ערעור על החלטת הרשם ג' שני (ע"פ 7643/13-ג') מיום 30.3.2014 בה דחה את בקשת המערער להקדים את מועד הדיון בערעור שהגיש על הכרעת הדין וגזר הדין שנתן בית המשפט המחוזי בתל אביב-יפו בעניינו.
הרשם דחה את הבקשה בציינו כי מועד הדיון בעניינו של המערער נקבע בהתאם לאמות המידה הנהוגות בהליכים מסוג זה, וכי בשים לב לכלל השיקולים, אין בידו להורות על הקדמת הדיון.
בערעור טוען המערער כי המועד שנקבע לדיון בערעור, ביום 31.12.2014, מרוחק מדי, ולכן פוגע בו קשות, ומצדיק סטייה מאמות המידה הנהוגות בהליכים מסוג זה, על אף היקפו של התיק ואורך תקופת המאסר. לטענתו, ללא בירור בהול של הערעור יגרם לו נזק בלתי הפיך, ומנגד, הערעור עלול להקל עליו בצורה ניכרת.
דין הערעור להידחות. הדיון בערעור נקבע על פי סדרי העבודה הנהוגים בהתחשב במכלול השיקולים הנבחנים לצורך כך ובהתחשב בעומס על יומנו של בית המשפט. השאלה אם להקדים מועד שנקבע לדיון בערעור אם לאו נתונה במתחם שיקול דעתו של הרשם. בנסיבות אלה הפעיל הרשם את שיקול דעתו כדבעי ולכן אין להתערב בהחלטתו.
סוף דבר, הערעור נדחה.
