החלטה
לפניי בקשה ראשונה להארכת מעצר לפי סעיף 62 לחוק סדר הדין הפלילי (סמכויות אכיפה – מעצרים), התשנ"ו-1996 (להלן: חוק המעצרים ), בתשעים ימים מיום 12.6.2013 או עד למתן פסק הדין בת"פ 28180-09-12 בבית המשפט המחוזי בבאר שבע (כב' השופט נ' אבו טהה ), לפי המוקדם.

נגד המשיב הוגש ביום 11.9.2012 כתב אישום לבית המשפט המחוזי בבאר שבע, המייחס לו עבירה של החזקת סמים שלא לצריכה עצמית ועבירה של הסתייעות ברכב לביצוע פשע לפי פקודת התעבורה. מכתב האישום עולה כי המשיב קיבל לידיו סם מסוכן מסוג חשיש, במשקל כולל של
62.8 ק"ג , אשר חולק למספר אריזות אותן הטמין במספר הזדמנויות במסלעה מתחת לאבנים בקרבת ביתו. הסמים נמצאו במסגרת פעילות יזומה של משטרת ישראל בסמוך לביתו של המשיב. בכתב האישום המתוקן נכללה גם בקשה לחילוט רכבו של המשיב לטובת אוצר המדינה, בהתאם לסעיף 36(א)(1) ו-(ב) לפקודת הסמים המסוכנים (נוסח חדש), התשל"ג-1973.

בד בבד עם הגשת כתב האישום הוגשה בקשה למעצרו של המשיב עד תום ההליכים. במסגרת הדיון בבקשה הסכים בא כוח המשיב לקיומן של ראיות לכאורה ולקיומה של עילת מעצר. בדיון שנערך ביום 8.11.2012 הורה בית המשפט על מעצרו של המשיב עד תום ההליכים המשפטיים נגדו, וזאת בהסתמך על תסקיר המבחן, אשר לא בא בהמלצה באשר לשחרורו לחלופה כלשהי. החלטה זו התקבלה בהסכמת בא כוח המשיב.

בתיק העיקרי המתנהל בבית המשפט המחוזי נדחה הדיון חמש פעמים, שלוש פעמים מתוכן מסיבות הנוגעות לצורכי המשיב בלבד כגון החלפת ייצוג, מחלת בא כוחו ומתן אפשרות לעיון בחומר חקירה. ביום 5.12.2012 קבע בית המשפט מועדים לשמיעת פרשת התביעה, לתאריכים 9.6.2013 ו-23.6.2013. על-פי כתב האישום, פרשת התביעה תכלול אחד-עשר עדים, מתוכם עשרה שוטרים.

כעת מונחת לפניי בקשה להארכת המעצר מעבר לתשעה חודשים, החל מיום 12.6.2013. בבקשה נטען כי מועדי שמיעת ההוכחות נקבעו כפי שנקבעו – אחד מהם לאחר סיום תקופת מעצרו של המשיב עד תום ההליכים דהיינו בתקופת ההארכה המתבקשת, וזאת בשל העומס הרב בבית המשפט המחוזי. בהקשר זה נטען כי בשני המועדים שנקבעו צפויה פרשת התביעה להסתיים. עוד טוענת המדינה כי נשקפת מהמשיב מסוכנות גבוהה הנלמדת, לטענתה, מן מהכמות הגדולה במיוחד של הסמים המסוכנים שהחזיק. בנוסף, נטען כי לא מדובר באירוע חד פעמי, שכן על-פי עובדות כתב האישום, הסמים נלקחו על ידי המשיב במספר הזדמנויות שונות. עוד עומדת המדינה על תסקיר המבחן שהוגש בעניינו של המשיב ומטעימה שבתסקיר לא הוצעה כל חלופת מעצר שיש בה כדי לאיין את המסוכנות האמורה.

המשיב מתנגד לבקשה וטוען כי ההליך בבית המשפט התארך שלא באשמתו וכי נוכח מורכבותו של התיק הוא צפוי להתנהל עוד זמן רב. עוד מטעים המשיב כי הוא נעדר עבר פלילי ובית המשפט המחוזי היה נכון לבחון לגביו חלופת מעצר, ומשכך החליט להורות על עריכת תסקיר בעניינו. בנוסף, נטען כי יש לתת משקל לכך שהסמים לא נתפסו בביתו של המשיב אלא בסמוך לו.

לאחר שעיינתי בבקשה ובצרופותיה ושמעתי את טענות הצדדים, הגעתי לכלל מסקנה כי דין הבקשה להתקבל. כידוע, שניים הם השיקולים המנחים את בית המשפט בדונו בבקשה להארכת מעצר מעבר לתקופה הסטטוטורית הקבועה בחוק: רמת המסוכנות הנשקפת מן הנאשם וקצב שמיעת המשפט (בש''פ 1461/07 מדינת ישראל נ' חכמיגרי (21.2.07); בש"פ 1693/03 מדינת ישראל נ' אבו-עסא
(5.3.03)). באשר לרמת המסוכנות הנשקפת מהמשיב, הרי שהעבירות המיוחסות לו בכתב האישום מקימות חזקת מסוכנות סטטוטורית (סעיף 21(א)(ג)(3) לחוק המעצרים) ובהקשר זה נקבע לא אחת בפסיקתנו כי מי שנאשם בעבירות סמים שלא לצריכה עצמית לא ישוחרר לחלופת מעצר אלא במקרים חריגים ויוצאי דופן (ראו למשל: בש"פ
6527/12 מדינת ישראל נ' שרכס , פס' 12 (30.09.12); בש"פ 4251/09 אוחיון נ' מדינת ישראל , פסקה 12 (22.5.09)). יתרה מזאת, מקובלת עליי טענת המדינה, לפיה יש ללמוד על מסוכנותו הרבה של המשיב אף מכמות הסמים שנתפסו ברשותו. עוד יש לתת את הדעת לכך שלמשיב מיוחסת קבלת סמים במספר הזדמנויות שונות, וזאת להבדיל ממעידה חד-פעמית. נתון חשוב נוסף הוא תסקיר שירות המבחן שהוגש בעניינו של המשיב, בו נקבע כי "במכלול השיקולים להערכתנו קיימת רמת סיכון להישנות התנהגות פורצת גבולות בעתיד".

באשר לקצב שמיעת המשפט, כידוע ככל שתקופת המעצר מתארכת, הולך ופוחת משקל אינטרס ההגנה על הציבור מפני המסוכנות הנשקפת מהנאשם, ובה-בעת גובר בהדרגה משקלה של זכות הנאשם לחירות (בש"פ 828/04 מדינת ישראל נ' בוטביקה (29.1.04); בש"פ 9944/02 מדינת ישראל נ' דאעס
(1.1.03)) . במקרה דנן, על אף שחלק מהאחריות על התמשכות הדיונים בתיק מוטל על ההגנה, יש לתת את הדעת לכך שעיכוב של כחצי שנה בשמיעת ההוכחות נבע מאילוצי יומנו של בית המשפט. בהקשר זה נזכור את שנאמר לא פעם בפסיקת בית משפט זה, כי מצוות המחוקק לקיים דיונים בתיקים פליליים בו הנאשם עצור עד תום ההליכים "מיום ליום" (סעיף 125 לחוק סדר הדין הפלילי (נוסח משולב), התשמ"ב-1982) הפכה להיות בבחינת "הלכה ואין מורין כן" (בש"פ 3838/90 מדינת ישראל נ' שילון , פ"ד מד(4) 360, 367-366 (1990); בש"פ 627/05 מדינת ישראל נ' אלזם

( 30.5.13 )); אולם, קשה לקבל אי קיום דיונים – בתיק בו הנאשם עצור במשך חצי שנה אף בשים לב לעומס בו נתונים בתי המשפט, ודומה כי לו היה בידי המשיב להציע חלופה אשר יש בה כדי לאיין את מסוכנותו, היה מקום לדחות את בקשת המדינה. יחד עם זאת, בהיעדר חלופה סבירה ובהתחשב במסוכנות הנשקפת מהמשיב, נראה כי אין לעת הזאת אפשרות להורות על שחרורו, אלא להסתפק בכך ששני הצדדים יגלו רצון לסיים את הפרשה מהר ככל הניתן ויגישו יחד בקשה לבית המשפט המחוזי לקבוע דיונים נוספים, ככל שיידרשו, ברציפות. לעניין זה יוער כי על פניו, ובניגוד לטענת המשיב, אותה לא נימק, לא מדובר בתיק מורכב שידרוש הרבה מעבר לשתי ישיבות ההוכחות שנקבעו לחודש יוני 2013.
סיכומו של דבר, הבקשה מתקבלת. מעצרו של המשיב מוארך בתשעים ימים החל מיום 12.6.13 או עד למתן פסק דין בת"פ 28180-09-12 בבית המשפט המחוזי בירושלים, לפי המוקדם.
