החלטה

שני עררים של העורר על החלטות בית המשפט המחוזי תל אביב (כב' סגן הנשיאה ע' מודריק ) במ"ת 54247-11-14
מיום 10.2.2015 ומיום 12.3.2015. בהחלטה האחת נקבע, כי
על העורר להפקיד 5,000 ₪ לצורך יציאה לליל הסדר בבית משפחתו של הערב לו; ובשניה - כי על מנת לשחרר את רכבו התפוס, על העורר להפקיד 10,000 ₪ בקופת בית המשפט.
רקע והליכים קודמים

במסגרת כתב אישום (שתוקן פעמיים) הואשם העורר, יחד עם שבעה אחרים בעבירות שונות של ייצור, הפקה, החזקה וסחר בסמים מסוכנים ממשפחת הקנבואידים הסינטטיים. לפי עובדות כתב האישום, עובר ליום 7.10.2014 שילם העורר סכום של 30,000 ש"ח לנאשמים 1 ו-3, או למי מטעמם, כדי שאלה ייצרו ויספקו לו כמות לא ידועה של סמים. באותו היום החלו הנאשמים האמורים ואדם שלישי שאינו נאשם במסגרת כתב האישום בייצור הסמים. למחרת היום הובלו הסמים לביתו של העורר כשהם ארוזים בשק יוטה לבן שתכולתו שקלה כ- 10 ק"ג . באותו היום נתפסו הסמים על ידי המשטרה בעת שהעורר שהה מחוץ לביתו.
בגין אירועים אלו יוחסו לעורר שלוש עבירות: קשירת קשר לביצוע פשע (סחר בסם), לפי סעיף 499(א)(1) לחוק העונשין, התשל"ז-1977 (להלן: חוק העונשין ); ריבוי עבירות של סחר בסמים לפי סעיף 13 לפקודת הסמים המסוכנים [נוסח חדש], התשל"ג-1973 (להלן: הפקודה ) בשילוב סעיף 29 לחוק העונשין; וריבוי עבירות של החזקת סמים שלא לצריכה עצמית לפי סעיף 7 לפקודה.

לאחר שני דיונים שקיים בנושא, קבע בית המשפט קמא בהחלטה מיום 14.1.2015, כי אין ראיות לכאורה לעבירה של קשירת הקשר לסחר בסם או לריבוי עבירות הסחר בסמים, אך כן קיימות ראיות לכאורה לעבירות החזקת סם שלא לצריכה עצמית. בית המשפט הורה על מעצר העורר עד תום ההליכים. בערר על החלטה זו לפני בית משפט זה (בש"פ 612/15) נקבע (השופט פוגלמן) , כי אמנם אין עילה להתערב בקביעה בדבר קיומן של ראיות לכאורה, אולם
בראיה המרכזית נגד העורר יש חולשה המצדיקה בחינה מחודשת של חלופה לשחרורו ממעצר.
בעקבות זאת שוחרר העורר על-ידי בית המשפט קמא ביום 24.2.2015 למעצר בית בתנאים מגבילים, חרף המלצה שלילית נוספת מטעם שירות המבחן לגבי החלופה שהוצעה, תוך "הידוק" מרבי של החלופה. נקבע, שמעצר הבית ילווה באיזוק אלקטרוני של העורר, בערבות בת
5,000 ₪ מצד כל מפקח, בערבות עצמית בסך 10,000 ₪ ובהפקדת 15,000 ₪ במזומן. כן נאסר העל העורר יציאה מהארץ, ונאסר עליו ליצור קשר ישיר או עקיף עם מי מהמעורבים והעדים בפרשה.

ביום 10.3.2015 דן בית המשפט קמא בבקשת העורר להחזרת חפצים שונים שהמשטרה תפסה מידו, וביניהם רכבו. בא כוחו של העורר טען, כי החולשה הראייתית שנמצאה בעניינו צריכה להביא גם להחזרת רכבו, אף על פי שהמשיבה מבקשת לחלט אותו בסוף המשפט. בית המשפט קבע כי בנוגע להחזרת הרכב יש לנהוג בדרך המקובלת, ולהורות על שיעבוד פוליסת הביטוח של הרכב לידי המשיבה, ועל הפקדת בטוחה בגובה שליש משווי הרכב, שהוסכם שהוא סכום של 10,000 ₪. כן נדרש מהעורר להתחייב שלא יעשה כל דיספוזיציה ברכב.
ביום 12.3.2015 ניתנה ההחלטה בבקשה הנוספת של העורר, ליציאה לליל הסדר בבית משפחתו של אחד הערבים. המשיבה הסכימה לבקשה, בתנאי שיוגדל סכום ההפקדה, היות שלא ניתן להעתיק את מיקום האזיק האלקטרוני באופן זמני. בית המשפט קיבל את הבקשה, בכפוף להפקדת סכום של 5,000 ₪ למשך תקופת ההיעדרות מהבית.
העררים מופנים נגד שתי החלטות אלה.

לטענת העורר, ההפקדות הנוספות שנדרשו ממנו בשתי ההחלטות הנ"ל מכבידות עליו מאוד מבחינה כלכלית, ופוגעות בו באופן לא מידתי. כן טען, כי הוא היה עצור כשלושה חודשים וחצי, בהם לא עבד, ואינו עובד גם מאז שוחרר למעצר הבית, ולפיכך הדרישה להפקדות נוספות עלולה לסכל את בקשותיו. הוא סבור שמשנקבע שעוצמת הראיות חלשה, יש בכך כדי להשליך על עוצמת ההידוק של חלופת המעצר לצורך היציאה לליל הסדר. ולעניין הרכב התפוס נטען, כי אמנם הסכום שנקבע לצורך שחרור הרכב עולה בקנה אחד עם ההלכה בנושא, אך חולשת הראיות בעניינו מצדיקה ויתור על דרישת ההפקדה והסתפקות בתנאים האחרים שהוטלו, אשר מבטיחים, אליבא דידו, את האפשרות לחילוט עתידי של הרכב.

מנגד, טענה באת כוח המדינה כי לא נפל כל פגם בהחלטות בית המשפט קמא ויש לדחות את שני העררים. נטען כי לעורר מיוחסות עבירות חמורות המלמדות על המסוכנות הנשקפת ממנו ועל החשש שיימלט מן הדין. היא הוסיפה כי תסקירי המעצר בעניינו מלמדים על הסיכון למעורבות חוזרת של העורר בעבריינות בתחום הסמים, ועל כן לא הומלץ לשחררו מלכתחילה לחלופת מעצר. כן, נטען שאין עדיין בסיס למתן אמון בעורר אם ישוחרר לרגל החג מן האיזוק האלקטרוני בו הוא נתון, ושההפקדה הנוספת מאזנת נכון בין השחרור לבין הצורך לאיין את מסוכנותו של העורר ואת החשש מהימלטות.
באשר לרכב התפוס, טענה המדינה כי נקבע לא אחת שהאפקטיביות של הפקדת כסף במזומן או בערבות להבטחת חילוט עתידי של הרכב גדולה לאין שיעור מכל תנאי ערבות אחר. כן נטען כי שיעור ההפקדה שנקבע זהה לשיעור המקובל של 30% מערכו של הרכב, וכי לעוצמת הראיות אין השלכה על גובה ההפקדה הראוי.
דיון והכרעה

לא מצאתי כי נפל פגם בהחלטות בית המשפט קמא, ועל כן דין שני העררים להידחות.

אשר ליציאה לליל הסדר. העורר אמנם שוחרר בסופו של דבר לחלופת מעצר, למרות תסקירים שליליים לגביו, ואולם בית המשפט היה ער למסוכנות העורר ולחשש להימלטות, ולפיכך הטיל על שחרורו תנאים מגבילים חמורים, לרבות איזוק אלקטרוני. מאחר שלא ניתן להעתיק את מיקום האזיק האלקטרוני באופן זמני למקום המיועד לבילוי ליל הסדר המבוקש על ידי העורר, מצא בית המשפט לאזן את הדבר על ידי הטלת הפקדה נוספת בסכום של 5,000 ₪ למשך תקופת ההיעדרות מהבית. ולענין זה איני רואה כל רלבנטיות באשר לטענה על "חולשת" הראיות, שכן ראיות אלה הן ששימשו בסיס לקביעת התנאים המחמירים כאמור של חלופת המעצר שנקבעה. אשר על כן, אין למצוא כל פגם בהחלטת בית המשפט.

ובאשר לשחרור הרכב התפוס. כידוע, התכלית העומדת בבסיס הטלת ערבויות על שחרור רכב תפוס ("חלופת תפיסה") היא הבטחת האפשרות לחילוטו העתידי (בש"פ 342/06 חב' לרגו עבודות עפר בע"מ נ' מדינת ישראל
(12.3.2006), בש"פ 5550/08 שמעון נ' מדינת ישראל
(8.7.2008)). העורר לא כופר בכך שההפקדה שנקבעה בעניינו היא בשיעור הנהוג שנקבע בפסיקה (עניין שמעון , בש"פ 6159/01 אבו עמר נ' מדינת ישראל , פ"ד נו(3) 817 (2001), בש"פ 3616/11
זגורי נ' מדינת ישראל (24.5.2011)). משנקבע כי קיימות ראיות לכאורה בעניינו של העורר, הרי שהתכלית האמורה של הבטחת האפשרות לחילוטו העתידי של הרכב בעינה עומדת, ואיני סבור כי יש בטענות בדבר "חולשה" כזו או אחרת בראיות התביעה כדי להשליך על הצורך בהבטחת תכלית זו.

סיכומם של דברים: התנאים שקבע בית המשפט קמא בשתי ההחלטות מושא העררים הם סבירים, ואינם חורגים מהמקובל, ולכן לא מצאתי עילה להתערב בהם.
משכך, דין שני העררים להידחות.
