החלטה

העורר הורשע בביצוע עבירות מין כלפי שתי אחייניותיו הקטינות, ונדון לעונש מאסר של 12 שנה. בתום תקופת המאסר הוצא נגדו צו פיקוח ומעקב למשך 4 שנים, החל מיום 17.1.2010 לפי חוק הגנה על הציבור מפני עברייני מין, התשס"ו-2006 (להלן: חוק הפיקוח ). צו הפיקוח כולל, בין היתר, שיתוף פעולה עם קצין הפיקוח, איסור התחברות עם קטינות, איסור לשהות לבד עם קטינות ואיסור לינה בבית בו גרות קטינות.
בחלוף כשנתיים, עתר העורר ל בית המשפט המחוזי בבקשה לבטל את תקופת הפיקוח, בטענה כי הפיקוח פוגע בכבודו ובסיכויי שיקומו. העורר, אשר מייצג את עצמו בערר דכאן, טען כי הוא משמש כשליח ציבור במספר בתי כנסת, וכי נרשם ללימודים אקדמיים, כך שיש בפיקוח כדי לפגוע בו הן כשליח ציבור והן כסטודנט.
בית המשפט
המחוזי דחה את בקשתו של העורר, ומכאן הערר שבפניי במסגרתו חזר העורר על הטענות שהעלה בפני בית משפט
קמא.

למרות שטרם נתברכנו בפסיקה עשירה לגבי הוראות חוק הפיקוח (ראו החלטתו של כב' השופט רובינשטיין בבש"פ 5876/10 פלוני נ' מדינת ישראל (לא פורסם, 25.8.2001) והאסמכתאות שם), איני סבור כי הערר דכאן מצריך דיון מקיף בהוראות החוק.
לטעמי, לא עלה בידי העורר להראות שינוי נסיבות המצדיק קיצור תקופת הפיקוח. נהפוך הוא. ממכתבו של קצין פיקוח עברייני מין, עולה כי העורר אינו משתף פעולה לאורך כל תקופת היותו נתון בפיקוח, וגם אם החל לשתף פעולה לאחרונה בכך שהוא עונה לטלפונים ומוסר מידע, עדיין, כך נטען, הוא ממשיך לנקוט בגישה שקרית, מדווח על מקום הימצאו במקומות שונים אך לא נמצא בהם. עוד נכתב, כי מאחר שהעורר מתגורר כיום בבית אמו ולמקום מגיעים בני המשפחה, לרבות אחת המתלוננות, הרי שבהעדר פיקוח עלול העורר להכניס עצמו למצבים בהם ישב ביחידות עם קטינים ויהווה סכנה עבורם.
