כנגד המשיב הוגש כתב אישום המייחס לו זריקת אבן על רכב חולף – עבירה של סיכון חיי אדם במזיד בנתיב תחבורה לפי סעיף 332(3) לחוק העונשין, תשל"ז-1977.
על פי כתב האישום וכפי שעולה מחומר הראיות, השליך המשיב אבן במרחק מה מגדר הישוב לכיוון הכביש. כפי שעולה מחומר הראיות, המרחק ממקום זריקת האבן לכביש הוא כ- 30 מטר
(על פי תצ"א שצורפה). אין חולק כי האבן לא פגעה ברכב שחלף.
מחומר הראיות עולה לכאורה כי המניע לזריקת האבן הוא "מעורב". שמא ניסיון להרשים בחורה שהאיצה במשיב להשליך את האבן, שמא ניסיון לפגוע בערבים כפי שהתבטא המשיב בחקירתו.
בית משפט קמא הורה על שחרורו של המשיב בשל מספר טעמים, המקובלים עלי. ראשית, אין מדובר בהשלכת אבן "בכינון ישיר" משולי הכביש על רכב חולף במרחק של מטרים ספורים. מבלי להמעיט כהוא זה מחומרת העבירה, הרי שבמשרעת של העבירה של יידוי אבנים, המעשה שבפנינו אינו ברף הגבוה, כפי שהתבטאה באת כוח המאשימה עצמה במהלך הדיון בבית המשפט קמא.
על כך יש להוסיף, כי ענייננו בקטין חסר עבר פלילי. אף הופנתה תשומת ליבי לבעיות רפואיות כאלה ואחרות של המשיב, גורם שיש לקחת בחשבון מבחינת השלכות המעצר על המשיב.
בנסיבות אלה, וכאשר הקטין הביע חרטה וצער על הטעות שעשה מיד בחקירתו הראשונה, נחה דעתי כי אין מקום להתערב בהחלטת בית המשפט קמא.
השאלה שהטרידה אותי יותר היתה לגבי חלופת המעצר. ברגיל, יש הגיון ויש טעם בהרחקת הנאשם ממקום ביצוע העבירה. במקרה דנן, בית משפט הורה על החזרת המשיב לבית הוריו במעלה עמוס. לאחר ששקלתי בעניין, ובהתחשב בחג הפסח המתרגש עלינו לטובה, איני רואה להתערב בהחלטה זו. עם זאת, מאחר שהעבירה נעברה בתחומי הישוב, ומאחר שטרם הוגש תסקיר מעצר בעניינו של המשיב על מנת ליתן את התמונה המלאה לפני בית משפט של
מעצר, אני מורה כי בשלב זה המעצר יהיה מעצר בית מלא, כך שלא יתאפשר למשיב להסתובב ברחבי הישוב. כל זאת, בכפוף לכך, שבמהלך חג הפסח יתאפשר למשיב לצאת בלווית אביו ובפיקוח אביו לבית הכנסת וחזרה.
