לפניי שתי בקשות רשות ערר אשר החלטתי לדון בהן במשותף. האחת היא בקשת ערר על החלטת בית המשפט המחוזי בירושלים (כבוד השופט כ' מוסק) בתיק עמ"י 23373-01-13 מיום 29.1.2013, בגדרה נדחה ערר המבקש על החלטת בית משפט השלום בירושלים (כבוד השופטת ת' בן-אשר צבן ) מיום 3.1.2013 (להלן: המבקש 1). השנייה היא בקשת ערר על החלטת בית המשפט המחוזי בירושלים (כבוד השופט כ' מוסק) בתיק עמ"י 33751-01-13 מיום 29.1.2013, בגדרה נדחה ערר המבקשים על החלטת בית משפט השלום בירושלים (כבוד השופט י' מינטקביץ' ) מיום 15.3.2013 (להלן: המבקש 2 והמבקש 3). בשתי הפרשות הורה בית המשפט קמא על שחרור המבקשים בתנאים הנוגעים להרחקתם מאתרים בהם מתבצעות עבודות על ידי רשות העתיקות.

ביום 2.1.2013 נעצר המבקש 1 ועוכבו לחקירה המבקשים 2 ו-3 בחשד לביצוע עבירה של פגיעה באתר עתיקות או בעתיקות ועבירה של פעולות אסורות באתר עתיקות. זאת, נוכח החשד שהמבקשים – כאשר תפקדו לטענתם כנציגים של עמותת "אתרא קדישא" – הורו לקבלן לבצע עבודות בלא סמכות ובניגוד להוראות המפקח מטעם רשות העתיקות, אשר מחזיק בסמכות בלעדית להנחות ביצוע עבודות באתר שהוכרז אתר עתיקות (בהתאם לסעיף 29 לחוק העתיקות, התשל"ח-1978 (להלן: חוק העתיקות )). המשיבה ביקשה לשחרר בערובה את המבקשים בכפוף לתנאים.

בית משפט השלום בירושלים שדן בתיקים נעתר לבקשה לשחרר את המבקשים בתנאים, לפיהם נאסר על המבקשים להתקרב לאתר הבנייה ברחוב מירסקי בשכונת רמות ד' בירושלים, שלפי הנטען הוכרז כאתר עתיקות, ואשר בו בוצעו לכאורה העבירות המיוחסות למבקשים. כמו כן, נאסר על המבקשים להתקרב, במרחק של 500 מ' ומטה, לכל אתר בו מתבצעות עבודות בפיקוח של רשות העתיקות או שהוכרז כאתר עתיקות בילקוט הפרסומים. הגבלות אלו יחולו על המבקש עד ליום 3.5.2013. בית משפט השלום קבע כי על פי הראיות שהוצגו בפניו קיים חשד סביר לביצוע העבירות המיוחסות על ידי המבקשים, וכי בניגוד לטענותיהם אין לעמותת אתרא קדישא, אשר בשמה פעלו לטענתם, סמכות חוקית לפעול באתרים שהוכרזו כאתרי עתיקות (לפי סעיף 28(א) לחוק העתיקות), אלא אך סמכות להגיש התנגדות לתכניות מתאר אשר יש לה עניין ציבורי בה (צו התכנון הבנייה (קביעת גופים ציבוריים ומקצועיים לעניין סעיף 100(3) לחוק), התשנ"ג-1993 (להלן: צו התכנון והבנייה )).

על החלטה זו הגישו המבקשים עררים נפרדים לבית המשפט המחוזי בירושלים. בערר הלינו המבקשים על תנאי ההרחקה ועל אורך תקופת ההרחקה. בית המשפט המחוזי בשתי החלטות נפרדות דחה את העררים, בקובעו כי חומר הראיות שהוצג בפניו אכן מקים חשד סביר שהמבקשים ביצעו את העבירות האמורות, וכי בבקשתה לשחרר את המבקש בתנאים ערכה המשיבה איזון ראוי בין הצורך במניעת עבירות נוספות מהסוג הנידון על ידי המבקשים, לבין הצורך למנוע פגיעה בלתי מידתית בהם.

בבקשת רשות הערר שבפניי טוענים המבקשים כי לא הוכח שאתר הבנייה הנידון הוכרז כאתר עתיקות לפי חוק, וכי בעת האירוע לא ידעו המבקשים ולא יכלו לדעת שאכן מדובר באתר עתיקות אשר העבודה בו היא בסמכותה הבלעדית של רשות העתיקות. כמו כן טוענים המבקשים כי לא פגעו בעתיקות אלא ביקשו לברר האם קיים קבר באתר, מתוקף תפקידם כנציגי עמותת "אתרא קדישא". בנוסף, נטען כי בתי המשפט קמא טעו בכך שהתעלמו ממעמדה המיוחד של עמותת "אתרא קדישא" ומחובתה לוודא קיומם של אתרי קבורה לפי צו התכנון והבניה. כמו כן, טוענים המבקשים באשר לעילת המעצר, כי לא הוכח קיומו של חשש לשיבוש הליכי משפט. זאת ועוד, נטען כי המבקשים הופלו לרעה כאשר הוטלו עליהם ההגבלות האמורות, בעוד שעל אחרים, ובהם מפעיל הטרקטור שביצע את החפירה לפי הוראות המבקש והקבלן אשר לא מנע את החפירה, לא הוטלו הגבלות כאמור. לבסוף נטען כי הרחקתם של המבקשים מכל אתרי העתיקות בארץ הינה בלתי מידתית וגוררת פגיעה מהותית בזכויותיהם המעוגנות בחוק יסוד: כבוד האדם וחירותו.

המבקשים 2 ו-3 טוענים בנוסף לאמור, כי טעה בית המשפט קמא פעמיים. בפעם הראשונה, טעה כשפסק שחרור בתנאים בעניינם כאשר לא היו כלל עצורים. בפעם השנייה, טעה כשקבע תנאים מחמירים מאלו שהתבקשו על ידי המשיבה.

לאחר עיון בבקשות נחה דעתי כי דינן להידחות. מדובר בבקשות רשות לערור לערכאה שלישית. כידוע, הלכה פסוקה היא כי רשות ערעור "בגלגול שלישי" תינתן רק מקום בו מתעוררת שאלה משפטית עקרונית, ציבורית או אחרת, שההכרעה בה חורגת מעניינם של הצדדים להליך הספציפי (ר"ע 103/82 חניון חיפה בע"מ נ' מצת אור (הדר חיפה) בע"מ , פ"ד לו(3) 123 (1982); להלן: הלכת
חניון חיפה ). עקרון זה, שמקורו במשפט אזרחי, אומץ אף ביחס לבקשות רשות לערער בהליכים פליליים (ראו למשל: רע"פ 9255/10 אבו עראר נ' מדינת ישראל (3.2.11); רע"פ 4199/10 אוחיון נ' מדינת ישראל
(13.7.10)). עם זאת, בבש"פ 2786/11 ג'ריס נ' מדינת ישראל (17.4.11) עמדתי על כך שבנוגע לסמכות בית המשפט מכוח סעיף 53 חוק סדר הדין הפלילי (סמכויות אכיפה – מעצרים), תשנ"ו-1996 (להלן: חוק המעצרים ), ייתכנו מקרים חריגים בהם ראוי לגלות גמישות רבה יותר ביחס לאפשרות ליתן רשות לערור, גם כאשר הדרישות לפי הלכת חניון חיפה לא מתקיימות.

הבקשות שלפניי אינן מעוררת שאלה בעלת חשיבות משפטית אשר חורגת מעניינם של הצדדים. כמו כן, אין זה מן המקרים אשר הנסיבות בהם מצדיקות מתן הרשות לערור בפני ערכאה שלישית על אף אי התקיימותם של המבחנים הקבועים בהלכת חניון חיפה . מטעם זה בלבד מוצדקת דחיית הבקשות. טענות המבקשים כולן תחומות לנסיבות העניין הנידון וליישום ההלכות הנהוגות על עניינם.

למעלה מן הצורך אציין כי אף לגופו של עניין סבורני כי אין מקום להתערבות בהחלטותיהן של הערכאות קמא. שתי ערכאות שיפוטיות שבחנו בקפידה את חומר החקירה התרשמו כי קיימות ראיות המקימות חשד סביר שהמבקשים ביצעו את העבירות המיוחסות להם, לרבות ראיות לכך שהאתר הנידון הינו אתר עתיקות מוכרז כחוק. בנוסף, על אף טענות המבקשים באשר לכוונותיהם בדבר הגנה על העתיקות ולא פגיעה בהן, ועל אף מעמדה ואופייה הייחודיים של עמותת אתרא קדישא בכל הנוגע לשימור קברים, נראה על פניו כי צו התכנון והבנייה אינו מקנה לעמותה סמכויות פעולה כלשהן מלבד סמכות להגיש התנגדויות לתכניות מתאר שונות. מכאן שפעולות המבקשים, בניגוד להנחיות המפקח מטעם רשות העתיקות, נעשו לכאורה בלא סמכות חוקית. מכל מקום, טענות אלו תיבחנה במסגרת התיק העיקרי. כמו כן, מהחלטותיו של בית המשפט המחוזי עולה כי עילת המעצר בגינה נקבע שחרור בערובה הינה עילת המסוכנות המנויה בסעיף 13(א)(2) לחוק המעצרים, מסוכנות הנובעת מחשש סביר שהמבקשים יחזרו לבצע עבירות מהסוג הנידון. על כן, אין חשיבות לטענת המבקשים כי לא הוכח חשש לשיבוש הליכי חקירה. באשר לטענת הפגיעה בזכויות יסוד של המבקשים, הרי שלטעמי הערכאות דלמטה ערכו איזון ראוי בין מידתיות הפגיעה במבקשים לבין הצורך למנוע ביצוע עבירות נוספות מצידם.

עוד אציין, ביחס לטענותיהם של המבקשים 2 ו- 3, כי לבית המשפט יש סמכות, בהתאם לסעיף 46 לחוק המעצרים ולהלכות שנקבעו זה מכבר על ידי בית משפט זה, לשחרר בערובה כל אדם ולא עצור בלבד (בש"פ 952/00 מדינת ישראל נ' חוטר-ישי פ"ד נד(1), 638 (2000); בש"פ 5523/00 פדרמן נ' מדינת ישראל (8.8.2000)). יתר על כן, כאמור בסעיף 12 לחוק המעצרים, בית המשפט רשאי לשחרר אדם בתנאים שימצא לנכון ואין הוא מוגבל לתנאים שנתבקשו על ידי התביעה.

אשר על כן, הבקשה נדחית.
