בפניי ערר על החלטת בית המשפט המחוזי מרכז (כבוד השופט מ' יפרח ) בתיק מ"ת 13619-02-09 מיום 5.4.2009, לפיה הוחלט לעצור את העורר עד תום ההליכים המשפטיים המתנהלים נגדו.
כנגד העורר הוגש לבית המשפט המחוזי מרכז כתב אישום, המייחס לו עבירה של שוד, לפי סעיף 402(ב) לחוק העונשין, התשל"ז-1977 (להלן: חוק העונשין ); ועבירה של פציעה בנסיבות מחמירות, לפי סעיף 335(א)(1)+(2) לחוק העונשין.
על פי הנטען בכתב האישום, ביום 1.2.2009 בשעה 03:30 בבוקר לערך, היה המתלונן, שהינו בעלים של פאב ברחובות, בדרך אל ביתו בנס ציונה, כאשר בכיסו האחורי פדיון יומי בסך 15,000 ש"ח. באותה עת הגיע העורר יחד עם שלושה נוספים (להלן: חבורת השודדים ) אל הבניין בו מתגורר המתלונן. שלושה מחבורת השודדים ארבו למתלונן במבואת הבית כאשר הם חבושים בכובעי גרב, לובשים כפפות, ובידי כל אחד מהשלושה מהלום ("שוקר" חשמלי בלעז). בנוסף, אחד מחבריו של העורר נשא עליו אזיקים. כשהגיע המתלונן לביתו, תקפו אותו השלושה באמצעות מכות אגרוף לפניו ולבטנו, וכן תקפו אותו בעזרת המהלומים. השלושה הכו את המתלונן במשך מספר דקות, עד אשר שכנו, שהינו שוטר, הגיע למקום לאחר ששמע את צעקותיו של המתלונן. בשלב זה ברחה חבורת השודדים יחד עם פדיונו של המתלונן. כתוצאה מהתקיפה, נחבל המתלונן בפניו והוא נזקק לתפרים וטיפול רפואי נוסף. כמו כן, נגרם נזק לדלת הזכוכית ולמראת קיר בכניסה לביתו של המתלונן.
בד בבד עם הגשת כתב האישום, הוגשה לבית המשפט המחוזי בקשה למעצרו של העורר עד תום ההליכים המשפטיים המתנהלים נגדו. ביום 4.3.2009 הורה בית המשפט המחוזי (כבוד השופטת ל' ברודי ) על עריכת תסקיר על ידי שירות המבחן בעניינו של העורר,
בטרם ייתן החלטתו בבקשה. לאחר שהוגש התסקיר, ביום 5.4.2009 הורה בית המשפט המחוזי (כבוד השופט מ' יפרח ) על מעצרו של העורר עד תום ההליכים המשפטיים המתנהלים נגדו. בהחלטתו, בית המשפט המחוזי עמד על כך כי העורר אינו חולק על כך כי קיימות נגדו ראיות לכאורה וכן עילת מעצר. לאור זאת בחן האם ניתן לאיין את המסוכנות הנשקפת מצדו בדרך של חלופת מעצר. בית המשפט המחוזי קבע כי על אף ששירות המבחן המליץ על שחרור העורר למעצר בית בפיקוח אביו, הרי שמהתסקיר עולה גם כי לא ניתן לשלול סיכון למעורבות עבריינית חוזרת מצידו. עוד ציין בית המשפט המחוזי כי כנגד העורר תלוי ועומד מאסר על תנאי בר הפעלה, וגם בעבר שהה לתקופה מסוימת במעצר בית בפיקוח אביו, אך הדבר לא מנע ממנו לחזור לסורו לאחר סיום התקופה, ועל כן לא ניתן לתת בו אמון. משכך, הורה על מעצרו עד תום ההליכים המשפטיים המתנהלים נגדו.
מכאן הערר שבפניי.
לטענת העורר, אף כי אין חולק כי קיימות נגדו ראיות לכאורה, הרי שעוצמתן חלשה ובכך יש להוביל למסקנה כי יש לשחררו לחלופת מעצר. לטענתו, הוא נעצר לאחר שמידע מודיעיני קשר אותו לאירוע נשוא כתב האישום. מהתייחסות המשיבה לטיבו של חומר זה אשר הועברה אליו, עולה כי חלקו בשוד מסתכם בהיותו נהג רכבם של חבורת השודדים, וכלל לא השתתף באירוע האלים. מכאן שהמסוכנות הנשקפת ממנו פחותה היא מזו של המעורבים האחרים בפרשה. ראיות אחרות הקושרות אותו לאירוע הן איכון מכשיר הטלפון הסלולארי שלו בזירת האירוע, בעוד שהוא טוען כי היה בביתו בזמן השוד ואימרה של אחד המעורבים האחרים למדובב מטעם המדינה, אשר משתמעת לשני פנים. עוד טוען העורר כי שגה בית המשפט משפסל את חלופת המעצר המוצעת. במיוחד הדגיש כי לא ניתן לפסול את חלופת המעצר משום שלכאורה חזר לפלילים על אף ששהה במעצר בית אצל אביו בעבר, שכן בעת ביצוע העבירות המיוחסות לו בכתב האישום התגורר בביתו ולא אצל אביו. העורר מוסיף כי הדיון היחיד בתיק הקבוע כרגע בבית המשפט המחוזי הינו בבקשה להסרת חיסיון ביום 17.5.2009, וטרם נקבעו מועדי הוכחות בתיק. לבסוף הדגיש כי הינו אדם נורמטיבי, נשוי ואב לילדים אשר לא קיים חשש כלשהו כי יימלט מן הדין.
מנגד, סומך בא כוח המשיבה את ידיו על החלטת בית המשפט המחוזי. בא כוח המשיבה מוסיף כי משלא חלק העורר כי קיימות נגדו ראיות לכאורה על מעורבותו בשוד, אין בפראפרזה שניתנה לו על תוכן המידע המודיעיני כדי לאיין את השתתפותו באירוע בו ננקטו אמצעים אלימים כלפי המתלונן. בנוסף הדגיש הוא את עברו הפלילי של העורר וכן לנאמר בתסקיר שירות המבחן כי לא ניתן לתת בו אמון.
לאחר ששמעתי את טיעוני הצדדים ולאחר שעיינתי בהודעת הערר ובהחלטת בית המשפט המחוזי, הגעתי לכלל מסקנה, כי דין הערר להדחות.
כפי שמורה סעיף 21(ב)(1) לחוק סדר הדין הפלילי (סמכויות אכיפה-מעצרים), התשנ"ו-1996, לא יורה בית המשפט על מעצרו של אדם מאחורי סורג ובריח אם ניתן להשיג את מטרת המעצר בדרך של שחרור לחלופת מעצר שפגיעתה בחירותו של הנאשם פחותה. על בית המשפט,
בבואו להחליט האם לשחרר נאשם לחלופת מעצר, לשקול את כלל השיקולים הרלוונטיים, לרבות טיב המעשים המיוחסים לו ועברו הפלילי. במקרה שלפניי, כתב האישום מייחס לעורר השתתפות בשוד אלים שתוכנן מראש, תוך שימוש בנשק ונקיטת אמצעים אשר אמורים היו למנוע את תפיסתם בידי רשויות החוק. נוסף על כך, עברו הפלילי העשיר כולל עבירות סמים רבות, עבירות רכוש ואף עבירת תקיפה הגורמת חבלה של ממש. בגין עבירה אחרונה זו הוטל עליו מאסר על תנאי, אשר הינו בר הפעלה באם יורשע בהליך הנוכחי. בנסיבות אלו, הצדק עם בית המשפט המחוזי אשר מצא כי לא ניתן לתת אמון בעורר ולשחררו חלופת מעצר, כיוון שזו לא תאכל לאיין את המסוכנות הנשקפת מצדו.
אכן, בעבר עמדתי על כך שאחד השיקולים המנחים להורות על חלופת מעצר הוא, היעדר עוצמה מספקת של הראיות הלכאוריות כדי להצדיק מעצר בפועל, שאז ניתן להסתפק בחלופת מעצר. (ראו בש"פ 6955/05 לולחי נ' מדינת ישראל (לא פורסם, 25.7.2005); בש"פ 7525/08 כהן נ' מדינת ישראל (לא פורסם, 9.9.2008)). עם זאת, בכל הנוגע לאפשרות שחרורו של העורר לחלופת מעצר איני מוצא מקום לסטות מהחלטתו של בית המשפט המחוזי. אין נפקא מינה לטענת העורר כי הראיות לכאורה מצביעות על כך כי חלקו בשוד היה בנהיגה ברכב המילוט ולא בהפעלת האלימות עצמה. אף אם יש אמת בטענה זו – אשר ודאי תתברר במהלך משפטו –
אין בכך כדי להחליש את קיומן של ראיות לכאורה נגדו לביצוע מעשה אלים, אשר יש בו בפני עצמו בכדי להעיד על המסוכנות הנשקפת מצדו כלפי הציבור.
אשר על כן, הערר נדחה.
