בפניי ערר על החלטת בית המשפט המחוזי בבאר שבע מיום 5.4.2009, בתיק ב"ש 20464/09, להורות על מעצרו של העורר עד תום ההליכים המשפטיים המתנהלים כנגדו.
כתב האישום שהוגש כנגד העורר לבית המשפט המחוזי, מייחס לו עבירה של איומים, לפי סעיף 192 לחוק העונשין, התשל"ז-1977 (להלן: חוק העונשין) ; עבירה של החזקת סכין שלא כדין, לפי סעיף 186(א) לחוק העונשין; שתי עבירות של ניסיון לרצח, לפי סעיף 305 לחוק העונשין; עבירה של גרימת פציעה בנסיבות מחמירות, לפי סעיפים 334 ו-335(א)(1) לחוק העונשין; עבירה של גרימת חבלה חמורה בנסיבות מחמירות, לפי סעיפים 333 ו-335(א)(1) לחוק העונשין; עבירה של גרימת היזק לרכוש במזיד, לפי סעיף 452 לחוק העונשין; ועבירה של ניסיון הצתה, לפי סעיפים 448(א) ו-25 לחוק העונשין.
כתב האישום מגולל סיפור על סכסוך בין העורר, שעבד משנת 1999 כמסגר במפעלי ים המלח (להלן: המפעל ), ליושב ראש מועצת העובדים במפעל, ארמונד לנקרי (להלן: ארמונד ) ובנו, שני לנקרי (להלן: שני ) שהחל גם הוא לעבוד במפעל בשנת 2002. הסכסוך החל על רקע תאונת עבודה שעבר העורר בשנת 2007, לאחריה סירב לקבל תפקידים חלופיים והחל להאשים את ארמונד כי לא סייע לו מספיק בפניותיו להנהלת המפעל. בתחילה, בחודש פברואר 2009, פנה העורר לשני ואיים עליו ועל אביו באומרו "תמסור לאבא שלך שכללי המשחק השתנו". בבוקר יום 3.3.2009 נקרא העורר לשיחה עם מנהלו הישיר, בה ננזף על תפקודו ובצהרי אותו יום, הגיע הלה למשרד מועצת העובדים במפעל כשהוא מצויד בסכין. לאחר הכניסה למשרד, בו נמצאו ארמונד ושני, התנפל העורר על שני ודקר אותו מספר פעמים. ארמונד פנה לעזרת בנו, אך כאשר ניסה לתפוס את העורר, נדקר גם הוא שלוש פעמים בחזהו ובגבו. לאחר שאדם נוסף, דוד ווזאנה, הצליח להשתלט על העורר וארמונד ושני פונו לבית חולים, הגיעו למשרד מאבטחים במטרה להוציא את העורר מהמשרד, אך זה החל לבעוט ולחבוט במחשב שנמצא בחדר עד לשבירתו. לאחר מכן, העורר יצא מהמשרד אך חזר לשם שוב והדליק דפים שהיו מונחים על השולחן. עם הגעת השוטרים למקום, כשהעורר אזוק וממתין עד לסיום גביית העדויות, הוא נגח בחוזקה בזגוגית של דלת הזזה וניפץ אותה.
בד בבד עם הגשת כתב האישום הוגשה לבית המשפט המחוזי בקשה לעצור את העורר עד לתום ההליכים המשפטיים המתנהלים כנגדו.
ביום 12.1.2009, האריך בית המשפט המחוזי (כבוד השופט י' צלקובניק ) את מעצרו של העורר עד למתן החלטה אחרת, לצורך עריכת בדיקה פסיכיאטרית ובדיקת כשירותו לעמוד לדין. לאחר דחייה נוספת, הדיון בבקשת המעצר נקבע ליום 5.4.2009 ובאותו מעמד אושרה בקשת המשיבה, ובית המשפט המחוזי הורה על מעצרו של העורר עד תום ההליכים המשפטיים המתנהלים כנגדו. בהחלטה מפורטת ומנומקת ציין בית המשפט, כי העורר אינו מכחיש כי דקר את ארמונד ואת שני וכי מהנסיבות עולה, שאף היה בכוונתו להביא למותם. עוד נאמר, כי אין חולק על קיומה של עילת מעצר, נוכח מעשי האלימות הקשים המתוארים בכתב האישום, ואולם סבר בא כוח העורר כי טרם ההחלטה יש להפנות את העורר לקבלת תסקיר. בית המשפט דחה טענה זו וקבע כי הנסיבות, בהן בוצעו המעשים החמורים המיוחסים לו, שוללות את האפשרות כי ניתן יהיה להשיג את מטרת המעצר על ידי שחרורו לחלופה. כמו כן, מחוות הדעת הפסיכיאטרית מיום 23.3.2009 עלה, כי בעת ביצוע העבירות, העורר לא היה שרוי במצב פסיכוטי וכן כי "ידוע על שימוש בסמים שונים ובאלכוהול". לבסוף, צוין בהחלטה כי, בעברו של העורר מספר הרשעות בפלילים. בשל קיומן של ראיות לכאורה ובשל החשש הכבד למסוכנות הנשקפת ממנו ואשר אינה ניתנת לאיון על ידי שחרורו לחלופת מעצר, הורה בית המשפט המחוזי כאמור, להורות על מעצרו עד תום ההליכים.
על החלטה זו מוגש הערר שבפניי, בגדרו עותר העורר לשחרורו לחלופת מעצר, לאחר שמסוכנותו תיבחן על ידי שירות המבחן. בנימוקיו, מביע בא כוח העורר הסכמה לקיומן של ראיות לכאורה לדקירה ועם זאת טוען, כי אלה אינן מגבשות עבירה של ניסיון לרצח, באשר לא היה בכוונתו של העורר להביא למותם של ארמונד או שני. לדבריו, העורר הגיע למשרדו של ארמונד למטרת הידברות, והשיחה המקדימה שבה הודיע העורר לשני על "שינוי כללי המשחק", לא מעידה על תכנון מוקדם של האירוע ואף לא על כוונה להרוג. כמו כן נטען, כי הדקירות נעשו באמצעות מסרט – כלי עבודה דמוי סכין, בו השתמש העורר במסגרת עבודתו כמסגר וכן, כי ההתנהגות האלימה של העורר נבעה ממצבו הנפשי הקשה ומאיבוד עשתונות שנבעו מן המצב הכלכלי בו היה שרוי.
בנוסף, הבהיר בא כוח העורר כי אינו חלוק גם על קיומה של עילת המסוכנות, ואולם חזר על טענתו כי שגה בית המשפט המחוזי, בוויתורו על קבלת תסקיר מבחן. לבסוף, הוזכרו נסיבותיו המשפחתיות, מצבו הבריאותי והנפשי של העורר, החרטה שהביע על מעשיו ונסיבות מקלות נוספות. כמו כן, צוין כי אין לייחס משקל לעברו הפלילי, בחלוף 17 שנה ממועד ביצוע העבירה האחרונה.
בא כוח המשיבה מצידו, טען בפניי כי יש מקום להורות על הכנת תסקיר, רק כאשר סובר בית המשפט כי ישנה אפשרות כלשהי לשחרור לחלופת מעצר. נסיבותיו של מקרה זה, מייתרות לדעתו את הפנייתו של העורר לשירות המבחן, מאחר וגם באם תתקבל התרשמות חיובית ממנו, לא יהיה בכך כדי להפוך את הקערה על פיה. מעשי האלימות הקשים, טיבן ומספרן של הדקירות שגרם והכנת הסכין מבעוד מועד, ממחישים את חומרת האירוע ומדגישים את המסוכנות הנשקפת ממנו. כמו כן, הודגשה ההתייחסות של חוות הדעת הפסיכיאטרית, בנוגע לבעיית הסמים והאלכוהול, שיש בה כדי להעצים לדברי בא כוח המשיבה, את עילת המסוכנות.
עיון בהודעת הערר ושמיעת הטיעונים, הביאוני לכלל מסקנה כי דין הערר להידחות. אקדים ואומר, כי גם לו הייתי מקבל את טענת בא כוח העורר באשר לאי גיבושה של מחשבה פלילית לעבירת ניסיון לרצח – ואיני מכריע בשאלה זו – די היה בששת האישומים האחרים בכתב האישום כדי להגיע לאותה תוצאה. באשר לעילת המסוכנות, הרי שאופי מעשיו של העורר מדבר בעד עצמו ומגבש עילה זו, גם אם אין מ דובר במסוכנות מובנית של עבירת הניסיון לרצח. השיחה בדבר "שינוי כללי המשחק" והבאת הסכין, מעידים על התכנון המוקדם של האירוע. מה עוד, שההתקפה על שני לא החלה בשל התלהטות יצרים ספונטנית, כי אם הכניסה למשרדים הייתה למטרת פגיעה. לכך נוספים נחישותו של העורר, ריבוי ניסיונות הדקירה (כפי שהדברים צולמו במצלמת אבטחה), הפניית הדקירות לפלג הגוף העליון של ארמונד ושל שני, לעבר חלקי גוף רגישים, העובדה כי תקף את שני שהיה במשרד באקראי, אמירתו בחקירת המשטרה כי כל שדרת המנהלים במפעל עלולה הייתה ליפול קרבן למעשיו, והן בעיית הסמים והאלכוהול המצוינת בחוות הדעת הפסיכיאטרית. ואם בכך לא היה די, גם לאחר מעשה, הביע העורר תקווה, כי קרבנותיו נפגעו בצורה אנושה ובהודעתו במשטרה אישר כי התכוון לפגוע בהם. כל אלה, מעידים באופן שאינו משתמע לשני פנים על עוצמת המסוכנות הגבוהה שנשקפת מן העורר, ומעלים חשש כבד לביטחונם של מנהלי המפעל והציבור בכללותו, במידה וישוחרר ממעצר.
גם בסוגיית חלופת המעצר, דעתי היא כדעת בית המשפט המחוזי. אכן, על בית המשפט לבחון כמצוותו של סעיף 21(ב)(1) לחוק סדר הדין הפלילי (סמכויות אכיפה – מעצרים), התשנ"ו-1996, בכל מקרה ומקרה, האם ניתן להשיג את מטרת המעצר גם בדרך הפוגעת פחות בחירותו של הנאשם. ואולם, אין משמעה של חובה זו, כי ניתן להשיב על שאלת החלופה רק לאחר קבלת המלצות תסקיר המבחן. בית משפט זה קבע פעמים רבות, כי עוצמת מסוכנות גבוהה ומוכחת עשויה לייתר את הצורך בבחינת חלופות מעצר קונקרטיות על ידי שירות המבחן (ראו בש"פ 9284/08 לוי נ' מדינת ישראל (לא פורסם, 14.11.2008); בש"פ 2931/06 גבאלי נ' מדינת ישראל (לא פורסם, 23.4.2006)). רק באם יגיע בית המשפט למסקנה, כי ניתן להסיר את מסוכנותו של הנאשם על ידי חלופת מעצר כלשהי, יהיה טעם לבחון את מידת התאמתן של חלופות המעצר המוצעות (בש"פ 5543/06 אבו חוצא נ' מדינת ישראל (לא פורסם, 5.7.2006); בש"פ 9447/04 זבידאת נ' מדינת ישראל (2.11.2004). לנוכח הנסיבות המתוארות לעיל, המסקנה, כי יש להותיר את העורר במעצר עד תום ההליכים המשפטיים המתנהלים כנגדו, מתגבשת גם בלא שייערך תסקיר מבחן בעניינו של העורר.
אשר על כן, הערר נדחה.
