החלטה

העורר, ולדימיר אברמוב, עומד לדין בבית-המשפט המחוזי בבאר-שבע באשמה של סחר בבני אדם לעיסוק בזנות, סרסרות למעשה זנות, הבאת אדם לידי עיסוק בזנות, החזקת מקום לשם זנות, קשירת קשר לביצוע פשע, הדחה בחקירה, הפרעה לעובד ציבור במילוי תפקידו, מעשה פזיזות ורשלנות בנהיגה ומתן סעד למסתנן – עבירות לפי חוק העונשין, התשל"ז-1977 ולפי החוק למניעת הסתננות (עבירות ושיפוט), התשי"ד-1954. על-פי המיוחס לו בשני פרטיו הראשונים של כתב האישום, העסיק העורר במרוצת השנתיים האחרונות ארבע נשים במתן שירותי זנות, בין היתר בדירות ששכר לצורך כך בעיר אשדוד, והתקיים מרווחיהן. אישום שלישי מדבר בקשר, שקשר העורר עם אנשים נוספים, לסחור בנשים לצורך זנות, במסגרתו הובאו לישראל נשים ש"נרכשו" בחבר המדינות. נשים אלו הוברחו ארצה דרך גבול מצרים, אך מימושו של הקשר סוכל לאחר שהעורר ושותפו לקשר, יחד עם אותן נשים, נעצרו – לאחר ניסיון הימלטות כושל – בידי כוחות הביטחון בשטח ישראל. בעקבות מעצרם ניסה העורר, על-פי הנטען, לדבר על לב הנשים המוברחות לבל יפלילוהו בחקירתן.

החלטתו של בית-המשפט המחוזי לעצור את העורר עד תום ההליכים נגדו נשענה על המסקנה, כי קיימות ראיות לכאורה לחובתו, והכוונה היא בפרט לדברים שאמר העורר למדובב משטרתי במהלך שהותו במעצר. המדובב מסר, באמרה שהוגשה לבית-המשפט, כי לא זו בלבד שהעורר גילה בקיאות כללית בפרטי העיסוק בסחר בנשים והברחתן דרך גבול מצרים, אלא אף קשר עצמו ישירות למעשים המ דובר ים. בית-המשפט לא ראה מקום לפקפק בשלב זה במהימנות האמרה, ודחה את גרסת העורר כי כל שעשה היה הסעתם של פועלים סינים שתרו אחר עבודה בישראל. על מסוכנותו של העורר למד בית-המשפט מהיותו לכאורה חלק מרשת של סוחרי נשים, כשעל רקע זה הוא נעצר כבר בעבר. את הצורך להחזיקו במעצר פן ישובשו מאמצי החקירה, הסיקה ערכאה קמא מניסיונו המוזכר לעיל של העורר להדיח את המתלוננות בחקירה, כמו גם מן הניסיון הכושל להימלט מהחיילים שביקשו לעוצרו.

בד בבד, מתח בית-המשפט המחוזי ביקורת על כך שהקלטות, המתעדות את הדברים שנמסרו למדובב, לא הוצגו בפניו ועל כן נקבע כי לעורר עומדת זכותו לעתור לעיון מחדש בהחלטת המעצר, ככל שיתברר כי חומר ההקלטה המלא אינו מתיישב עם אמרת המדובב כפי שהוצגה לבית-המשפט. בהמשך התברר, כי הקלטות פגומות במידה המקשה על פענוח הנאמר בהן, וכל שנותר אפוא הוא אמרת המדובב שהוצגה לבית-המשפט. חרף זאת, דחה בית-המשפט המחוזי בקשה לעיון מחדש בהחלטתו, לאחר שמצא כי אין בדבר זה כדי לגרוע מחומר הראיות שלחובת העורר.

בערר שבפני שב העורר וטוען כי אין עילה להותירו במעצר, והוא מכחיש את כל המיוחס לו. לטענתו, אמרת המדובב – שקיבל טובת הנאה עבור שירותיו – אינה מהימנה. יתר הפרטים, מהם הוסקה כאמור מסוכנותו והחשש מפני שיבוש ההליכים, מוכחשים אף הם.

לאחר שעיינתי בחומר שהונח בפני והאזנתי לטיעוני הצדדים על-פה, הגעתי למסקנה כי אין מקום להתערב בהחלטתו של בית-המשפט המחוזי. בשלב זה, בו עומדת על הפרק שאלת מעצרו של העורר, להבדיל מקביעת אשמתו או חפותו, די למשיבה בכך שהצביעה על ראיות לכאורה הקושרות אותו למיוחס לו. אמרתו של המדובב, מחד, המקום והנסיבות בהם נתפס העורר, מאידך, מצטרפים יחד לאותו מארג ראיות בו ניתן להסתפק בשלב זה. אלו, לצד מסקנותיו של בית-המשפט המחוזי באשר לסכנה הנשקפת מן העורר, עליהן סומך אני את ידי, שוללות את אפשרות שחרורו של העורר, ולו לחלופת מעצר.
