לפיה חרף האישור הרפואי שהוצג המבקש 1 החל לחוש ברע עוד קודם לכן (שלושה ימים לפני חלוף המועד לגשת ההליך) נטענה בעלמא, ובוודאי לא הוכח כי מצבו לא אפשר לו להגיש ולו בקשת ארכה לקונית.
עוד יצוין כי בארכה שניתנה למבקשים בהליך אחר אין כדי ללמד לעניינו שכן אין דומה מתן ארכה להגשת כתב בי-דין במסגרת הליך קיים למתן ארכה להגשתו של הליך עצמאי (הדורשת הוכחתם של "טעמים מיוחדים"). ולבסוף, קביעתי לעניין סיכויי ההליך עומדת בעינה.
אשר על כן, הבקשה נדחית.
