החלטה
בקשה להארכת מעצרו של המשיב בתשעים ימים לפי סעיף 62 ל חוק סדר דין פלילי (סמכויות אכיפה – מעצרים) , התשנ"ו-1996 (להלן: החסד"פ ).

ביום 5.1.2012 הוגש כנגד המשיב כתב אישום המייחס לו עבירה של ניסיון שוד בנסיבות מחמירות לפי סעיף 403 סיפא לחוק העונשין, התשל"ז-1977 (להלן: החוק ).

תמצית העובדות: לפי כתב האישום, ביום 24.6.12, בשעות הערב רכב י.ק. (להלן: המתלונן ) על קטנוע בדרך לביתו, ולאחר שנעצר בצומת עקב רמזור אדום, הבחין במשיב ואדם נוסף אשר זהותו אינה ידועה למבקשת (להלן: השותף ) מגיעים לעברו. כאשר הגיעו בסמוך אליו, אחזו המשיב והשותף בכידון הקטנוע וניסו לחלץ את אחיזתו מהקטנוע תוך שהם מורים לו לרדת ממנו. לאחר שהמתלונן ניסה להימלט עם הקטנוע, עצרו אותו המשיב והשותף, הכו אותו על הקסדה שלראשו והפילו אותו ביחד עם הקטנוע על הכביש. המשיב והשותף המשיכו להכות את המתלונן על הקסדה ובגופו, בזמן שהיה שרוע על הכביש, תוך שהם מנסים לנתק את אחיזתו בקטנוע, כשכל אותה העת המתלונן ממשיך לאחוז בקטנוע ולהפציר בנאשם ובשותף שיניחו לו. כעבור זמן מה, לאחר שנוסעים ברכבים סמוכים, אשר המתינו אף הם לרמזור, החלו לצפור ולצאת מרכביהם, נמלטו המשיב והשותף בריצה מן המקום. כתוצאה מן המאבק נגרם למתלונן שפשוף ברגלו.

בד בבד עם הגשת כתב האישום, נתבקשה הארכת מעצרו של המשיב עד תום ההליכים. בבקשה נטען כי נגד המשיב קיימות ראיות לכאורה, המושתתות על הודעותיו של המתלונן, דו"ח שוטר שהגיע למקום האירוע, וכן טביעת אצבע שנמצאה על גבי קסדתו של המתלונן ומתאימה לטביעת ידו של המשיב. בבקשה צוין כי למשיב עבר פלילי הכולל שלוש הרשעות קודמות, בין היתר בעבירות קשר להכשלת ביצוע החוק, נהיגה מסוכנת ברכב, ניסיון פריצה לרכב ועוד. עוד נטען בבקשה, כי גם את העבירות המיוחסות לו ביצע המשיב שעה שכבר תלוי ועומד כנגדו עונש מאסר על תנאי בן שישה חודשים.
ביום 11.7.2012, ניתנה החלטת בית משפט
קמא (השופט א' אינפלד ) ולפיה קיימות ראיות לכאורה כנגד המשיב. בהחלטה צוין כי המשיב פתח את חקירתו בשתיקה, ושתק ביחס לחלק מן השאלות אותן נשאל במהלך החקירה. בנוסף ציין בית המשפט
את גרסאותיו המפוקפקות של המשיב ביחס לאליבי, וביחס למכשיר הטלפון שלו, אותו לטענתו שכח במקום העבודה. נקבע אפוא כי שתיקת המשיב, גרסאותיו מעוררות התמיהה וטביעת האצבע שנמצאה על הקסדה מקימים ראיות לכאורה.
ביום 15.8.2012, החליט בית משפט
קמא (השופט נ' אבו טהה ) על מעצרו של המשיב, עד לתום ההליכים, וזאת בהיעדר חלופת מעצר ראויה ואפקטיבית. בית המשפט
נימק את החלטתו גם באופן המעשה, נסיבותיו החמורות של ביצועו ועברו הפלילי של המשיב אשר מגבשים כנגדו חזקת מסוכנות.
ההחלטה על הארכת המעצר התבססה על תסקיר שירות המבחן המשלים – אשר בניגוד לתסקיר הראשוני שקדם לו, התבסס גם על פגישה עם אמו של המשיב – וממנו עולה כי לא קיימת חלופת מעצר הולמת. בתסקיר נקבע כי אמו של המשיב, שהוצעה כמפקחת, תתקשה להוות מענה ראוי, סמכותי ומציב גבולות, שיש בו כדי לצמצם את הסיכון הנשקף מהתנהגותו של המשיב. כן נשללה חלופת מעצר בביתה של בת זוגו של המשיב ותחת פיקוחה.

התיק העיקרי: ביום 19.7.2012 הוקרא כתב האישום והמשיב כפר בעבירות המיוחסות לו. לאחר השתלשלות דיונית שבמהלכה הועבר הטיפול בתיק - בהסכמת הצדדים - מן השופט א' אינפלד אל השופטת ט' חיימוביץ',
תוקן כתב האישום, הוספו ארבעה עדי תביעה ונקבעו שתי ישיבות הוכחות ליום 23.1.2013 וליום 6.2.2013. המשך שמיעת התיק נדחה ליום 22.4.2013 אולם בשל אילוצי בית המשפט נדחתה הישיבה ליום 13.5.2013, שאז אמורה להסתיים פרשת התביעה, פרשת ההגנה ויישמעו סיכומי הצדדים.
מכאן בקשת המדינה להאריך את מעצרו של המשיב בשלושה חודשים. המשיב התנגד לבקשה, בציינו כי נוכח תשעת החודשים בהם שהה כבר במצער ומאחר שאין מדובר בעבירה ברף הגבוה, הגיעה העת לשחרורו של המשיב. למיצער, ביקש המשיב להתלות את מתן ההחלטה עד ליום 21.4.2013, שאז אמור להיערך דיון בבקשתו לעיון חוזר בהחלטה למעצרו עד תום ההליכים, וזאת נוכח חולשה ראייתית שנגלתה, לטענתו, במהלך שמיעת הראיות.

כידוע, שני השיקולים המרכזיים במסגרת סעיף 62 לחסד"פ הם מסוכנותו של הנאשם והתקדמות המשפט. במקרה דנן, מסוכנותו של המשיב אמנם אינה ברף הגבוה מאוד בהתחשב בכך שלא נעשה שימוש בנשק קר או חם במהלך ניסיון השוד. עם זאת, המסוכנות נלמדת מעצם המעשה של ניסיון שוד תוך שימוש באלימות בעיבורה של עיר, וייתכן כי לולא התערבותם של עוברי אורח, תוצאות האירועים ברכוש ובנפש היו חמורים בהרבה. לכך יש להוסיף כי למשיב עבר פלילי הכולל שלוש הרשעות קודמות (בעבירות של נסיון לפריצה לרכב בכוונה לגנוב, נהיגה בשכרות, נהיגה פוחזת של רכב וקשר להכשלת בצוע החוק) ובזמן ביצוע העבירות מושא כתב האישום היה תלוי ועומד כנגדו מאסר מותנה של ששה חודשים.
אשר לקצב התקדמות המשפט, הרי שביום 13.5.2013 אמורה להסתיים כל שמיעת הראיות וכן שמיעת הסיכומים. התיק אינו גדול בהיקפו, ומתבסס בעיקר על טביעת אצבע של המשיב שנמצאה על קסדתו של המתלונן. במצב דברים זה, אני סבור כי יש מקום להיעתר לבקשה, מתוך הנחה כי מדובר בארכה ראשונה ואחרונה, וככל הנראה אף לא יהא צורך לנצל ארכה זו עד תומה.
מובן כי אין בהחלטה זו כדי להשליך על הבקשה לעיון חוזר שהוגשה על ידי המשיב, ואשר עניינה במישור הראייתי.

אשר על כן, אני נעתר לבקשה ומורה על הארכת מעצרו של המשיב בתשעים יום החל מיום 5.4.13, או עד למתן פסק דין ב ת"פ
