החלטה
בפניי שתי עתירות להסרת חיסיון לפי סעיף 44 לפקודת הראיות [נוסח חדש], תשל"א- 1971 (להלן: פקודת הראיות ). מדובר בשתי עתירות שעניינן דומה, ועל כן נדונו יחדיו, הגם שכל אחת עומדת על רגליה שלה.
כנגד העותר בבש"פ 1361/09 הוגש ל בית המשפט המחוזי בבאר-שבע כתב אישום (תפ"ח 1076/07) המייחס לו מספר רב של עבירות חמורות: עבירות של מגע עם סוכן חוץ, לפי סעיף 114(א) לחוק העונשין, התשל"ז-1977 (להלן: חוק העונשין ); אימונים צבאיים אסורים, לפי סעיף 143(א) לחוק העונשין; נשיאת נשק, לפי סעיף 144(ב) לחוק העונשין; נשיאת תחמושת, לפי סעיף 144(א) לחוק העונשין; חברות בארגון טרוריסטי, לפי סעיף 3 לפקודת מניעת טרור, התש"ח-1948 (להלן: פקודת מניעת טרור ); פעילות בארגון טרוריסטי, לפי סעיף 2 לפקודת מניעת טרור; קשירת קשר לפשע, לפי סעיף 499(א)(1) לחוק העונשין; ניסיון לרצח, לפי סעיף 305(1) לחוק העונשין; ניהול בהתאחדות בלתי מותרת, לפי תקנה 85(1)(ב) לתקנות ההגנה (שעת חרום), 1945 (להלן: תקנות ההגנה לשעת חרום ); ומתן שרות להתאחדות בלתי מותרת, לפי תקנה 85(1)(ג) לתקנות ההגנה לשעת חרום.
לפי הנטען בכתב האישום הכולל עשרה אישומים, העותר הצטרף לארגון החזית הדמוקרטית ולאחר מכן לארגון גדודי חללי אל-אקצא, ופעל במסגרת ארגונים אלו בניסיון לפגוע באזרחים ישראלים ובחיילי צה"ל.
כנגד העותר בבש"פ 2916/09 הוגש ל בית המשפט המחוזי בבאר-שבע כתב אישום (תפ"ח 1169/08) המייחס לו עבירות של מגע עם סוכן חוץ, לפי סעיף 114(א) לחוק העונשין, התשל"ז-1977 (להלן: חוק העונשין ); חברות ופעילות בהתאחדות בלתי מותרת, לפי תקנה 85(1)(א) לתקנות ההגנה (שעת חרום), 1945 (להלן: תקנות ההגנה לשעת חרום ); נשיאת משרה בהתאחדות בלתי מותרת, לפי סעיף 85(1)(ב) לתקנות ההגנה לשעת חרום; החזקת נשק ותחמושת, לפי סעיף 144(א) לחוק העונשין; הובלת נשק ותחמושת, לפי סעיף 144(ב) לחוק העונשין; עסקה בנשק, לפי סעיף 144(ב2) לחוק העונשין; וקשירת קשר לביצוע פשע, לפי סעיף 499(א)(1) לחוק העונשין.
לפי הנטען בכתב האישום הכולל חמישה אישומים, העותר הצטרף לארגון גדודי חללי אלאקצא, ופעל במסגרתו בניסיון לפגוע בחיילי צה"ל. במסגרת פעולתו הקים חוליה שתפעל עמו במסגרת הארגון ולאחר מכן היה חבר במועצה צבאית השייכת לארגון.
במסגרת משפטיהם של השניים הציגה המשיבה תעודות בדבר ראיות חסויות אשר נחתמה על ידי שר הביטחון בתוקף סמכותו לפי סעיף 44(א) לפקודת הראיות. תעודות זו הינן נושא ההליכים שבפניי, ועל פיהן הוטל חסיון על מסירת ראיות מטעמים של בטחון המדינה, בנושאים הבאים:
א.
מקורות מידע של שירות הביטחון הכללי, לרבות כל פרט ו/או תוכן המידע שיש בו כדי לחשפם;
ב.
שיטות ודרכי פעולה, פעילות מבצעית, נהלי עבודה, ודרכי השגת מידע של שירות הביטחון הכללי, ככל שהם מתייחסים לאיסוף מידע מחוץ ובמסגרת החקירה, לרבות תוכן מידע העלול להביא לחשיפת שיטות ונהלים אלה; וכן אמצעים טכניים של שירות הביטחון הכללי להשגת חומר מודיעיני וחומר חקירה, לרבות החומר אשר נאסף באמצעים אלה;
ג.
תפקידים, שמות ומשימות של עובדי שירות הביטחון הכללי, לרבות כל פרט אחר שיש בו כדי לגלות או לחשוף את זהותם;
ד.
רשימות החומר והמידע החוסים תחת התעודות, לרבות כל פרט מזהה לגביהם ו/או אשר יש בו כדי להעיד על מהותו, היקפו וכמותו של החומר החסוי ולמעט העובדה כי מ דובר במידע מודיעיני וחומר חקירה חסוי.
התעודות מסויגות בכך שהחיסיון אינו חל על מידע מחקירותיהם של העותרים וחקירותיהם של עדי התביעה, המגלם פוטנציאל לטענת פסול.
בא כוחם של העותרים טוען בעתירות כי יחד עם תעודות החסיון לא הוצגה כל פרפראזה של החומר החסוי, וכי היה על המשיבה להציג רשימות של החומר החוסה תחת תעודת החסיון. עוד נטען כי במסגרת משפט זוטא, מתכוונים העותרים לטעון כנגד אמצעי חקירתם, הכוללים אמצעי חקירה של "תא מדובבים", בו הופעלו כנגדם לחצים רבים אשר הביאום להודות בעבירות אשר לא היו ולא נבראו. ברם, ללא חשיפת חומר החקירה הרלוונטי לא יוכלו העותרים לטעון כנגד קבילותן ומשקלן של אמרותיהם. עוד מוסיף בא כוח העותרים ומציין כי אינטרס עשיית הצדק בהקשר זה גובר על סודיות שיטת החקירה בייחוד לאור העובדה כי שיטת החקירה שהופעלה על ידי המדובבים אינה סודית ופורסמה בעבר באמצעי תקשורת שונים. על כן מבקש בא כוח העותרים להורות על העברת רשימות חומר החקירה וכן כל חומר חקירה הנוגע לחקירתם של העותרים, דרך הסרת החסיון מחומרים אלו. לבסוף מתבקש בית משפט זה להתיר לבא כוח העותרים לחקור את המדובבים עצמם בדרך שתיקבע.
באת כוח המשיבה טוענת בתגובתה הגלויה כי לא ניתן לפרט מעבר לאמור עד כה בענין זה מבלי לפגוע באינטרסים ביטחוניים מהותיים. לגופה של הבקשה מציינת באת כוח המשיבה כי אין בחומר החסוי חומר חיוני להגנתם של העותרים, ומדגישה כי כפי שמצויין בתעודות החיסיון, החסיון אינו חל על פעולות בחקירה אשר יש בהן כדי לפגום ברצון החופשי של העותרים במתן הודאותיהם. טעמים נוספים הוספו בדיון שנערך בדלתיים סגורות.
לאחר ששמעתי את טענותיהם של באי כוח הצדדים, ואת הדברים שנמסרו בדלתיים סגורות מפי נציגי המשיבה, ולאחר שעיינתי היטב בחומר החסוי, הגעתי לכלל מסקנה כי דין העתירות להדחות. אבהיר כי למסקנה זאת הגעתי לאחר שבחנתי בזהירות הנדרשת האם קיימת הצדקה להטלת החסיון, ובפרט האם החומר החסוי עשוי בדרך כלשהי להועיל לעותרים בהגנתם (ראו, למשל, בש"פ 8456/01 דלאשה נ' מדינת ישראל (לא פורסם, 14.11.2001). מהסבריהם של נציגי המשיבה ומעיון בחומר עצמו השתכנעתי כי כל מסירה של מידע החוסה תחת תעודות החיסיון יש בו משום פגיעה בביטחון המדינה, ומנגד אין באי חשיפת המידע משום פגיעה בזכותם של העותרים למשפט הוגן.
אשר על כן, שתי העתירות נדחות.
