לפניי בקשה להארכת מועד להגשת ערעור על החלטה של בית משפט השלום בירושלים (כבוד סגנית הנשיאה מאק-קלמנוביץ), מיום 23.1.2013, שבה נדחתה בקשתו של המבקש ל"פסלות על תנאי".
דין הבקשה להידחות.
פרק הזמן הקצוב בדין להגשת ערעור פסלות קצר ביותר, ולא בכדי. "במועדים אלו – הקצרים מן המקובל לערעור או לרשות ערעור בעניינים אחרים – ניתן ביטוי לחשיבותו של הליך הפסלות כיורד לשורש ההליך, וכן לחשיבות ההכרעה המהירה בו שתסיר כל עננה באשר לאובייקטיביות השיפוטית" (יגאל מרזל, דיני פסלות שופט 338 (2006)). בהליכים פליליים, פרק הזמן הקבוע בדין להגשת ערעור פסלות קצר במיוחד ועומד על חמישה ימים (סעיף 147(ב) לחוק סדר הדין הפלילי [נוסח משולב], התשמ"ב-1982).
ההחלטה נשוא הבקשה שלפניי ניתנה כאמור ביום 23.1.2013, בנוכחות המבקש. משכך, המועד הקבוע בדין להגשת הערעור חלף ביום 28.1.2013, ואילו הבקשה שלפניי הוגשה – יחד עם הודעת הערעור – רק ביום 10.2.2013, קרי באיחור ניכר. הסברו של המבקש לאיחור הוא מחלת שפעת שממנה התאושש "רק לפני כיומיים שלושה". המבקש לא צירף לבקשה המקורית אישור בדבר מחלתו, ולא טען כי נבדק על ידי רופא מאז מועד החלטת בית המשפט קמא ועד למועד הגשת הבקשה. עם זאת, הוא כתב בבקשתו כי יפגוש רופא
"מחר ה-10/2/13". ביום 12.2.2013 צירף המבקש מכתב, שממנו עולה כי פגש רופאת משפחה ביום 11.2.2013. במכתב נרשם אך ורק כי "המטופל היה חולה לדבריו בתאריך 07.02.2013-23.01.2013".
ובכן, ברור הדבר כי מכתב זה, שלפיו המבקש היה חולה ("לדבריו") החל ממועד הדיון בבית המשפט המחוזי (דיון שבו היה נוכח) ועד ליום 7.2.2013, אינו מקים "טעם מיוחד" למתן ארכה. לא הוכח כלל ועיקר כי המבקש לא יכול היה לתפקד במועד הרלוונטי להגשת ערעור, וודאי שלא הוכח כי לא יכול היה להגיש, למצער, בקשת ארכה מבעוד מועד. בשולי הדברים אציין כי בד-בבד עם טענתו כי התאושש ממחלת השפעת "לפני כיומיים שלושה", הגיש המבקש ערעור המשתרע על 34 עמודים.
לאור האמור, דין הבקשה להידחות, ואין זה המקום להוסיף דברים על הטכניקה המשפטית של הגשת "בקשת פסלות על תנאי".
סוף דבר: הבקשה נדחית.
